DHS also adjudicates petitions for certain visa categories and has certain responsibilities for strengthening the security of the visa process, including oversight of VSP [Visa Security Program] and VWP [Visa Waiver Program]. State manages the visa adjudication process for foreign nationals seeking admission to the United States. This statement addresses (1) CBP [Customs and Border Protection] programs aimed at preventing high-risk travelers from boarding U.S.-bound flights; (2) ICE's [Immigration and Customs Enforcement] management of VSP; and (3) DHS's oversight of VWP. This statement is based on prior products GAO [Government Accountability Office] issued from March 2011 through January 2017, along with selected updates conducted in April 2017 to obtain information from DHS on actions it has taken to address prior GAO recommendations. […] GAO previously made recommendations to improve evaluation of CBP's predeparture programs' performance and strengthen DHS's oversight of VSP and VWP. DHS agreed with GAO's recommendations related to CBP's predeparture programs and VWP. DHS did not agree with some of GAO's recommendations related to VSP. GAO has ongoing work related to, among other things, DHS's management and oversight of VSP and plans to report later this year on the results of this work."

  Rob Simmons: "The 9/11 Commission estimated that annually approximately 500,000 people enter this country illegally, without inspection, and overstay their legal welcome. Many come for opportunities that America provides, and we understand that, but others have a more sinister intent. In order to better protect our borders, we need to know who is attempting to cross, and what are they bringing into this country, and why. Our border immigration and Coast Guard officials protect more than 5,000 miles of the border with Canada, 1,900 miles of border with Mexico, and approximately 12,400 miles of shoreline east and west. To protect this vast international border, intelligence-driven operations will be the key to targeting and interdicting these threats before their arrival. On a typical day Federal officials will apprehend over 3,000 people trying to cross between ports of entry, and on a typical day will intercept one person for terrorism or national security-related reasons. These apprehensions net fraudulent documents and seemingly innocuous pocket litter, both of which can have tremendous intelligence value. Therefore, DES frontline operators must have the tools, the training, capability and processes in place to weave the information from these everyday encounters into a comprehensive intelligence picture."   On February 10, 2015, the Department of Homeland Security issued the following press release: "I continue to stress the need for a DHS appropriations bill for FY 2015, unburdened by politically charged amendments that attempt to defund our executive actions on immigration reform. The President has made plain that he will veto a bill that includes such language. At present, the Department of Homeland Security is operating on a continuing resolution that expires on February 27. As long as this Department is funded by a continuing resolution, there are a whole series of activities vital to homeland security and public safety that cannot be undertaken. The public must be aware of the real impacts to homeland security as long as DHS is funded by a continuing resolution, or, still worse, if Congress were to permit our funding to lapse altogether and the Department of Homeland Security goes into government shutdown. Last week I issued a statement noting the impact on DHS's grant-making activity to states, local and tribal governments as long as we are on a CR. Basically, we are prevented from funding all new non-disaster assistance grants. The public must also be aware of the impact on our ability to secure the borders as long as we operate on a CR. As part of our executive actions to reform the immigration system, the President and I have emphasized increased border security. Added border security is also a key component of the President's FY 2015 and FY 2016 budget submissions to Congress. But, as long as this Department is on a CR, and not a full-year appropriations bill, our ability to strengthen border security, to include maintaining the resources we put in place to respond to the surge in illegal migration into south Texas last summer, is constrained."

A porous border is a conduit for drug smugglers and human traffickers, and a vulnerability terrorists may exploit. Supporting and overseeing the Department of Homeland Security's efforts to secure the Nation's borders is a principal responsibility of the Congress. Over ten years after the creation of the Department of Homeland Security (DHS), the Department still lacks a National strategy to secure the borders or reliable metrics to measure border security progress. Since the attacks of September 11th, 2001, Congress has appropriated billions of dollars to enhance border security, primarily through new investments in personnel, technology, and infrastructure. Despite billions of dollars and decades of policy debates, the border is not secure. Illegal entries into this country continue at an astounding pace, and criminal enterprises have continued to exploit our weaknesses to get drugs, weapons, and other illicit goods into our communities. The Committee believes that operational control must be achieved through smart deployments of technology and infrastructure and progress must be assessed using robust border security performance measures. The required operational plan should be a roadmap to enable the Department to achieve requirements set forth in the legislation."

The issue of illegal human smuggling is not new to the United States-Mexico border, or to law enforcement agencies; however, the phenomenon continues to increase while smugglers adjust to law enforcement tactics. This paper is a synopsis of the thesis entitled 'Modeling the U.S. Border Patrol Tucson Sector for the Deployment and Operations of Border Security Forces' which describes and identifies the fundamental dimensions of U.S. Border Patrol operations in the busiest, most vulnerable section of the border. This paper seeks to provide a comprehensive picture of the complex dynamics along the U.S. Border Patrol Tucson Sector and highlights the primary challenges facing policymakers in developing innovative policies that will minimize illegal cross-border activity and secure the homeland."

  On January 22, 2015, the Department of Homeland Security issued the following press release: "The 'Secure Our Border First Act of 2015' voted out of the House Homeland Security Committee last night is not a serious effort at legislating border security -- and its authors know it. The bill is extreme to the point of being unworkable; if enacted, it would actually leave the border less secure. The bill sets mandatory and highly prescriptive standards that the Border Patrol itself regards as impossible to achieve, undermines the Department of Homeland Security's capacity to adapt to emerging threats, and politicizes tactical decisions. In the meantime, the bill does nothing to provide what the Department of Homeland Security really needs from Congress -- appropriated funding to pay for vital homeland security initiatives. That includes both the additional resources we put on the border last year, and the additional technology, equipment and other resources we need from Congress to further secure the border. As long as the Department of Homeland Security continues to function on a continuing resolution, as it is now, we are limited in our ability to deploy these critical tools, along with other resources vital to homeland security. Unfortunately, H.R. 399 is unworkable, plain and simple. I again encourage Congress to support the homeland security professionals at this Department with the resources they need, without provisions that would micromanage their work or restrict their flexibility in dealing with the nation's critical homeland security efforts."

  "U.S. Department of Homeland Security (DHS) Secretary Janet Napolitano announced today that Predator Unmanned Aerial System (UAS) flights will begin out of Corpus Christi, Texas, beginning on Wednesday, Sept.1. With the deployment of an UAS in Texas, DHS unmanned aerial capabilities will now cover the Southwest Border--from the El Centro Sector in California all the way to the Gulf of Mexico in Texas--providing critical aerial surveillance assistance to personnel on the ground. The new, border-wide use of the Predator aircraft, comes on the heels of the recently passed Southwest border security supplemental legislation, which will provide two additional UASs that will bolster these newly expanded operations. These UAS efforts are just the latest steps in the historic approach--and unprecedented amount of resources -- that the President and this Administration have directed to the southwest border since launching the Southwest Border Initiative in March 2009. Since then, the U.S. Department of Homeland Security has doubled the number of personnel assigned to border enforcement security task forces; tripled the number of Immigration and Customs Enforcement officers working along the U.S.-Mexico border; quadrupled deployments of border liaison officers; and begun screening 100 percent of southbound rail shipments for illegal weapons, drugs, and cash."

  "To address smuggling along the U.S. southwest border, the U.S. Border Patrol developed CDS [Consequence Delivery System]--a process to classify each apprehended alien into criminal or noncriminal categories and apply consequences, such as federal prosecution. Each Border Patrol sector ranks up to eight consequences from Most to Least Effective and Efficient to reduce recidivism. GAO [Government Accountability Office] was asked to review and assess Border Patrol's implementation of CDS across the southwest border. This report examines the extent to which Border Patrol (1) has a methodology for calculating recidivism that allows it to assess CDS program effectiveness, (2) applied consequences it determined to be most effective and efficient in each southwest border sector and (3) established guidance and controls to monitor field implementation of CDS. GAO analyzed Border Patrol's recidivism rate methodology; apprehension data and CDS application along the southwest border for fiscal years 2013 through 2015, the most recently available data; and DHS's U.S. Immigration and Customs Enforcement data on alien removals. GAO also interviewed Border Patrol personnel and reviewed CDS guidance. GAO is making six recommendations to strengthen the methodology for measuring recidivism, assess reasons agents do not apply CDS guides' Most Effective and Efficient consequence, and ensure performance management oversight. DHS concurred with all but one recommendation, which relates to strengthening its recidivism methodology, citing other means to measure CDS performance. GAO believes the recommendation remains valid, as discussed in the report."

  "From January 2003 to September 2007, GAO testified before the Committee on three occasions to describe security vulnerabilities that terrorists could exploit to enter the country. GAO's first two testimonies focused on covert testing at ports of entry-the air, sea, and land locations where international travelers can legally enter the United States. In its third testimony, GAO focused on limited security assessments of unmanned and unmonitored border areas between land ports of entry. GAO was asked to summarize the results of covert testing and assessment work for these three testimonies. This report discusses the results of testing at land, sea, and air ports of entry; however, the majority of GAO's work was focused on land ports of entry. The unmanned and unmonitored border areas GAO assessed were defined as locations where the government does not maintain a manned presence 24 hours per day or where there was no apparent monitoring equipment in place. GAO assessed a nonrepresentative selection of these locations and did not attempt to evaluate all potential U.S. border security vulnerabilities. Further, GAO's work was limited in scope and cannot be projected to represent systemic weaknesses. In response to this report, DHS provided a written update on numerous border protection efforts it has taken to enhance border security since 2003. GAO did not attempt to verify the information provided by DHS, but has included the response in this report."

[...] A legacy system in operation since 1987, TECS has become increasingly difficult and expensive to maintain due to the system's antiquated technology and its inability to support the requirements needed by CBP and ICE personnel in the field. From the opening statement of subcommittee chairman Candice Miller: "The commerce that moves through the nation's ports of entry powers our economy, drives job creation and is fundamental to our way of life. If ports of entry shut down, or traffic is backed up -- millions of dollars may be lost, economic growth comes to an abrupt halt, travelers find other destinations to visit, and would-be customs revenue destined for the U.S. Treasury goes away. Despite the importance of ports of entry to the nation's economic health, port of entry modernization efforts have been significantly underfunded, and Customs and Border Protection [CBP] staffing has not kept pace with growing demand. While CBP is frequently asked to provide new or additional service at ports of entry across the country, CBP is often unable to accommodate these requests due to staffing shortages and other resource constraints. Over the past few years this Congress has appropriated more than $2 billion dollars for port of entry construction, but that is dwarfed by the estimated $ 4-6 billion dollars needed to fully modernize our ports of entry. Air passenger volumes are growing at a rate of 4 to 5 percent a year, the nation has experienced a 24% increase in cargo containers since the dark days of the Great Recession, and more cars and trucks transit the land ports of entry than ever before. We are falling further behind every year to match the demands placed on our CBP officers and infrastructure."   "Federal and tribal lands on the U.S. borders with Canada and Mexico are vulnerable to illegal cross-border activity. The Department of Homeland Security (DHS)--through its U.S. Customs and Border Protection's Office of Border Patrol (Border Patrol)--is responsible for securing these lands, while the Departments of the Interior (DOI) and Agriculture (USDA) manage natural resources and protect the public. GAO [Government Accountability Office] was asked to examine the extent that (1) border security threats have changed on federal lands; (2) federal agencies operating on these lands have shared threat information and communications; and (3) federal agencies have coordinated budgets, resources, and strategies. GAO reviewed interagency agreements and threat assessments; analyzed enforcement data from 2007 through 2009; and interviewed officials at headquarters and two Border Patrol sectors selected due to high volume of illegal cross-border activity (Tucson) and limited ability to detect this activity (Spokane). GAO's observations cannot be generalized to all sectors but provide insights. This is a public version of a sensitive report that GAO issued in October 2010. Information that DHS deemed sensitive has been redacted. […] GAO is recommending that DOI and USDA determine if more guidance is needed for federal land closures, and that DHS, DOI, and USDA further implement interagency agreements. […] The U.S. Customs and Border Protection (CBP) processes approximately 1.18 million people entering the United States through established ports of entry every day. CBP is also responsible for monitoring between legal entry points along the Northern and Southern borders and intercepting individuals attempting to cross the border. Border patrol officers also act as first responders, rescuing individuals in danger from extreme weather or violent situations at illegal entry points. Surveillance technology acts as a 'force multiplier,' which allows border patrol agents to augment their patrols with ground based and aerial observation capabilities. Examples of currently in-use security technologies include infrared sensors, automated cameras, and seismic sensors to detect motion, as well as air based observational equipment to monitor a large area. Many promising technologies are still not feasible for full implementation along the border because of numerous barriers: high cost, lack of robustness in harsh conditions, lack of personnel trained to properly use high-tech equipment, and technical problems. DHS S&T has primary responsibility for bringing new technologies to full readiness, with support from other agencies such as the National Institute of Standards and Technology, which provides testing and validation services."   "In the decades leading up to September 11, 2001, protecting U.S. land borders was not viewed as a national security issue. It was either a drug or crime or immigration problem, but not one rising to the level of national security. Accordingly, during this time, many critical problems which had been previously identified by border communities, industry groups, the Government Accountability Office (GAO), academics as well as congressional committees were largely ignored. Issues such as deteriorating infrastructure, inadequate facilities, insufficient staffing, stove-piped organizations, poor intelligence and dysfunctional immigration laws were repeatedly identified but never adequately addressed. Since 9/11, this has changed. Significant attention has once again been focused upon our borders in general, and specifically the nation's 7,000 mile-long land borders. The specter of terrorists crossing our land borders to attack our homeland is now a justifiable concern especially in light of a growing number of instances of terrorists or suspected terrorists being caught crossing our land borders. This report demonstrates that, even three years after the 9/11 attacks, our Southern Border is still porous and ripe for exploitation by terrorists seeking to enter the United States. Our national security depends on making this border more secure to prevent terrorists from entering the United States."

This paper compares the Southwest Border Initiative and the future Merida Initiative (Beyond Merida) as available options to improve border security and subsequently U.S.-Mexico relations. The paper thus illustrates the aims, cost and impact of the three major imperatives encompassed by the Southwest Borders Initiative to illustrate its applicability to current and future border security. After identifying the best future option, the author provides recommendations as the U.S. administration plans for and initiates future southwest border initiatives. Finally, the paper draws conclusions concerning options to posit that the Southwest Borders Initiative will deliver the best long-term results."
