There have been instances in which employers and beneficiaries have reported being negatively impacted by the increased processing times as it can delay their ability to file initial, extension of stay and change of status H -1 B petitions. USCIS has received requests from the public to accept the filing of H-IB petitions that include LCAs that have been filed with DOL, but that DOL has not yet certified. This memorandum provides guidance regarding the temporary acceptance of Form 1-129, Petition/or a Nonimmigrant Worker, for H-IB specialty occupations that have been filed with a Labor Condition Application (LCA), ETA Form 9035, that has not yet been certified by the Department of Labor (DOL).I This guidance applies to all H-IB petitions, including initial petitions, extension of stay petitions and change of status petitions. This memorandum does not permit the acceptance of H-IB specialty occupation petitions that do not include evidence that an LCA has been filed with DOL. Furthermore, it does not permit the approval of any H-l B specialty occupation petition where DOL has not yet certified the LCA or where certification of the LCA has been denied."

It is not necessary to hold such a case, however, if the alien is eligible for a waiver of inadmissibility and USCIS determines that, as a matter of discretion, the waiver should be granted. This guidance is provided in response to the Department of Health and Human Services' (HHS) publication on July 2, 2009, of a proposed rule to remove HIV from the list of communicable diseases of public health significance and is effective as of the date of this memo. It did not apply to aliens serving in a support capacity, P-2 or P-3 category or derivatives. This memorandum extends the March 6, 2009 guidance to P-1 essential support personnel ('P-1S personnel') of P-1 individual athletes. Specifically, this memorandum clarifies that P-1S essential support personnel of individual athletes: 1. Are not subject to a lifetime admission limit of 10 years in the United States; 2. May reapply for a new P-1S initial period of admission, based on an approved petition, after they have been in the United States for a 10 year period; and 3. Must depart the United States after 10 years in order to be eligible for a new initial period of admission of up to 1 year."

Employers sometimes need to hire foreign labor when there is a shortage of available U.S. workers to fill certain jobs. Under certain conditions, U.S. immigration law may allow a U.S. employer to file a Form I-129, Petition for a Nonimmigrant Worker, with U.S. Citizenship and Immigration Services (USCIS) on behalf of a prospective foreign national employee. Upon approval of the petition, the prospective employee may apply for admission to the United States, or for a change of nonimmigrant status while in the United States, to temporarily work or to receive training. For most employment-based nonimmigrant visa categories, the employer starts the process by filing Form I-129 with USCIS. Form I-129 is available on our website at www.uscis.gov.   "The USCIS quarterly report is designed to provide Congress with an update on the progress USCIS has made in its effort to eliminate the backlog of pending applications for immigration benefits by the end of FY 2006. This report will cover the progress made during the fourth quarter of FY 2005. Changes in the number of pending cases is itself significant when looking at performance. For the 4th quarter, pending fell by 594,560. But the pending level can be affected by changes in demand as well as production, and is not the best indicator of processing time. Current technology systems employed by USCIS District Offices and Service Centers are unable to produce reliable aging reports from which average wait times or processing times can be calculated. That said, USCIS believes that the 'Cycle Time' measurement, pending expressed in months of receipts, in conjunction with the first-in-first-out adjudication policy comes close to approximating average processing time. USCIS continues to define 'Backlog,' generally, as the number of pending cases that exceed acceptable or target pending levels for each case type. Acceptable pending levels are determined for each distinct case type by totaling the number of cases received during the target cycle-time period (usually six months). Backlogs are calculated for each case type, then totaled to determine the aggregate backlog. This ensures that backlogs in a product are not obscured by faster production of other products."

Garvey: "Thank you once again for the opportunity to appear before you this morning to discuss the President's budget request for Federal Aviation Administration [FAA] for 2001. First of all, just the put it in a little bit of context, the FAA is a 24-hour-a-day, seven-day-a-week service delivery organization. We safely manage approximately 200,000 take-offs and landings every day in a system that moves over 600 million airline passengers per year, and we expect that number to reach one billion within a decade. We anticipate 30 billion cargo ton miles of high priority shipped cargo this year, which represents an 88 percent increase since 1990. In the context of that dramatic growth in the industry, the President's budget provides the resources for us to continue the modernization of the national airspace system, or the NAS. Modernization of the NAS is a two-pronged effort. First of all, it is sustaining the infrastructure, those thousands of pieces of equipment that are out there, and, secondly, deploying the new technologies to improve the safety, to improve the efficiency of the airspace. But, again, we need to do this within the context of a 24- hour-a-day operation. The FAA has over 14,500 facilities and buildings. Many of our buildings are beyond their economic service life of 30 to 40 years, and these facilities are critical to support the technological advances we are bringing online. Just by way of example, the average age of an airport air traffic control tower is 26 years. Specifically at some of our Nation's busiest airports: the control tower at New York LaGuardia's Airport, for example, was commissioned in 1964; Washington's Dulles, commissioned in 1962; and Newark International Airport, commissioned in 1960. Clearly, there is a need for resources if the FAA is going to be able to meet the challenges of the 21st century, but the issue is not simply a matter of more money. It is also whether the FAA will have a steady and reliable source of funding for the investments required to ensure that the traveling public has a safe and reliable air transportation system."   From the opening statement of Thomas Petri: "Although the United States aviation system is very safe, when it comes to aviation safety there is always room for improvement. The top priority for our subcommittee is safety, and I know that the FAA [Federal Aviation Administration], aviation operators industry, and passenger advocate groups share that priority. With this in mind, today we will review the FAA's safety oversight activities, covering a broad range of issues. As we have noted many times in the past, the United States aviation system is the safest in the world. On any given day the FAA's air traffic controllers will handle over 28,500 commercial flights. In 2011, there were no commercial passenger airline fatalities. Over the past 5 years, roughly 52 million passenger flights were operated safely. This high level of safety is the result of collaborative efforts by the FAA, Congress, industry and by other stakeholders. But we must not forget the one tragic fatal commercial accident during those 5 years. We have taken steps with the passage of the Airline Safety and Federal Aviation Administration Act of 2010 to address the identified weaknesses that contributed to that tragedy, and we are accepting a statement for the record from the relatives of some of the victims of that airline disaster."   From the opening statement Frank LoBiondo: "The subcommittee is meeting this morning to examine the status of the Coast Guard's major acquisition program, and hear from the commandant on what his plans are to restore public faith in the program. Though the subcommittee previously held an acquisition hearing in April, we promised to revisit the issue often to ensure that the Coast Guard's major acquisition programs continue to improve by addressing valid concerns over rising costs, schedule delays, and capability shortfalls. As part of our oversight effort, the committee asked the Government Accountability Office to review the current program to determine whether it is still on track, and to make recommendations to ensure its success. The GAO [Government Accountability Office] is here today to present those findings and recommendations. In 2002 the Coast Guard signed the contract to begin the acquisition program formally known as Integrated Deepwater System. Deepwater was supposed to provide a complete recapitalization and modernization of the Service's larger aging assets, as well as its outdated communications and information systems over a 20-year period. Now nearly a decade later, the subcommittee is concerned that the Service has less to show for the investment of over $7 billion in taxpayer money than it should."
