  From the Document: "Domestic terrorism (DT) differs from other criminal activity in key ways. Importantly, unlike most offenders--who may be driven by self-centered motives--domestic terrorists are driven by a cause or ideology. The Federal Bureau of Investigation (FBI), the agency with lead responsibility for terrorism investigations at the federal level, generally relies on two definitions of DT. First, the Code of Federal Regulations [hyperlink] characterizes 'terrorism' as including 'the unlawful use of force and violence against persons or property to intimidate or coerce a government, the civilian population, or any segment thereof, in furtherance of political or social objectives.' Second, 18 U.S.C. [United States Code] §2331(5) [hyperlink] more narrowly defines 'domestic terrorism' as occurring primarily within U.S. territorial jurisdiction, and involving acts (A) ... dangerous to human life that are a violation of the criminal laws of the United States or of any State; (B) [that] appear to be intended-- (i) to intimidate or coerce a civilian population; (ii) to influence the policy of a government by intimidation or coercion; or (iii) to affect the conduct of a government by mass destruction, assassination, or kidnapping…[.] Domestic terrorists draw from many philosophies and worldviews [hyperlink] to justify their illegal acts. They can be motivated to commit crimes in the name of ideas such as animal rights, environmental rights, racially or ethnically based ideological objectives, anti-government or anti-authority beliefs, abortion-related beliefs, and anarchism [hyperlink], for example. Expression of these ideas--absent the commission of crimes--may involve constitutionally protected activity."

[...] This report covers a variety of topics on school crime and safety. It first examines different types of student victimization, including violent deaths and school shootings, nonfatal criminal victimization, and bullying victimization. Then, the report presents data on measures of school conditions--such as discipline problems, gangs, hate-related speech, possession of weapons, and use and availability of illegal drugs--as well as data that reflect student perceptions about their personal safety at school. This report wraps up the discussion on crime and safety issues at the elementary and secondary level by examining the percentages of teachers who reported having been threatened or attacked by their students."

Through the Department's partnerships with state, local, tribal, territorial, and university LEAs, and the Department's own law enforcement components, the Department recognizes that law enforcement officers (LEOs) at all ranks are striving to improve their response to reports of these crimes and seeking assistance and support for their efforts. Gender-based violence is violence and other harmful acts directed at an individual because of gender, which includes biological or perceived gender, sexual orientation, gender identity, and intersex traits. Gender-based violence is rooted in gender inequality, and perpetrators use violence to exert power and control over their victims. Examples include domestic violence, dating violence, sexual assault, stalking, sexual harassment, and gender-based hate crimes. While this guidance focuses on domestic violence and sexual assault, reducing gender bias in these areas will improve law enforcement responses to other forms of gender-based violence."

  From the Purpose and Summary: "Federal law enforcement agencies have reported that domestic violent extremists pose a steady and evolving threat of violence to our communities and especially to minority institutions. As threats and attacks have moved from one community to the next, the underlying drivers for domestic violent extremism--anti-government sentiment, racism, and anti-Semitism--have remained constant. H.R. 350, the ''Domestic Terrorism Prevention Act of 2022'' (DTPA), authorizes the creation of three offices, one each within the Department of Homeland Security (DHS), the Department of Justice (DOJ), and the Federal Bureau of Investigation (FBI), to monitor, investigate and prosecute cases of domestic terrorism. The newly created offices would provide joint biannual reports to Congress assessing the state of domestic terrorism threats, with a specific focus on white supremacists. In preparing the reports, the offices would review hate crime incidents to determine if those incidents also constituted domestic terrorism. Based on the data collected, DTPA requires the newly created offices to focus their resources on the most significant threats, as described in detail to Congress in the joint biannual report. DTPA also codifies the Domestic Terrorism Executive Committee, which would coordinate with United States Attorneys and other public safety officials to promote information sharing and ensure an effective, responsive, and organized joint effort to combat domestic terrorism. The legislation requires DOJ, FBI, and DHS to provide training and resources to assist state, local, and tribal law enforcement agencies in understanding, detecting, deterring, and investigating acts of domestic terrorism and white supremacy. Finally, DTPA directs DHS, DOJ, FBI, and the Department of Defense (DoD) to establish an interagency task force to combat white supremacist infiltration of the uniformed services and federal law enforcement."

  From the Document: "Hate, in and of itself, cannot be criminalized. When hate motivates criminal conduct, however, such conduct may be classified as a hate crime--defined by the Federal Bureau of Investigation (FBI) as a 'criminal offense against a person or property motivated in whole or in part by an offender's bias against a race, religion, disability, sexual orientation, ethnicity, gender, or gender identity.' According to the FBI, hate crimes are 'traditional offenses like murder, arson, or vandalism with an added element of bias.' In 2020, the FBI received reports of 8,263 incidents of bias-motivated crimes involving 11,472 victims. Hate crime laws have garnered significant public attention, as evidenced by the widespread media coverage of the reported rise in hate crimes during the Coronavirus Disease 2019 (COVID-19) pandemic. Over the years, Congress has maintained a perennial interest in hate crime laws, and a number of relevant proposals have been introduced in recent Congresses to either enact new or amend existing federal hate crime laws. [...] This Report begins with an overview of concepts key to understanding the applicability and scope of federal hate crime laws, and what it means for conduct to occur 'because of' a factor such as race, religion, gender, or other characteristics of a victim or person. It then examines the substantive provisions of the federal hate crime statutes listed above, and summarizes statutorily authorized penalties and the hate crime enhancement contained in the Guidelines.   From the Abstract: "In the United States, a number of challenges prevent an accurate assessment of the prevalence of hate crimes in different areas of the country. These challenges create huge gaps in our knowledge about hate crime--who is targeted, how, and in what areas--which in turn, hinder appropriate policy efforts and allocation of resources to the prevention of hate crime. In the absence of high-quality hate crime data, online platforms may provide information that can contribute to a more accurate estimate of the risk of hate crimes in certain places and against certain groups of people. Data on social media posts that use hate speech or internet search terms related to hate against specific groups has the potential to enhance and facilitate timely understanding of what is happening offline, outside of traditional monitoring (e.g., police crime reports). The current work assessed the utility of Twitter data to illuminate the prevalence of hate crimes in the United States with the goals of (i) addressing the lack of reliable knowledge about hate crime prevalence in the U.S. by (ii) identifying and analyzing online hate speech and (iii) examining the links between the online hate speech and offline hate crimes. The project drew on four types of data: recorded hate crime data, social media data, census data, and data on hate crime risk factors. [...] Although the results were inconsistent, they did point to the potential for using online behavior to identify offline risk. More exploration of implicit sentiments expressed online-- search terms, for example--may be more appropriate in the current context of social media platforms more strictly enforcing policies against the use of hate speech online."

  From the Introduction: "This manual is intended to assist law enforcement agencies (LEAs) in reporting incidents of hate crime to the Federal Bureau of Investigation's (FBI) Uniform Crime Reporting (UCR) Program. It addresses policy, the types of bias crime to be reported, how to identify a hate crime, and guidelines for reporting hate crime. Federal law requires the FBI to collect hate crime data from federal, state, local, tribal, and college/university law enforcement, however the law does not require those agencies to submit hate crime data to the FBI UCR Program. Their participation in the hate crime statistics collection is voluntary. Conversely, it is mandatory for federal law enforcement agencies to report hate crime data to the FBI UCR Program. It is the law enforcement officers within these agencies who investigate offenses, determine those motivated by bias, and report them as known hate crimes that have made crucial contributions to the success of the hate crime statistics collection. Without their continued support and participation in identifying bias-motivated crimes, the FBI would be unable to annually publish 'Hate Crime Statistics'. This partnership and, ultimately, this publication serve as the cornerstone in raising the nation's awareness about the occurrence of bias-motivated offenses."

[...] Section 249(a) of title 18, United States Code, is amended by adding at the end the following: [...] 'Whoever conspires to commit any offense under paragraph (1), (2), or (3), shall-- '(A) if death results from the offense, be imprisoned for any term of years or for life, fined in accordance with this title, or both; or '(B) in any other case, be subject to the same penalties as the penalties prescribed for the offense the commission of which was the object of the conspiracy.' [...] H.R. 55, the 'Emmett Till Antilynching Act,' would amend section 249 of title 18, United States Code, to specify lynching as a hate crime under federal law. The bill corrects a longstanding omission from federal civil rights law. [...] Lynchings were violent and public acts of torture used for nearly a century to enforce racial segregation. From the Document: "H.R. 55 would classify the act of lynching as a hate crime. Individuals who violate the bill's provisions could be subject to criminal fines, so the federal government might collect additional fines under the legislation. Criminal fines are recorded as revenues and deposited in the Crime Victims Fund. Those funds are later spent without further appropriation action, which is classified as direct spending. CBO expects that any additional revenues and associated direct spending would not be significant because few additional cases would probably be affected."

I am relieved that the individuals who viciously attacked a Jewish student have been charged with hate crime assault and grand theft. For one of the group's leaders this is the second time he has been charged with committing violent acts against innocent bystanders this year. These hateful and violent acts followed several incidents in which anti-Semitic flyers were left outside homes across Central Florida. [...] As the terrorism landscape has grown more complex and houses of worship are increasingly being targeted, the demand for this program has risen exponentially. To meet this demand, Congress has increased funding for Nonprofit Security Grant Program. Even with the recent increases, we still see a growing need for organizations to access this funding. According to Education's guidance, incidents of harassment or hate, when motivated by race, color, national origin, sex (including sexual orientation and gender identity), or disability status can impede access to an equal education. In certain circumstances, these kinds of incidents may violate certain federal civil rights laws, which Education's OCR [Office for Civil Rights] is tasked with enforcing in K-12 schools. GAO was asked to review hostile behaviors in K-12 schools. This report examines (1) the prevalence and nature of hostile behaviors in K-12 public schools; (2) the presence of K-12 school programs and practices to address hostile behaviors; and (3) how Education has addressed complaints related to these issues in school years 2010-11 through 2019-20."

  From the Foreword: "The Global Action Against Mass Atrocity Crimes (GAAMAC), with a culture of bringing together prevention experts and practitioners from across the world, commissioned the research that led to the production of this special report through the GAAMAC-Africa Working Group (G-AWG). The aim of the research was to garner evidence-based analysis regarding the Covid-19 [coronavirus disease 2019] pandemic and elections as atrocity crime triggers in Africa, and identify populations at risk of related hate speech, misinformation and fake news in three selected countries, Nigeria, Cameroon and South Sudan. As such, this empirical report through virtual and physical interviews, draws on the knowledge and expertise of different atrocity crimes prevention stakeholders and specialists at the local and national level, including regional and international atrocity crimes subject matter experts within and outside of Africa. The idea was to underscore how the Covid-19 pandemic on one hand and elections on the other serve as atrocity crime triggers on the continent. [...] Specifically, this report was based on extensive consultations, interviews and a desk review held between 12 October 2020 and 14 November 2020. The virtual and physical interviews were held mainly to validate the information from the desk review and possibly obtain new data from local NGOs, health-care practitioners and grassroots organizations. Evidence from the different communities in this study indicates that misinformation, fake news and related hate speech associated with Covid-19 in South Sudan and Nigeria are expressions of latent and manifest conflicts that persists between different groups within and across societies. Fundamentally, Covid-19 occurs within the intersection of pre-existing multiple tensions and differences, which the pandemic itself continues to reinforce."

Under Title X of the Civil Rights Act of 1964 and the Matthew Shepard and James Byrd, Jr., Hate Crimes Prevention Act of 2009, CRS responds to community conflicts arising from differences of race, color, national origin, gender, gender identity, sexual orientation, religion, or disability. CRS does not have investigative or prosecutorial authority. Rather, CRS impartially works with communities in conflict to help rebuild relationships, facilitate mutual understanding, and encourage the development of local solutions.   From the Document: "From October 1, 2004 to September 30, 2019, U.S. attorneys investigated a total of 1,864 suspects in matters involving violations of federal hate crime statutes. Federal prosecutors referred 17% of the suspects for prosecution. The number of hate crime matters investigated fell 8%, from 647 during 2005-09 (129 per year) to 597 during 2015-19 (119 per year). During the most recent 5-year period of 2015-19, nearly half (48%) of the 597 suspects investigated for a hate crime were referred to U.S. attorneys for Hate Crimes Prevention Act (HCPA) violations. This report uses data from the Bureau of Justice Statistics' Federal Justice Statistics Program to describe criminal prosecutions over federal hate crimes from 2005 to 2019."

As the effects of the pandemic were felt immediately, so was the far-right's response to it. From the very first days of the pandemic, extreme right groups took to social media to spread misinformation and conspiracies about both the virus itself and governments' responses to it [hyperlink]. Although there are strong and widespread concerns about the pandemic leading to increased engagement with extremism, we are yet to experience the full velocity of the situation. This includes a diversification of engagement and overlaps between different fringe organisations and ideas. As one particular example, this has manifested in the spread of coronavirus-related conspiracy theories concerning lockdown measures, vaccines, masks, and other pandemic restrictions, and wider far-right conspiracies around immigration, asylum, anti-government and establishment positions, and anti-globalist and capitalist agendas. On the ground, these conspiracies have contributed to a rise in antisemitic hate speech and hate crimes (both on- and offline) as well as vandalism. Europe has been at the centre of much of this messaging."

  From the Executive Summary: "Are Jews able to live openly and freely as Jews, in whatever manner they wish? The answer to this question is fundamental for judging antisemitism in any country. The factors that go into that assessment include: (1) Prevalence of antisemitic attitudes among the general population; (2) Number and nature (or severity) of antisemitic incidents; (3) Tolerance for antisemitic rhetoric in public, whether in politics or media; and (4) Actions (or inaction) by governments to counter and prevent antisemitism. This latter category may include physical security for Jewish institutions, public denunciations of antisemitism by political leaders, prosecution of antisemitic hate crimes, and education against antisemitism. For the purpose of this study, researchers asked questions on those topics of Jewish community leaders and government officials in 11 countries. These inquiries were informed and complemented by desk research to develop profiles of how antisemitism manifests in each country and how governments are addressing antisemitism. Those 11 country profiles constitute Part I of this report."

From the Document: "The vast majority of those who serve in our Armed Forces have no connection to white supremacy or extremism and uphold the best traditions of our nation's democratic ideals. Though the number of extremists associated with the Armed Forces who engage in hate crimes and criminal extremist activity is relatively small, their capabilities and specialized weapons training make them prime targets for extremist propaganda and recruitment. Recent investigations have identified dozens of veterans and active-duty servicemembers who are affiliated with white supremacist activity. This is far from a new problem. In fact, the SPLC has been documenting white supremacist infiltration of the military and urging officials to take substantial and systematic action since 1986. Over the course of the 116th Congress, the Committee has investigated this issue, including conducting a hearing entitled 'Hate Crimes and the Rise of White Nationalism' on April 9, 2019. In the hearing witnesses highlighted Congress' critical role in addressing the disturbing increase in white supremacist violence, provided examples of how hate groups have proliferated inside the United States, and detailed how social media platforms have become dangerous recruiting tools in the white nationalist movement. [...] With three-fourths of all domestic terrorist attacks coming from white supremacists, the federal government must allocate its resources to the most deadly threats. H.R. 5602 authorizes the collection of data, call for the results of the data collection to be published, and requires the FBI to focus its resources on the greatest threats. Additionally, H.R. 5602 authorizes the creation of three offices, one each within the Department of Homeland Security (DHS), the Department of Justice (DOJ), and the Federal Bureau of Investigation (FBI), to monitor, investigate and prosecute cases of domestic terrorism. The newly created offices will provide Congress joint biannual reports assessing the state of domestic terrorism threats, with a specific focus on white supremacists."
