This is a testimony compilation of the September 10, 2015 hearing "Examining Vulnerabilities of America's Power Supply" held before the House Committee on Science, Space, and Technology. From the opening statement of subcommittee chairman Barry Loudermilk: "The electricity infrastructure of the United States is aging, and the electric power industry is in the process of modernizing it with its transformation to the 'smart grid' -- the technology that provides an increased use of digital information and control technology to improve reliability, security, and efficiency of the electric grid. That process of modernization, however, introduces new vulnerabilities in addition to ones that have existed for over a century. This hearing will discuss those various threats to the national electric grid, including: severe weather or other natural events; cyber, physical, or coordinated attacks; space weather; and electromagnetic pulse (EMP) attacks. […] Mitigating these vulnerabilities and their potential consequences is ultimately essential for the safety and security of all Americans. Protecting our power supply is something that is crucial for day to day life activities and things that we take for granted -- like heating and cooling a home or powering a business -- as well as ensuring our national security." Congressional Budget Office Cost Estimate: S. 1846: Critical Infrastructure Protection Act of 2015
"S. 1846 would require the Department of Homeland Security (DHS) to undertake research and planning activities to mitigate the potential consequences of electromagnetic pulses and geomagnetic disturbances-resulting from either intentional acts or natural causes-on critical infrastructure, such as public utilities and national security assets. DHS is currently carrying out programs similar to those required by the bill, and CBO [Congressional Budget Office] estimates that implementing S. 1846 would not significantly affect spending by the department. Because enacting the legislation would not affect direct spending or revenues, pay-as-you-go procedures do not apply. S. 1846 contains no intergovernmental or private-sector mandates as defined in the Unfunded Mandates Reform Act and would not affect the budgets of state, local, or tribal governments. On July 13, 2015, CBO transmitted a cost estimate for H.R. 1073, the Critical Infrastructure Protection Act, as ordered reported by the House Committee on Homeland Security on June 25, 2015. The two bills are similar and CBO's estimates of the budgetary effects are the same."

Critical Infrastructure Protection: Preliminary Observations on DHS Efforts to Address Electromagnetic Threats to the Electric Grid, Statement of Christopher P. Currie, Director, Homeland Security and Justice, Testimony Before the Committee on Homeland Security and Governmental Affairs, U.S. Senate
"The threat posed by an electromagnetic pulse (EMP) or solar weather event could have a debilitating impact on the nation's critical electrical infrastructure, as well as other key assets that depend on electricity. These events could lead to power outages over broad geographic areas for extended durations. Addressing these risks requires collaboration among multiple government and industry stakeholders; with DHS in the lead role for overall infrastructure protection efforts, working in coordination with DOE [Department of Energy]. The EMP Commission, established by statute and comprised of subject matter experts, issued recommendations in 2008 addressing the preparation, protection and recovery of critical infrastructures against a possible EMP attack. The majority of these recommendations were made to DHS and DOE. This testimony is based on preliminary observations from GAO's [Government Accountability Office] ongoing review of DHS's efforts to address electromagnetic threats. Specifically, this testimony addresses the extent to which DHS has: (1) taken action to address recommendations from the 2008 EMP Commission Report and (2) coordinated with other principal federal agencies, such as DOE and industry stakeholders to mitigate risks to the electric grid from electromagnetic threats. GAO reviewed EMP Commission recommendations and DHS program documents, and interviewed relevant stakeholders who provided insights on key issues and coordination activities with the federal government to address these threats."

This is a testimony compilation of the July 14, 2015 hearing "Fundamental Role of Safe Seismic Surveying in OCS [Outer Continental Shelf] Energy Exploration and Development" held before the House Committee on Natural Resources. From the testimony of Dr. Robert Gisiner: "I will start by stating categorically and confidently that there is at present no scientific support for statements that seismic sound kills or injures animals, causes them to beach themselves or disrupts their behavior to the extent that it affects the health and well-being of the individuals or the populations of which they are a part. This does not mean that we will not continue to actively search for possible undetected risks through our support of independent, third-party research, or that we will reduce our diligence in monitoring, mitigation and documentation of our activities and their environmental effects. It does mean that speculations of what could, might, or may potentially occur will be subjected to the same high standards of scientific verification and validation that would be expected of our own industry-funded research. […] Current claims that seismic sound kills, injures or causes the beaching of marine mammals, fish or other species are speculation and are not supported by the available scientific evidence. Recent research has in fact shown that the sound exposure threshold at which some small hearing loss might occur would be greater than 210 decibels of total energy (SEL). That is equivalent to the cumulative sound energy from ten consecutive seismic air pulses at a distance of less than 100 yards from even the largest arrays." Physical Security of the U.S. Power Grid: High-Voltage Transformer Substations [Updated July 2, 2015]
From the Summary: "There is widespread agreement among government agencies, utilities, and manufacturers that HV [high voltage] transformers in the United States are vulnerable to terrorist attack, and that such an attack potentially could have catastrophic consequences. But the most serious, multi-transformer attacks could require acquiring operational information and a certain level of sophistication on the part of potential attackers. Consequently, despite the technical arguments, without more specific information about potential targets and attacker capabilities, the actual risk of a multi-HV transformer attack remains an open question. As the electric power industry and federal agencies continue their efforts to improve the physical security of critical HV transformer substations, Congress may consider several issues as part of its oversight of the sector: identifying critical transformers, confidentiality of critical transformer information, adequacy of HV transformer protection, quality of federal threat information, recovery from HV transformer attacks, and the overall resiliency of the grid. Maintaining an integrated perspective on prevention, recovery, and resilience may help to promote an effective balance among industry investment, regulatory requirements, and federal oversight."

National Space Weather Strategy (Draft)
"Reducing the Nation's vulnerability to space weather is a national priority. Space weather describes the variations in the space environment between the sun and Earth that can affect infrastructure systems and technologies in space and on Earth. It can disrupt the technology that forms the backbone of our economic vitality and national security, including satellite and airline operations, communications networks, navigation systems, and the electric power grid. These key components of our Nation's infrastructure and economy are increasingly at risk from space weather storms. The Strategic National Risk Assessment identifies space weather as a hazard that poses significant risk to the security of the Nation. This Strategy builds on recent significant efforts to reduce risks associated with natural hazards and improve the resilience of critical facilities and systems. It aims to foster a collaborative environment in which government, industry, and private citizens can better understand and prepare for the effects of space weather. As a Nation, we must continue to leverage our existing national network of expertise and capabilities and pursue targeted enhancements to improve our ability to manage risks associated with space weather."

Quadrennial Energy Review: Energy Transmission, Storage, and Distribution Infrastructure
From the section 'Summary for Policymakers': "The U.S. energy landscape is changing. The United States has become the world's leading producer of oil and natural gas combined. The country is less dependent on foreign oil, as a percentage of national oil consumption, than it has been since 1971. Current cars can go farther on a gallon of gas than ever before. Between 2005 and 2014, U.S. consumption of motor gasoline fell 2.6 percent despite population growth of 7.6 percent and gross domestic product growth of 13.0 percent. Additionally, as a result of changes in economic structure and conditions and policies to promote energy efficiency, U.S. electricity consumption was flat over that 10-year period and total energy use declined by 1.9 percent. […] This first installment of the QER [Quadrennial Energy Review] addresses infrastructures for energy transmission, storage, and distribution (TS&D), broadly defined as infrastructures that link energy supplies, carriers, or by-products to intermediate and end users. This focus was chosen because the dramatic changes in the U.S. energy landscape have significant implications for TS&D infrastructure needs and choices. Well-informed and forward-looking decisions that lead to a more robust and resilient infrastructure can enable substantial new economic, consumer service, climate protection, and system reliability benefits. Good decisions on TS&D infrastructure can also provide flexibility in taking advantage of new opportunities to achieve our national energy objectives."

This testimony compilation is from the February 25, 2015 hearing, "State of Technological Innovation Related to the Electric Grid," before the U.S. Senate Committee on Energy & Natural Resources. From the opening statement of Chairman Lisa Murkowski: "No other electricity network on Earth provides as much power to as many people as reliably and affordably as our American grid. It really is a modern marvel and I think we should be proud of what we've accomplished. Keeping the lights on - as all segments of the industry have for the past 100 years - is not just about flicking a switch or changing a bulb. It's a highly complex and technical undertaking that requires scores of talented individuals. We have also reached a very good point in time to be looking at this subject this morning. The grid was built incrementally, but the rate at which it changes, or is compelled to change, appears to be accelerating. A combination of market forces, technological innovation, and policy directives at both the federal and the state level could well result in an unprecedented transformation of the electricity sector. […] This Administration has rightly classified the electric grid as 'super critical' infrastructure because so many things -- communications, roadways, and hospitals -- depend upon a functioning grid. The reliability of our nation's grid is therefore paramount, and the impact of policy directives must be seriously considered -- not dismissed as somehow anti-environment or anti-future." This is the July 14, 2015 hearing "United States Department of Homeland Security" held before the House Committee on the Judiciary. From the opening statement of Committee Chairman Bob Goodlatte: "While testifying this March, ICE [Immigration and Customs Enforcement] Director Saldaña expressed her enthusiastic support for mandatory detainers. Then, the very next day, she retracted that statement made under oath and called mandatory detainers highly counterproductive. There are now more than 200 jurisdictions, including San Francisco, which refuse to honor ICE detainers. This effectively releases criminal aliens onto the streets with all too tragic results. Secretary Johnson's solution, the Priorities Enforcement Program, is a failure. Politely asking for cooperation from sanctuary cities is a fool's errand. The clear answer to this problem is for DHS to mandate compliance with detainers and for this Administration to defend the mandatory nature of detainers in Federal court. Unfortunately, the Administration has taken neither of these crucial steps to keep our communities safe. Prior to Secretary Johnson's appointment, DHS, under the Obama administration, went beyond simple nonenforcement and took the leap of granting administrative amnesty to a class of hundreds of thousands of unlawful aliens. Then, last November, Secretary Johnson announced that DHS would grant such deferred action to over 4 million more unlawful aliens. By granting these classes of people deferred action, he would bestow benefits such as legal presence, work authorization, and access to the Social Security trust fund, and the earned income tax credit. It is within the constitutional authority of Congress, not the Administration, to grant such benefits to classes of unlawful aliens. Twenty-six States believe that Secretary Johnson's planned grant of deferred action en masse would cause them irreparable harm. They challenged the plan in Federal court.
