• Strategies for the War on Terrorism: Results of a Special Study

  Following the events of 9/11, President and Lab Director, Paul Robinson, asked Dr. Yonas and the Advanced Concepts Group (ACG) to develop a long-term (3-5 year) technology roadmap showing how Sandia could direct efforts to making major contributions to the success of the nation's war on terrorism. The ACG study was conducted in two phases. The first, more exploratory, stage divided the terrorism challenge into three broad parts, each examined by a team that included both permanent ACG staff and part-time staff and consultants from other Sandia organizations. The "Red" team looked at the problems of finding and stopping terrorists before they strike. The "Yellow" team studied the problems of protecting people and facilities from terrorist attacks, as well as those of responding to attacks that occur. The "Green" team attempted to understand how technology might help ameliorate the conditions that lead people to support, or even become, terrorists. From the many ideas explored by the Red, Green, and Yellow teams, the ACG assembled a set of five major technology development goals. These goals, if pursued, could lead to major contributions to the war on terrorism. With some rearrangement of team members and coordinators, a new set of teams began fleshing out these five "Big Hairy Audacious Goals" for the consideration of Laboratory leadership. Dr. Yonas briefed Sandia upper management on the work of these teams on February 4, 2002. This report presents the essence of that work as applicable to the RBD community of the nation interested in the development of better tools for a long term "War on Terrorism."

• Virtual Border: Countering Seaborne Container Terrorism

  America's potential vulnerability to terrorist attack through exploitation of the global trade and transportation system is now widely recognized. Maritime commerce, and container shipping in particular, provides a highly attractive means not only of delivering weapons but also of smuggling terrorists themselves into the American homeland. This situation stems in part from a lack of information specifying cargo contents, complicating U.S. Customs Service efforts to identify high-risk containers for inspection upon arrival, and from the commercially driven need to move trade goods rapidly through the transportation system. The first and most important line of defense against container terrorism, therefore, is at the foreign point of origin. A virtual border must be designed to provide a multilayered defense, addressing container security from the initial loading of the container to its movement through the entire international transportation network.

  "In this monograph, Lieutenant Colonel Raymond Millen examines NATO's extraordinary performance and incisive initiatives during the immediate post-Cold War years. While other security organizations and concepts have faded in importance and utility, NATO has made sweeping changes to remain relevant, and its unique enforcement mechanism means it has no security peer. Organizationally, NATO remains the greatest cost effective hedge against future threats and possesses the greatest potential for the full spectrum of conflict, to include crisis management. Notwithstanding its successes, NATO does need to conduct simple reforms, which, if implemented, will result in enormous cost savings and greater interoperability among new and old members. Allied bickering may result, but if the United States insists on their implementation, all members will fall in line. Lieutenant Colonel Millen scrutinizes the impact of enlargement on the Alliance, not only from a military but also a geopolitical perspective. He is quick to point out that, without the needed reforms, new members will bring more fat than muscle to the Alliance. However, the process of enlargement has served to harmonize Central and Eastern Europe with Western Europe in a remarkable manner. That achievement alone has made enlargement worthwhile."

  From the Executive Summary: "On May 1, 2002, an exercise was conducted in the Plume Exposure Pathway emergency planning zone (EPZ) around the Millstone Power Station by the Federal Emergency Management Agency (FEMA), Region I. The purpose of the exercise was to assess the level of State and local preparedness in responding to a radiological emergency. The exercise was held in accordance with FEMA's policies and guidance concerning the exercise of State and local radiological emergency response plans (RERP) and procedures. The most recent exercises at this site were conducted on March 15, 2000 (plume exposure pathway), and October 8-10, 1997 (ingestion exposure pathway). [...] This report contains the final evaluation of the biennial exercise and the evaluation of the following out-of-sequence activities: [1] School demonstrations in the Town of Groton, City of Groton. and Montville on May 2, 2002; [2] Nursing homes including Mariner (East Lyme), Camelot (New London), and Mystic Manor (Groton) on May 2, 2002; [3] New Haven Congregate Care Centers on May 31, 2002; and [4] New Haven Emergency Operations Center (EOC) and Host Community Drill on June 1, 2002. The State and local organizations, except where noted in this report, demonstrated knowledge of their emergency response plans and procedures and adequately implemented them. There were no Deficiencies and seven Areas Requiring Corrective Action (ARCA) identified as a result of this exercise. Two of these seven ARCAs were successfully redemonstrated."

  This Report addresses matters identified in the NTIA Report to Congress in January of 2002, and it reflects the Federal Communications Commission's efforts to meet the communications needs of the energy, water and railroad industries. Energy, water and railroad interests are critical to the nation's infrastructure and rely on radio spectrum to perform core operations, ranging from routine monitoring to emergency responses. The Commission is especially sensitive to needs involving domestic security concerns. Therefore, the spectrum needs of the designated industries as well as others must be very carefully balanced and efficient use of the spectrum must be encouraged. Recent and ongoing actions of the Commission, as will be discussed, demonstrate how the Commission is responding to maximize the use of the airwaves. The Report is divided into three sections. Section I provides the background on the NTIA Report and this Report, presents the major concerns identified in the NTIA Report, and offers an overview of the communications systems used by the energy, water and railroad industries ("designated industries") and the bands currently used by these industries. Section II addresses major actions that the Commission has taken to address the spectrum requirements of the designated industries. Section III provides the FCC Staff's response to the matters identified by NTIA.

• Review and Consolidation of Business Management Systems for the Proposed Department of Homeland Security

  On July 19th, OMB provided guidance to Department of Homeland Security (DHS) component agencies on preventing redundant IT infrastructure. That guidance recognized that an effective DHS requires high quality integrated common systems. The guidance also established the Homeland Security IT Investment Review Group as the executive review group for IT investments proposed by DHS component agencies. A similar opportunity for effectiveness and economy exists in the case of management systems for financial management, procurement, and human resources. Not only is consolidation possible, it has been used effectively in the recent past. In 1998, the Department of Interior's National Business Center consolidated payroll systems for Interior, the Social Security Administration, the Department of Education and many smaller agencies onto the Federal Personnel Payroll System. The result was a payroll system that worked better and cost 25 percent less. Currently, DHS component agencies all use different financial management systems, and lack a common automated system for either procurement or human resources.

  "The events of September 11 brought the Immigration and Naturalization Service (INS) to the forefront of the nation's attention. Although all 19 hijackers entered the country legally, three overstayed their visas. And, on March 11, 2002, INS sent student visa notifications for two of the (now deceased) 19 hijackers to the aviation school they attended, provoking an intensification of long-standing criticism of INS for weak management controls, among other things. An underlying theme of criticism concerns what many believe are overlapping and unclear chains of command with respect to INS's service and enforcement functions. There appears to be a consensus among the Administration, Congress, and commentators that the immigration system, primarily INS, is in need of restructuring. There also appears to be a consensus among interested parties that INS's two main functions -- service and enforcement -- need to be separated. There has not been a consensus, however, with regard to how the restructuring should take place. Current proposals to restructure INS center on separating the service and enforcement functions either by keeping INS intact and creating two separate bureaus to carry out the functions, or by dismantling INS and reassigning the functions to DOJ [Department of Justice] and other agencies. While separating the two main functions would create a clear chain of command and increase accountability, several questions are raised. Are these functions operationally separable or interdependent? Will both functions receive equal attention and resources? How will separating the main functions address the fragmentation of immigrant-related functions across INS and other federal agencies? How will the separate entities expeditiously share information?"

  "Congress is now considering proposals to create a Department of Homeland Security. Since World War II, Congress has created or implemented major reorganizations of seven of the now existing 14 Cabinet departments. This report describes the principal elements of legislative process that established the Departments of Defense; Health, Education, and Welfare (HEW) (now, in part, Health and Human Services); Housing and Urban Development; Transportation; Energy; Education; and Veterans Affairs. Congressional consideration of legislation establishing Cabinet departments has generally exhibited certain common procedural elements. In each case, successful congressional action was preceded by a presidential endorsement, the submission of draft legislation, or, in one instance, a reorganization plan by the President. [...] Votes in committee and on final passage were generally by comfortable majorities. An exception was the House consideration of the Department of Education bill (H.R. 2444, 96th Congress), which cleared committee by a single vote and passed the House by a four-vote margin. Finally, with the exception of the joint resolution approving the Department of HEW reorganization plan, all the legislation went to conference to resolve differences between House and Senate versions. With two exceptions, conferees were drawn from the reporting committees. House and Senate Veterans Affairs Committee members joined the conference on the Department of Veterans Affairs legislation, and members of the Senate Energy and Natural Resources Committee and the House Post Office and Civil Service Committee served on the Energy Department conference."

• Review of the Estimates for the Impact of the September 11, 2001, Terrorist Attacks on New York Tax Revenues

  GAO reviewed the New York City Office of Management and Budget and the New York State Division of Budget estimates of tax revenue losses attributed to the September 2001 terrorist attacks. Both offices estimated that the attacks would reduce anticipated tax revenues to the city and state in both fiscal years 2002 and 2003. The budget offices' estimates of the tax revenue losses have limitations, such as including some of the economic slowdown that was under way at the time of the attacks. Nevertheless, the tax revenue loss estimates for the 2002 fiscal year--$1.6 billion for New York City and $1.6 billion for New York State--appear to reasonably approximate the impact of the attacks on tax revenues. Precisely measuring the effect on economic activity and related tax revenues is inherently difficult. Such measuring requires disentangling the effect of the attacks from the effects of other events. As of June 2002, the federal government had authorized funds of $10.4 billion to New York to partly compensate for the economic losses attributable to the attacks, including $6.4 billion for debris removal and temporary housing assistance. Nonetheless, the specific amount of funding obligated solely to New York City has not yet been compiled.

  "One of the major trade issues in the 107th Congress is whether or not Congress approves trade promotion authority (formerly called fast-track authority) for the President to negotiate trade agreements with expedited procedures for implementing legislation. Under this authority, Congress agrees to consider legislation to implement the trade agreements (usually nontariff trade agreements) under a procedure with mandatory deadlines, no amendment, and limited debate. The President is required to consult with congressional committees during negotiation and notify Congress before entering into an agreement. The President was granted this authority almost continuously from 1974 to 1994, but the authority lapsed and has not been renewed. A major issue has been the role of labor and the environment as objectives in trade agreements. Differences have been largely along party lines. […] According to the press reports on July 26, 2002, conferees reached agreement on a conference report late July 25. It is possible that the House might vote on the conference report on July 25 or 26, and that the Senate might vote during the week of July 29. The House approved H.Res. 450 on June 26 by a vote of 216-215. On May 23, 2002, the Senate passed comprehensive trade bill H.R. 3009 by a 66-30 vote. Title XXI of H.R. 3009 includes TPA provisions similar, but not identical, to the House-approved TPA provisions. The House approved TPA bill H.R. 3005 along party lines by a vote of 215-214, on December 6, 2001."

  "Congress is presently debating how the structure and responsibilities of a new Department of Homeland Security will impact state and local preparedness for terrorism. Both H.R. 5005 and S. 2452 would consolidate state and local assistance programs into the new department. The department would also be responsible for coordinating the development and implementation of federal, state, and local response plans. At present, Congress authorizes several federal agencies to conduct programs designed to help state and local responders enhance their preparedness for terrorist attacks, particularly attacks involving weapons of mass destruction. These programs cover a range of activities, including emergency planning; training and equipment; response to chemical and biological attacks; law enforcement; and public health. As Congress determines the responsibilities of a new Homeland Security Department, it might consider a range of policy issues frequently mentioned by state and local emergency managers and analysts."

The General Accounting Office (GAO) found that the Transportation Security Administration (TSA) has assumed responsibility for aviation security and has focused on meeting congressionally mandated deadlines for strengthening aviation security: TSA has developed plans and implemented procedures for using federal employees to conduct security screening at more than 400 commercial airports, hired and begun to train nearly 4,000 key security personnel and has undertaken more rigorous background checks of workers with access to secure areas at airports. Overall, TSA faces immediate challenges in assuming responsibility for security in other modes of transportation, improving the performance of screeners, and addressing aviation security issues not covered by the Aviation and Transportation Security Act's current-year deadlines.   "The United States has been a leader of worldwide efforts to prevent the spread of nuclear weapons. To this end, the international community and many individual states have agreed to a range of treaties, laws, and agreements, known collectively as the nuclear nonproliferation regime, aimed at keeping nations that do not have nuclear weapons from acquiring them. The nonproliferation regime has also been concerned with preventing terrorists from obtaining a nuclear weapon or the materials to craft one. The attacks on New York and Washington September 11 added a new level of reality to the threat that terrorists might acquire a nuclear weapon and explode it in a populated area. Other nonproliferation concerns include a number of regional crisis points: the India- Pakistan arms race, North Korea, and the Middle East, primarily Iraq, Iran, and Israel. There is concern about China's actions in expanding its nuclear force, and of Chinese and Russian activities that may encourage proliferation in the other regions."

  These are remarks by President Bush supporting Elizabeth Dole for Senate. Bush also discusses the progress in the war on terror and the proposal to make changes that will strengthen the homeland including a reorganization of the federal government and the creation of the Department of Homeland Security. Bush explains the best way to secure the homeland, defend freedom, and make America safe is to hunt down the terrorists and bring them to justice. Bush continues using Afghanistan as an example of the consequences of the harboring of terrorists.

  "DOE initially recognized the need for external safety regulation in 1993, when Secretary Hazel OLeary announced that the department would seek external regulation for worker safety. In 1994, legislation was proposed and hearings held on externally regulating nuclear safety at DOE facilities. Although no legislation was enacted, DOE responded by creating advisory groups to help formulate its policies and implement plans to eliminate self-regulation of nuclear and worker safety in all of its facilities. To achieve this goal, in 1996, DOE endorsed recommendations to phase out its self-regulation practices over a 10-year period. In late 1997, however, DOE took a more cautious approach when Secretary Federico Pea embarked on a 2-year pilot program to simulate regulation by NRC and OSHA at selected facilities. Among other themes, these simulations were developed to test regulatory approaches and determine the cost of moving to external regulation. Despite NRC and OSHA conclusions from these pilots that externally regulating DOEs science laboratories was achievable, Secretary Bill Richardson decided not to pursue external regulation, citing cost and other regulatory uncertainties. In this context, we reported in 1998 (and again in congressional testimony in 1999 and 2000) that DOE did not have a clear strategy on external regulation. In a subsequent overview report on DOE, we recommended eliminating self-regulation, among other necessary actions, to help improve the accountability of the department."

  "The Committee on Rules, having had under consideration House Resolution 502, by a nonrecord vote, report the same to the House with the recommendation that the resolution be adopted. The resolution provides for the consideration of H.R. 5005, the Homeland Security Act of 2002, under a structured rule. The rule provides 90 minutes of general debate equally divided and controlled by the chairman and ranking minority member of the Select Committee on Homeland Security. The rule waives all points of order against consideration of the bill. The rule provides that the amendment in the nature of a substitute recommended by the Select Committee on Homeland Security now printed in the bill shall be considered as an original bill for the purpose of amendment and shall be considered as read. The rule waives all points of order against the bill, as amended. The rule provides that no amendment to the committee amendment in the nature of a substitute shall be in order except those printed in this report and amendments en bloc described in section 3 of the resolution. The rule provides that each amendment printed in this report may be offered only in the order printed in this report, may be offered only by a Member designated in this report, shall be considered as read, shall be debatable for the time specified in this report equally divided and controlled by the proponent and an opponent, shall not be subject to amendment, and shall not be subject to a demand for division of the question in the House or in the Committee of the Whole, except as specified in section 4 of the resolution."

  "The explosion in computer interconnectivity, while providing great benefits, also poses enormous risks. Terrorists or hostile foreign states could launch computer-based attacks on critical systems to severely damage or disrupt national defense or other critical operations. Presidential Decision Directive (33 and Executive Order 13231, issued in 1998 and 2001, respectively, call for various actions to improve our nation's critical infrastructure protection (CIP) , including establishing partnerships between the government and the private sector. CIP involves activities that enhance the security of our nation's cyber and physical public and private infrastructure that are essential to national security, national economic security, and/or national public health and safety. The President's national strategy for homeland security, issued last week, identifies protecting critical infrastructures and intelligence and warning, a critical CIP component, as two of six mission areas and expands our nation's approach to cover additional sectors of our economy (see graphic). At the subcommittee's request, GAO [General Accountin Office] discussed challenges the nation faces in protecting our critical infrastructures and addressing federal information security."

  This public law is an act to provide for an independent investigation of Forest Service firefighter deaths that are caused by wildfire entrapment or burnover. "In the case of each fatality of an officer or employee of the Forest Service that occurs due to wildfire entrapment or burnover, the Inspector General of the Department of Agriculture shall conduct an investigation of the fatality. The investigation shall not rely on, and shall be completely independent of, any investigation of the fatality that is conducted by the Forest Service. As soon as possible after completing an investigation under section 1, the Inspector General of the Department of Agriculture shall submit to Congress and the Secretary of Agriculture a report containing the results of the investigation."

  "The Select Committee on Homeland Security, to whom was referred the bill (H.R. 5005) to establish the Department of Homeland Security, and for other purposes, having considered the same, report favorably thereon with an amendment and recommend that the bill as amended do pass. […] H.R. 5005, the Homeland Security Act of 2002, will create the Department of Homeland Security (DHS) to provide for the security of the American people, territory, and sovereignty within the United States. The Department of Homeland Security will help fulfill the Constitutional responsibility of the Federal government by providing for the common defense by uniting, under a single department those elements within the government whose primary responsibility is to secure the United States homeland. This department will have the mission of preventing terrorist attacks within the United States, reducing the United States' vulnerability to terrorism, minimizing the damages from attacks, and assisting in recovery from any attacks, should they occur. The Department's primary responsibilities will include: analyzing information and protecting infrastructure; developing countermeasures against chemical, biological, radiological, and nuclear attacks; securing U.S. borders and transportation systems; organizing emergency preparedness and response efforts; conducting homeland security related research, development, technology, and acquisition programs; coordinating counter-terrorism activities with other Federal agencies, State and local governments, and the private sector. The Department will bring together 22 existing Federal agencies or portions of agencies under a single clear chain of command. Each of these agencies will continue to be responsible for carrying out existing and homeland security functions."
