2,059 Criminals Arrested In ICE Nationwide Operation [March 9, 2015]

On March 9, 2015, the Department of Homeland Security issued the following press release: "WASHINGTON - A five-day nationwide operation targeting convicted criminal aliens subject to removal from the United States yielded the arrest of 2,059 convicted criminals. The operation was led by U.S. Immigration and Customs Enforcement's (ICE) Enforcement and Removal Operations (ERO). 'This nationwide operation led to the apprehension of more than 2,000 convicted criminal aliens who pose the greatest risk to our public safety,' said Deputy Secretary of Homeland Security Alejandro Mayorkas. 'Today, communities around the country are safer because of the great work of the men and women of U.S. Immigration and Customs Enforcement.' The operation, dubbed 'Cross Check,' began Sunday, March 1, and ended Thursday, March 5. Hundreds of ERO officers participated in the operation that focused on the arrests of public safety threats. Those arrested are from 94 countries and have a wide array of criminal convictions. The 2,059 individuals with prior criminal convictions who were arrested include more than 1,000 individuals who have multiple criminal convictions. More than 1,000 of those arrested have felony convictions, including voluntary manslaughter, child pornography, robbery, kidnapping and rape. Of the total 2,059 criminals arrested, 58 are known gang members or affiliates, and 89 are convicted sex offenders. The vast majority of misdemeanor convictions were for driving under the influence of alcohol or drugs (DUI). ICE considers DUI offenders, particularly repeat offenders, to be a significant public safety threat. Of those arrested during this operation, 476 were illegal re-entrants who had been previously removed from the country. Because of their serious criminal histories and prior immigration arrest records, 163 of those arrested during the enforcement action were presented to U.S. Attorneys for prosecution on a variety of charges, including illegal re-entry after deportation, a felony punishable by up to 20 years in prison."

"Human trafficking is a serious crime that must be confronted by our economies in this region, especially with so many human trafficking victims coming from Asia. Amidst growing prosperity and development, no person should be exploited through the use of force, coercion, or fraud. No one should ever have to be subjected to human trafficking, forced into sexual exploitation, or recruited and forced to serve as a gang member, child soldier, or terrorist. The societal harms and impacts posed by human trafficking are very real. Corruption helps to fuel it and enriches not only those criminal networks behind today's modern slavery but also enables corrupt police, customs, judicial, and other security officials who protect traffickers and allow them to carry out their criminal activities. Human trafficking siphons away the human capital potential of communities to build sustainable economic growth in a manner that respects human rights. No person should ever have a price tag attached to their heart and soul nor be restricted, abused, and violated against their physical integrity and free will. Yet, over 20 million people are estimated to be entrapped in modern slavery. "The Department of Justice (DOJ) is responsible for enforcing the Controlled Substances Act of 1970 (CSA) and in recent years has updated its marijuana enforcement policy in response to the rising number of states that have legalized marijuana under state law. In August 2013, DOJ updated its marijuana enforcement guidance with instructions for DOJ's prosecutorial and law enforcement components to focus marijuana enforcement efforts on priorities that it stated were particularly important to the federal government, such as preventing revenue from the sale of marijuana from going to criminal enterprises, gangs and cartels, preventing violence and the use of firearms in the cultivation and distribution of marijuana, and preventing the distribution of marijuana to minors. My statement today is based on our December 2015 report on DOJ's marijuana enforcement efforts and plans for monitoring the effects of state legalization of marijuana. My statement, like the report, addresses: (1) the features of Colorado's and Washington's systems to regulate the production, processing, and sale of recreational marijuana; (2) the extent DOJ is monitoring the effects of state marijuana legalization relative to its 2013 marijuana enforcement policy guidance; and (3) the factors DOJ field officials reported affecting their marijuana enforcement actions in selected states that have legalized marijuana for medical purposes."

Taken from the annotation: "'Cell phones, smuggled in by guards or family members and activated with hard-to-trace prepaid calling plans, are a lifeline for criminals and gang members to order hits, buy drugs and plan escape attempts from behind bars. Correction officials have identified the problem of cell phones in prisons as one of the toughest issues they face. The purpose of this project is to design, implement and test an effective system for the detection and localization of cellular phones in correctional facilities. The key purpose of the proposed effort is to mature the prototype Time Difference Of Arrival (TDOA) and signal strength detection for location system from laboratory to deployment in a correctional facility, and capable of detecting and locating cell phones in real time. Another key purpose is to explicitly use the known building floor plan in the algorithm that processes the received cell phone signals in to the likely location' (p. 10). Sections contained in this report are: introduction and background; hardware receiver system development; cell phone signal transmitter; signal processing and algorithm development; experiments and results; Tartarus--the resultant system of hardware and software; products; participants and other collaborating organizations; impact; changes and problems; budgetary information--system cost ranging from $10,000 to $25,000 depending on facility size; and conclusions and future work. Illegal Immigration in the United States: Implications for Rule of Law and National Security

Without the rule of law, serious social tensions will occur that impel states and localities to fill the void left by the lack of immigration enforcement. In the worst case, citizens themselves will consider taking the law into their own hands when rule of law is not consistently and uniformly applied by a sovereign nation. National security is also negatively impacted by failure to enforce immigration law. This paper explores the impact of drug and human trafficking organizations, transnational gang infiltration, increased terrorist vulnerability, increased violence along the southwest border region and the growing threat of internal separatist movements. Military Assistance to Mexico: Use of Special Operations Forces

From the thesis abstract: "Currently Mexico is facing serious internal security problems that the United States has observed closely. The Mexican government has all but lost control of parts of its northern border and surrounding territories. Drug cartels have infiltrated these border areas along with Mexican police departments and judicial institutions. [...] This problem is greater than the Mexican border as many U.S. cities have a cartel presence too. Solving the security threat in Mexico is important to the United States. Mexican President Felipe Calderon is very aggressive in targeting the drug cartels and associated corruption and violence. Nevertheless, Mexico cannot succeed without external assistance. The 2008 Merida Initiative is a good start and provides $1.6 billion during FY2008 - FY2010 to Mexico and Central America in order to fight drug trafficking, gangs and organized crime. Mexico requires advisory assistance in rebuilding its law enforcement capability and border interdiction capacity. U.S. SOF [special operations forces] can augment Merida and provide expert training and mentorship in order to help the Mexican authorities consolidate and strengthen its governmental institutions and rule of law. SOF assistance to Mexico is not free of challenges. Some analysts argue any type of military presence results in a harmful militarization of the situation. Furthermore, the U.S.- Mexico military relationship has not always been hospitable. Hence, a U.S. military presence on Mexico soil is very politically sensitive. Overcoming these issues is possible and events such as military exercises would demonstrate the willingness of the U.S; to cooperate and strengthen relationships between the two countries."

Comparative Analysis into U.S. Military Abuses at the My Lai Massacre and Abu Ghraib Prison Scandal

From the thesis abstract: "Incidents of abuse by U.S. service members, even if few and far between, have nearly irreversible impacts on the United States, including straining foreign relations, decreasing public support of U.S. policy, and negating counterterrorism efforts. A lot of research exists to discover why individuals participate in abuse, but little is known why individuals report abuse. This thesis looks at various models and their subcomponent elements from four bodies of literature: psychology; terrorist engagement; terrorist disengagement, deradicalization, and non-radicalization; and gang involvement, to better understand the disparate behavior between abusers and whistleblowers. After extracting applicable elements, a preliminary model to explain the difference between abusers and whistleblowers is formed, and then tested comparatively against two case studies: the My Lai massacre, and the Abu Ghraib prison scandal. The preliminary model is then discarded of elements that failed to explain the differences in behavior, leaving a final model. Measures to deter abuse and encourage reporting are then derived from this final model, leaving the reader with an enhanced understanding of not just why individuals participate in abuse, but why, under relatively similar conditions, others actively stop or report the abuse."

"The National Incident-Based Reporting System (NIBRS) was implemented to improve the quality of crime data collected by law enforcement by capturing detailed information on each single crime occurrence. Designed for law enforcement, the NIBRS has the flexibility to gather administrative facts on crime incidents as well as varied information about the victims, offenses, arrestees, and property involved in them. Accordingly, the offenses are categorized as Crimes Against Persons, Crimes Against Property, and Crimes Against Society. NIBRS reporting provides information on most of the criminal justice issues facing law enforcement today--terrorism, white collar crime, information about assaults on law enforcement officers, offenses in which weapons were involved, drug/narcotic offenses, hate crimes, domestic and familial abuse including elder abuse, juvenile crime, gang-related crime, parental abduction, organized crime, and pornography, as well as arrest data related to driving under the influence. In addition, NIBRS reporting captures whether the offender was suspected of using drugs/narcotics or alcohol during or shortly before the incident and whether the offender used computer equipment to perpetrate the crime."

Policing the Connected World: Using Social Network Analysis in Police-Community Partnerships

"Law enforcement agencies are increasingly using social network analysis (SNA) to understand the organization of gangs and other criminal networks, to identify their relationships, and to analyze data that can be used to focus crime prevention efforts. This report details the implementation of a SNA program developed by the COPS Office in partnership with Yale University. Created as part of a violence prevention initiative in New Haven, Connecticut, the Project Longevity SNA program emphasizes the value of community collaboration when gathering critical information such as the location and membership of these groups. In 1991, the U.S. Department of Justice established Operation Weed and Seed--a community-based multiagency approach to law enforcement, crime prevention, and neighborhood restoration. The goals of Weed and Seed are to control violent crime, drug trafficking, and drug-related crime in targeted high-crime neighborhoods and provide a safe environment free of crime and drug use for residents. The Weed and Seed strategy brings together federal, state, and local crime-fighting agencies, social service providers, representatives of the public and private sectors, prosecutors, business owners, and neighborhood residents under the shared goal of weeding out violent crime and gang activity while seeding in social services and economic revitalization. The Weed and Seed strategy is a two-pronged approach to crime control and prevention: law enforcement agencies and prosecutors cooperate in "weeding out" criminals from the target area "seeding" brings prevention, intervention, treatment, and neighborhood revitalization services to the area. Four fundamental principles underlie the Weed and Seed strategy. These include collaboration, coordination, community participation, and leveraging resources. These principles set Weed and Seed apart from traditional approaches of the past and are key to the success of the strategy at the neighborhood level. Weed and Seed is a comprehensive response to crime and neighborhood deterioration. Therefore, the strategy is a multilevel strategic plan that includes four basic components: law enforcement, community policing prevention, intervention and treatment, neighborhood restoration. Key elements of the plan include a steering committee and a strategic plan.

"The Regional Information Sharing Systems (RISS) Program links law enforcement agencies throughout the nation, providing secure communications, information sharing resources, and investigative support to combat multijurisdictional crime and terrorist threats. Currently, RISS serves more than 7,100 local, state, federal, and tribal law enforcement member agencies in all 50 states, the District of Columbia, U.S. territories, Australia, Canada, and England. RISS is a national program made up of six centers that operate in geographic regions of varying size, serving the unique needs of law enforcement in each region while fostering information sharing among all levels of law enforcement across the country. RISS communications and information sharing services are designed to help member agencies thwart terrorism, narcotics trafficking, organized crime, violent crime, cybercrime, and gang activity. Responding to national security needs, RISS has expanded its resources to include services that allow information sharing and secure collaboration among public and private entities critical to the protection of the nations population and infrastructures."

"This report describes Weed and Seed programs and practices that have been effective in reducing crime, violence, and juvenile delinquency while increasing neighborhood vitality and economic strength. The Weed and Seed program in Albuquerque, NM, has emphasized weeding out violent crime, gang activity, drug use, and drug trafficking. Of the many programs developed to address these issues, one of the most innovative was the creation of the community and prosecutions coordinator (CPC) position in the district attorney's office. The CPC maintains and uses a database with information on drug-trafficking cases to track the scheduling of court hearings for the purpose of keeping crime victims and neighborhood organizations informed of cases that affect them and their communities. The Bethel Weed and Seed initiative in Eugene, OR, has had two particularly notable successes that stemmed from a series of public safety forums sponsored by the program. These were the creation of a user-friendly brochure on safety tips and suggestions for dealing with neighborhood drug trafficking and the development of a cooperative relationship between police and community residents in setting priorities for public-safety actions...The four components of the program are law enforcement; community policing; prevention, intervention, and treatment; and neighborhood restoration. The Weed and Seed program in Humboldt, TN, has led to interagency and intergovernmental cooperation in addressing drug dealing in the city, the development of a community-policing strategy that has reduced the fear of crime and improved the overall quality of life, reduction in school drop-out rates, and neighborhood restoration through code enforcement.
