  The purpose of this standard is as follows: "(1) This Intelligence Community (IC) Directive (ICD) establishes overarching doctrine and policy of the Director of National Intelligence (DNI) and IC responsibilities concerning outreach to experts beyond the IC to support, improve, and enrich analysis. Analytic outreach is the open, overt, and deliberate act of an IC analyst engaging with an individual outside the IC to explore ideas and alternate perspectives, gain new insights, generate new knowledge, or obtain new information. It is conducted in accordance with fiscal, procurement, security, counterintelligence, operational and other laws, regulations, policies and procedures applicable to the IC and the analysts' individual organizations. (2) This ICD responds to recommendations in the 2005 report of the Commission on the Intelligence Capabilities of the United States (U.S.) Regarding Weapons of Mass Destruction. The report recommended that IC analysts broaden their information horizons by collaborating with individuals in academia, nongovernmental organizations, and business, and to the National Intelligence Strategy objective of drawing upon expertise wherever it resides to inform judgments. (3) This ICD directs the Deputy Director of National Intelligence for Analysis (DDNI/A), in collaboration with the Deputy Director of National Intelligence for Collection (DDNI/C) and the Heads of all elements of the IC, to ensure that this policy is implemented effectively. (4). Sound intelligence analysis requires that analysts who are dealing with issues of concern network in the U.S. and internationally to develop trusted relationships. These trusted relationships could include, as appropriate, experts in academia; think tanks; industry; nongovernmental organizations; the scientific world (e.g., U.S. government laboratories, national academies, national research councils, and Federally Funded Research and Development Centers); state, local, and tribal governments; other non-Intelligence Community U.S. government agencies; and elsewhere. These communities allow the IC to expand its knowledge base, share burdens, challenge assumptions and cultural biases, and encourage innovative thinking."

  "This letter presents the views of the Administration on an amendment to the Foreign Intelligence Surveillance Act of 1978 ('FISA') Amendments Act of 2008 (H.R. 6304) that was not covered in our letter of June 26, 2008. As we stated in that letter, we strongly support enactment of H.R. 6304, which would represent an historic modernization of FISA to reflect dramatic changes in communications technology over the last 30 years. This bill, which passed the House of Representatives by a wide margin of 293-129, is the result of a bipartisan effort that will place the Nation's foreign intelligence effort in this area on a firm, long-term foundation. The bill provides our intelligence professionals the tools they need to protect the country and protects companies whose assistance is vital to this effort from lawsuits for past and future cooperation with the Government. As we have previously noted, any FISA modernization bill must contain effective legal protections for those companies sued because they are believed to have helped the Government prevent terrorist attacks in the aftermath of September II, 2001. Liability protection is the fair and just result and is necessary to ensure the continued assistance of the private sector. H.R. 6304 contains such protection, but the amendment addressed in this letter would unnecessarily delay implementation of the protections with the purpose of deferring any decision on this issue for more than a year."

We've been on the Hill having dialogue with our committees. What I want to do is just frame the issue. I read the press reporting coming out here. So I'm almost at the point of saying are there any questions. But just let me say that what we're going to discuss is a nuclear reactor. It was constructed by the Syrians in the eastern desert of Syria along the Euphrates River on the east side. The Syrians constructed this reactor for the production of plutonium with the assistance of the North Koreans. Our evidence goes back an extended period of time. We have had insights to what was going on since very late '90s, early 2000, 2001 that something was happening. Our issue was pinning it down and being more precise. We had increasing appreciation for what was happening in the 2003, 2006 timeframe. But we still couldn't quite pin it down, as will become apparent to you when we show you more of the physical evidence that you'll see in just a moment."

  "As stated in the joint letter from the Attorney General and the Director of National Intelligence dated February 22, the Department of Justice and the Intelligence Community have been working assiduously to mitigate the effects of the uncertainty caused by the failure to enact longterm modernization of the Foreign Intelligence Surveillance Act of 1978. We learned last night after sending this letter that, as a result of these efforts, new surveillances under existing directives issued pursuant to the Protect America Act will resume, at least for now. We appreciate the willingness of our private partners to cooperate despite the uncertainty. Unfortunately, the delay resulting from this discussion impaired our ability to cover foreign intelligence targets, which resulted in missed intelligence information. In addition, although our private partners are cooperating for the time being, they have expressed understandable misgivings about doing so in light of the on-going uncertainty and have indicated that they may well discontinue cooperation if the uncertainty persists. Even with the cooperation of these private partners under existing directives, our ability to gather information concerning the intentions and planning of terrorists and other foreign intelligence targets will continue to degrade because we have lost tools provided by the Protect America Act that enable us to adjust to changing circumstances. Other intelligence tools simply cannot replace these Protect America Act authorities. The bipartisan Senate bill contains these authorities, as well as liability protection for those companies who answered their country's call in the aftermath of September 11. We hope that the House will pass this bill soon and end the continuing problems the Intelligence Community faces in carrying out its mission to protect the country."

  The purpose and applicability of this standard is as follows: "(1) This Intelligence Community Directive (ICD) establishes the Director of National Intelligence (DNI) policy and assigns responsibilities for the oversight of Intelligence Community (IC) Technical Surveillance Countermeasures (TSCM) programs, in support of the National Intelligence Strategy and the protection of national intelligence and intelligence sources and methods. This ICD rescinds Director of Central Intelligence Directive 6/2, Technical Surveillance Countermeasures, 11 March 1999 Forthcoming IC policy guidance shall provide detailed implementation guidance. (2) 'Technical Surveillance Countermeasures' represents the convergence of two distinct disciplines--counterintelligence and security countermeasures. These techniques and countermeasures are designed to detect and nullify a wide variety of technologies used to gain unauthorized access to classified national security information, restricted data, or otherwise sensitive information. This directive applies to the IC, as defined by the National Security Act of 1947, as amended; and other departments or agencies that may be designated by the President, or designated jointly by the DNI and the head of the department or agency concerned, as an element of the IC."

  "The Office of the Director of National Intelligence (ODNI) is pleased to provide to the Congress this report pursuant to Section 804 of the Implementing the Recommendations of the 9/11 Commission Act of2007, entitled The Federal Agency Data Mining Reporting Act of 2007 ('Data Mining Reporting Act'). The Data Mining Reporting Act requires 'the head of each department or agency of the Federal Government' that is engaged in activities defined as 'data mining' to report on such activities to the Congress. This report covers the data mining activities of all elements of the ODNI. Constituent elements of the Intelligence Community are reporting their data mining activities through their own departments or agencies. This report covering ODNI activities is unclassified and has been made available to the public through the ODNI's website. A classified annex has also been prepared and has been transmitted to the appropriate Congressional committees. The ODNI's Civil Liberties and Privacy Office (CLPO) has requested that civil liberties and privacy officers within the Intelligence Community disclose their data mining activities to the ODNI and provide copies of any reports submitted in response to the Data Mining Reporting Act."

  "This reporting period marked the second full year of operations for the Office of the Inspector General (OIG) for the Office of the Director of National Intelligence (ODNI). In accordance with the Intelligence Reform and Terrorism Prevention Act of 2004 (IRTPA), the Director of National Intelligence (DNI) established the ODNI OIG in July 2005. This past year, the primary impetus of the OIG's efforts was to execute on the Intelligence Community (IC) reform mission by recommending improvements in the following four general focus areas: [1] Increased information sharing in the IC, [2] Enhanced financial management in the ODNI and IC, [3] Efficient and effective management of the ODNI, and [4] Effective integration of law enforcement into the IC. The ODNI OIG completed or initiated several significant projects in 2007 to address these focus areas, including a review of domestic intelligence integration, an organizational and cultural Diagnostic if the ODNI, a follow-up review of the National Counterterrorism Center (NCTC), an inspection of Advanced Geospatial Intelligence (AGI) capabilities, and an initiative to promote auditable financial statements. Many of these projects are ongoing and will be expanded or completed in 2008. We also conducted several investigations. In addition, in cooperation with the other IC inspectors General, we have conducted an IC-wide review of the terrorist watchlist nomination process."

  "Section 102A(b) of the National Security Act of 1947, as amended, provides that '[u]less otherwise directed by the President, the Director of National Intelligence shall have access to all national intelligence and intelligence related to the national security which is collected by any Federal department, agency, or other entity, except as otherwise provided by law or, as appropriate, under guidelines agreed upon by the Attorney General and the Director of National Intelligence.' This Memorandum of Agreement (MOA) establishes such guidelines between the Attorney General and the Director of National Intelligence as called for in section 102A of the National Security Act of 1947, as amended, to govern the access, retention, use, and dissemination by [National Counterterrorism Center] of terrorism information that is contained within datasets that are identified as including non-terrorism information and information pertaining exclusively to domestic terrorism."
