The subpoenaed document is a memorandum to you from the Director of the Federal Bureau of Investigation ('FBI') and the Administrator of the Drug Enforcement Administration ('DEA'), containing confidential advice and recommendations regarding efforts to combat drug trafficking. The Subcommittee first requested this document on September 17, 1996. By letter dated September 27, 1996, the Deputy Counsel to the President informed the Subcommittee of the White House's concerns regarding the need to preserve the confidentiality of deliberative communications to the President and indicated that the Department of Justice is prepared to accommodate the Subcommittee's request by providing a briefing on the subject addressed by the memorandum."

  "Islamic radicalism in North Africa has three faces-a religious one which seeks through personal piety, prayer, and preaching to make society more "just"; a reformist one which calls for legitimate political action using democratic, electoral means to change state and society from within; and an extremist face, which believes that only violent confrontation and destruction of the state can establish a new Islamic world order. Algeria, Tunisia, Morocco, Libya, and Egypt tend to regard the latter two as equally dangerous to regional and regime stability. Their concerns about regional security, if radical Islamists were to gain power, grew in 1991 when an Islamist political party-the Islamic Salvation Front (FIS)-scored a major election victory and appeared to be on the verge of gaining power in Algeria. Over the subsequent four years, Algeria's neighbors watched in growing horror while the military-dominated Algerian government canceled elections, outlawed the FIS, and the country slipped into the chaos of urban terrorism and civil war. Determined not to repeat Algiers' mistake in allowing an Islamist party access to the political process, Tunis, Rabat, and Cairo sought to eliminate the opportunities for radical Islamist politicians to force a confrontation with the government, legally or illegally. Even Libya's Muamar Qadhafi, a long-time sponsor of Islamic 'liberation' movements, was not immune from Islamist-inspired opposition riots in several towns. Their answer was similar to that of the Algerian government-exclusion from the political process and containment through intimidation and force."

  "Chapter 443 of title 49 authorizes the Secretary of Transportation to offer insurance and reinsurance to air carriers conducting flights 'necessary to carry out the foreign policy of the United States Government.' […] Apparently, disputes arise from time to time as to whether liability to compensate an air carrier is properly assigned to the policy issued under the Secretary's authority, the so-called 'war-risk' insurance, or to the air carrier's general, or 'all-risk,' policy. You have asked whether such insurance and reinsurance policies issued pursuant to the Secretary's authority may provide for resolution of such disputes under a '50-50 clause.' Under a 50-50 clause, the all-risk and war-risk insurers each advance half of the amount payable under their policy at the time of the loss, assuring that the insured air carrier is fully compensated immediately. The 50-50 clause provides that insurers then submit their dispute as to liability to binding arbitration, unless the insurers are able to negotiate a settlement in advance."

• TRIAGE of Irradiated Personnel

  AERRI [Armed Forces Radiobiology Research Institute] was tasked by the Army Office of the Surgeon General to answer operational questions concerning three issues related to the triage of irradiated personnel deployed forward. These issues, and the workshop participants' consensus responses, are: (1) Effects of radiation injuries on exposed personnel, assuming Level I and Level II medical care and facilities. Individuals receiving over 1.5 Gy should be evacuated; those receiving less than this amount may return to duty. Even at this level, 30% of exposed personnel may be too ill to return to duty. Those who recover will experience varying degrees of persistent fatigue and weakness. Dose assessment at this level is best served by physical dosimetry. (2) Describe these effects in previously exposed personnel. Physical dosimetry is required for personnel who are at risk of a second exposure; no animal model completely predicts the effects of either protracted or multiple radiation exposure in humans. Fatigue and weakness in multiply exposed personnel will be cumulative.

  "This audit report was requested by Senator David Pryor, Ranking Minority Member of the Senate Governmental Affairs Subcommittee on Post Office and Civil Service, to assess potential conflicts of interest among members of the Defense Science Board (DSB) and to assess balance concerning their points of view. More than 25 years ago, the Secretary of Defense established DSB as a Federal advisory committee to provide objective and expert scientific advice to DoD on major policy decisions affecting weapon system acquisitions and other procurements costing billions of dollars. The Office of the Under Secretary of Defense for Acquisition and Technology (USDA&T) provides management oversight of DSB activities. DSB members are selected on the basis of their experience in the fields of science and technology and their application in military operations, research, engineering, and manufacturing. Task forces conduct studies under the auspices of DSB on a wide range of Defense matters. The task forces were composed of subject matter experts from industry, academia, and Government. For calendar years 1994 and 1995, about 35 task forces were initiated, with 25 reports issued at the time of our audit."

  "You have requested my legal advice as to whether executive privilege may properly be asserted with respect to documents that are the subject of a subpoena issued to the Executive Secretary of the National Security Council ('NSC') by the Committee on International Relations of the House of Representatives. The documents concern the Administration's conduct of foreign affairs with respect to Haiti. […] Although the question of Congress's oversight authority in this context must be viewed as unresolved as a matter of law, it is clear that congressional needs for information in this context will weigh substantially less in the constitutional balancing than a specific need in connection with the considerations of legislation. Based on the Office of Legal Counsel's review of the documents for which assertion of executive privilege has been requested, and conducting the balancing required by the case law, […] I do not believe that access to these documents would be held by the courts to be 'demonstrably critical to the responsible fulfillment of the Committee's functions.' Senate Select Committee, 498 F.2d at 731. In conclusion, it is my legal judgment that executive privilege may properly be asserted in response to the Committee's subpoena."

  The 1988 terrorist bombing of Pan Am Flight 103, which killed 270 people, and the more recent, and as yet unexplained, explosion aboard TWA flight 800 have shaken public confidence in the safety and security of air travel. The threat of terrorism against the United States has increased, and aviation remains an attractive target for terrorists. This testimony focuses on measures that need to be taken to protect the flying public from terrorists and how technology can improve aviation safety. The General Accounting Office (GAO) discusses (1) the aviation security system and its vulnerabilities, (2) the availability and limitations of explosives detection technology and other methods to counter the threat, and (3) efforts under way to bolster aviation security. This GAO report also addresses the September 1996 recommendations from the Presidential Commission on Aviation Security and Terrorism.

  "We have been asked to provide our views on the obligations imposed by the Establishment Clause on the treatment of sacred sites under Executive Order No. 13007. That Order states that each federal agency with responsibility for the management of federal lands 'shall, to the extent practicable, permitted by law, and not clearly inconsistent with essential agency functions, (1) accommodate access to and ceremonial use of Indian sacred sites by Indian religious practitioners and (2) avoid adversely affecting the physical integrity of such sacred sites.' […] Questions concerning the permissible means for implementing this executive order have arisen in the wake of a recent federal district court decision enjoining a National Park Service regulation that prohibited the issuance of commercial climbing licenses at Devils Tower, a sacred site in Wyoming, during the religiously significant month of June. We believe that this case was wrongly decided and that the federal government has broad latitude to accommodate the use of sacred sites by federally recognized Indian tribes. In the first section of this memorandum, we lay out the general principles that govern the accommodation of religion under the Establishment Clause. In the second section, we address the principles applicable to the accommodation of sacred sites. We then apply those principles to the Devils Tower case."

  "My own sense is that what was clear to Theodore Roosevelt at the start of the 20th Century is still true today as America prepares to enter the 21st Century. In every field-politics, economics, technology-we are living in an era of 'rich possibilities.' Our hopes are symbolized by the emergence of democracy around the globe, by the growth of new global trade relationships, by the expansion of global communications and by the explosion of information. In this era, the term 'closed society' is rapidly becoming obsolete. One does not need to look any further than beyond the front page of this morning's Washington Post to see how rich the possibilities are--a physician at Mount Vernon Hospital in Fairfax County was able to have a dictated patient medical summary transcribed within four hours. .. not by the hospital clerical staff in Virginia. .. but by a medical transcriptionist in Bangalore, India using high- speed data lines to throw first the voice recording and then the completed transcript halfway around the globe! But along with these rich new opportunities, there is a dark side of fears: the fear of the proliferation of weapons of mass destruction, the fear of ancient ethnic hatreds ripping apart multiethnic states, the fear of terrorism by extremist groups, and the fear of aggression by rogue nations freed from the constraints of their former Cold War alliances. The security of the United States continues to require us to maintain strong military forces to deter and if necessary, to defeat those who threaten our vital national interests. I also believe that national security-ours and that of our friends and allies-now, and in the future, will increasingly rely on cooperation."
