Fact Sheet: Executive Order on Optimizing the Security of Biological Select Agents and Toxins in the United States [July 2, 2010]

Shipboard Technology Evaluation Program (STEP): Experimental Ballast Water Treatment Systems
"The purpose of this circular is to implement a Shipboard Technology Evaluation Program (STEP) through which foreign and domestic vessel owners/operators can apply for acceptance to install and operate experimental ballast water treatment (BWT) systems on their vessels. Treatment systems will not be accepted into STEP independent of a specific vessel. The STEP is a voluntary program available to all vessels subject to the Coast Guard's Ballast Water Management (BWM) regulations, 33 CFR § 151 Subparts C and D. STEP is intended to facilitate the development of effective BWT technologies, thus creating more options for vessel owners/operators seeking alternatives to ballast water exchange. Technology developers and vessel owners/operators have agreed on the need for incentives that will encourage the development of prototype treatment systems and shipboard testing. However, vessel owners/operators have expressed a reluctance to invest the resources to install and operate an experimental treatment system that might not meet discharge standards mandated by future regulations. To address this concern, vessels accepted into this program may be granted an equivalency to future ballast water discharge standard regulations, for up to the life of the vessel or the system, while the prototype system operates satisfactorily. The length of the period of equivalency is dependent upon the date on which the vessel applies to the experimental program."

"This circular notifies the shipping industry of the interim procedures adopted by the U.S. for demonstrating compliance with the requirements of Regulation 16 of Annex II of MARPOL 73/78, which became effective on January 1, 2003. These include guidelines for preparation of Shipboard Marine Pollution Emergency Plans for Noxious Liquid Substances required for certain vessels, for approval of those plans by the U.S. Coast Guard, and for making approved plans available for review by any port State which is signatory to this MARPOL 73/78 annex visited by the vessel. This circular also provides guidance for determining compliance with Regulation 16 by foreign flag vessels. This circular will remain effective until the publication of a final rule implementing Regulation 16 of Annex II in Title 33, Code of Federal Regulations, Part 151, but shall not exceed two years from the promulgation date of this circular. […]. This guidance allows for the submission and approval of one response plan to meet the requirements of the Vessel Response Plans required by the Oil Pollution Act of 1990 (OPA 90), Shipboard Oil Pollution Emergency Plans (SOPEPs) required by regulation 26 of Annex I of MARPOL 73/78, Shipboard Marine Pollution Emergency Plans for Noxious Liquid Substances (SMPEP-NLS), or Shipboard Marine Pollution Emergency Plans (SMPEPs) required by regulation 16 of Annex II of MARPOL 73/78."

Environmental Inspection Checklist; Addendum to Foreign Passenger Vessel Examination Book, CG-840
"As the result of a GAO [General Accounting Office] report and Bluewater Network petition, the FCCA [Florida-Caribbean Cruise Association], FDEP [Florida Department of Environmental Protection], and the Coast Guard began discussing the means to improve and ensure the compliance of large passenger vessels with existing Federal and state environmental standards. These discussions have resulted in the checklist contained in Enclosure 1. This checklist is an extensive list of possible inspection items related to pollution prevention equipment, operation, plans and records. It is intended as a job aid to be used by Coast Guard personnel during certificate of compliance examinations onboard foreign-flagged passenger vessels. Additionally, this document does not change or establish new Coast Guard authorities, but is intended to provide a framework and focus on responsibilities currently possessed. This checklist will be incorporated into a future revision of the existing Foreign Passenger Vessel Examination Book, CG-840."

Guide to Subchapter W Safety Assessments under 46 CFR 199.630 (F)
"This Circular provides guidance on the Subchapter W safety assessment alternative for survival craft as permitted by 46 CFR 199.630(f) for passenger vessels of at least 100 tons gross tonnage (Subchapter H) in Great Lakes; lakes, bays, sounds; and rivers service. The alternative safety assessment is not available to Subchapter H vessels in international, oceans, or coastwise service. In addition, this alternative is only available to those Subchapter H vessels in Great Lakes or lakes, bays, and sounds service that are ferries or have not overnight passenger accommodations. This circular describes the type of information and extent of analysis expected in the alternative safety assessment, as well as guidance on the evaluation and approval of the safety assessments."
