  "This audit report contains the Annual Financial Statements of the United States Marshals Service (USMS) for the fiscal years (FY) ended September 30, 2012, and September 30, 2011. Under the direction of the Office of the Inspector General (OIG), Cotton & Company LLP performed the USMS's audit in accordance with auditing standards generally accepted in the United States of America. The audit resulted in an unqualified opinion on the FY 2012 financial statements. An unqualified opinion means that the financial statements present fairly, in all material respects, the financial position and the results of the entity's operations in conformity with U.S. generally accepted accounting principles. For FY 2011, the USMS also received an unqualified opinion on its financial statements (OIG Report No. 12-15)."

  "The U.S. Department of Justice Office of the Inspector General, Audit Division, has completed an audit of two cooperative agreements (2007-RG-CX-K016 and 2009-SQ-B9-K113) awarded by the Office of Justice Programs (OJP), National Institute of Justice to AKELA, Incorporated (AKELA), located in Santa Barbara, California. The purpose of both agreements was to fund development of a portable radar system, which would provide law enforcement with the capability to detect individuals, behind a wall from 30 meters away. OJP awarded AKELA a total of $1,956,985 under both agreements. As of December 2011, AKELA reported agreement-related expenditures totaling $949,990 (95 percent) of the 2009 award, and $956,995 (100 percent) of the completed 2007 award. For the 2009 agreement our audit covered expenditures totaling $219,730 for the program period beginning September 2009 through our July 19, 2010, entrance conference. For the 2007 agreement, our audit covered the $956,995 in expenditures from September 2007 through the agreement's administrative closeout completed in July 2010. The purpose of our audit was to determine whether costs claimed under cooperative agreements 2007-RG-CX-K016 and 2009-SQ-B9-K113 were allowable, reasonable, and in accordance with applicable laws, regulations, guidelines, and terms and conditions of the cooperative agreements. The objective of our audit was to review performance in the following areas: (1) internal control environment; (2) drawdowns; (3) program income; (4) expenditures including payroll, fringe benefits, indirect costs, and accountable property; (5) matching; (6) budget management; (7) monitoring of sub-recipients and contractors; (8) reporting; (9) award requirements; (10) program performance and accomplishments; and (11) post end date activity. We determined that program income, matching, and monitoring of sub-recipients were not applicable to the cooperative agreements we audited."

  "The Office of the Inspector General, Audit Division, has completed an audit of the Office of Community Oriented Policing Services (COPS) Technology Program grant number 2008-CK-WX-0200 in the amount of $1,215,890 awarded to the Columbus, Ohio, Police Department (Columbus PD). The COPS Technology Program provides direct funding for the continued development of technologies and automated systems to assist in investigating, responding to, and preventing crime. Grants are intended to enhance a variety of technical equipment and/or programs to encourage the continuation and advancement of community policing efforts within a jurisdiction. Specifically, the purpose of grant number 2008-CK-WX-0200 was to assist the Columbus PD to: (1) purchase and install a video recording system for police vehicles that wirelessly transfers video to servers at 17 W-Fi hot spots, 110 digital video cameras in marked cruisers, and support software; and to (2) provide training for officers on the system. Additionally, the Columbus PD planned for the video recordings to assist in the prosecution of criminal and traffic-related offenses. The purpose of this audit was to determine whether reimbursements claimed for costs under the grant were allowable, supported, and in accordance with applicable laws, regulations, guidelines, and terms and conditions of the grant, and to determine program performance and accomplishments. The objective of our audit was to review performance in the following areas: (1) internal control environment, (2) drawdowns, (3) grant expenditures, (4) budget management and control, (5) federal financial and progress reports, (6) grant requirements, (7) program performance, and (8) monitoring contractors. We determined that indirect costs, program income, and sub-grantees were not applicable to this grant."

• Review of the September 2005 Shooting Incident Involving the Federal Bureau of Investigation and Filiberto Ojeda Rios

  "On September 23, 2005, agents from the Federal Bureau of Investigation (FBI) attempted to arrest long-time fugitive Filiberto Ojeda Rios (Ojeda) at a residence on a rural hillside near Hormigueros, Puerto Rico. Ojeda was one of the founders and leaders of the Ejercito Popular Boricua, also known as the 'Macheteros' (Cane-Cutters), an organization that claimed credit for various violent crimes during the late 1970s and 1980s in pursuit of independence for Puerto Rico. A team of FBI agents attempted to enter the residence to arrest Ojeda at 4:28 p.m. The operation resulted in a brief but intense exchange of gunfire between Ojeda and the FBI. Three agents were shot and one was seriously wounded; Ojeda was not hit. The agents did not enter the house or complete the arrest. The gunfight was followed by a standoff during which Ojeda's wife surrendered and FBI agents engaged in a dialog with Ojeda. At 6:08 p.m., an FBI agent saw Ojeda through a window and fired three shots at him. Several agents heard Ojeda cry out and fall. The FBI did not enter the house until shortly after noon the next day, at which time the agents found Ojeda on the floor, dead from a single bullet wound that punctured his lung. On September 26, FBI Director Robert Mueller requested that the Office of the Inspector General (OIG) conduct an investigation to determine the facts and circumstances of the Ojeda shooting incident and to make recommendations regarding what actions, if any, the FBI should take in connection with it. The FBI and the United States Attorney General also received written requests from several United States Representatives and other elected officials for an independent investigation of the circumstances of Ojeda's death."

  "On February 18, 2001, Robert Philip Hanssen, a former Federal Bureau of Investigation (FBI) Supervisory Agent, was arrested and charged with committing espionage on behalf of the KGB (Komitet Gosudarstvennoy Bezopasnosti, the intelligence service of the former Soviet Union) and its successors. Hanssen was the most damaging spy in FBI history. His espionage began in November 1979 and continued until his arrest, just two months before his mandatory retirement date. Over more than 20 years, Hanssen compromised some of this nation's most important intelligence and military secrets, including the identities of dozens of human sources, at least three of whom were executed. Hanssen gave the KGB thousands of pages of highly classified documents and dozens of computer disks detailing U.S. strategies in the event of nuclear war, major developments in military weapons technologies, information on active espionage cases, and many other aspects of the U.S. Intelligence Community's Soviet counterintelligence program. On July 6, 2001, Hanssen pled guilty to espionage charges, and on May 10, 2002, he was sentenced to life imprisonment. The OIG's review examined in detail Hanssen's career at the FBI, his espionage, and the FBI's efforts to uncover the cause of the compromises of the U.S. Intelligence Community's Soviet/Russian assets detection because he was a 'master spy' who was extraordinarily clever and crafty, but because of longstanding systemic problems in the FBI's counterintelligence program and a deeply flawed internal security program."

  "The Federal Bureau of Investigation (FBI) has reported that the frequency and impact of cyber attacks on private sector and government computers increased dramatically in the last decade and are expected to continue to grow. In January 2012, former FBI Director Mueller stated during a congressional testimony that he expected the cyber threat to surpass the terrorism threat to our national security in the years to come. According to current FBI Director, James B. Comey, Jr., the FBI is prioritizing the investigation and prevention of cyber intrusions against the United States. The FBI has designated the protection of the United States against cyber-based attacks and high-technology crimes as its number three priority, behind only counterterrorism and counterintelligence. Following the Office of the Inspector General's (OIG) April 2011 report on the FBI's ability to address the national cyber intrusion threat, in October 2012 the FBI launched its Next Generation Cyber (Next Gen Cyber) Initiative to enhance its ability to address cybersecurity threats to the United States.1 In fiscal year 2014, the FBI initially budgeted $314 million for its Next Gen Cyber Initiative, including a total of 1,333 full-time positions (including 756 agents). In addition, the Department of Justice (Department) requested an $86.6 million increase in funding for fiscal year 2014 to support the Initiative. The objective of this audit was to evaluate the FBI's implementation of its Next Gen Cyber Initiative."

  Taken from the Executive Summary: "This Executive Summary provides a brief overview of the results of the Department of Justice (Department or DOJ) Office of the Inspector General's (OIG) review of the Federal Bureau of Investigation's (FBI) use of pen registers and trap and trace devices under the Foreign Intelligence Surveillance Act (FISA) during calendar years 2007 through 2009. We completed a draft of this report in February 2014. At that time, we provided the draft report to the Department, the FBI, and the Intelligence Community to conduct factual accuracy and classification reviews. In May 2014, we circulated an updated draft report that reflected minor revisions made in response to the factual accuracy comments we received. We did not receive the final results of the classification reviews until April 2015. We provided the full classified version of this report to DOJ leadership offices, the FBI, the Office of the Director of National Intelligence, and appropriately cleared members of the relevant congressional oversight and intelligence committees."

  "After allegations arose regarding the conduct of U.S. government personnel, including three Drug Enforcement Administration (DEA) agents, during the President's visit in 2012 to Cartagena, Colombia, the Department of Justice (DOJ or Department) Office of the Inspector General (OIG) received inquiries from Members of Congress regarding the training provided to DOJ personnel working outside the United States about off-duty behavior. Off-duty misconduct by DOJ employees working abroad can present unique concerns, particularly for those in law enforcement and those with security clearances. Moreover, when off-duty misconduct occurs abroad, the impact on the U.S. government's reputation and its law enforcement efforts can be especially damaging. In this review, the OIG initially sought to identify DOJ policy and training addressing off-duty conduct abroad. We found that, to the extent such policies existed, they did not specifically address off-duty conduct when outside the United States, but rather applied regardless of location."

  This is the U.S. Department of Justice Inspector General Michael E. Horowitz' testimony on, "Obstructing Oversight: Concerns from the Inspectors General" before the House Subcommittee on Oversight and Government Reform on September 10, 2014. "Access by Inspectors General to information in agency files goes to the heart of our mission to provide independent and non-partisan oversight. It is very clear to me -- just as it is to the Inspectors General community -- that the Inspector General Act of 1978 (IG Act) entitles Inspectors General to access all documents and records within the agency's possession. Each of us firmly believes that Congress meant what it said in Section 6(a) of the IG Act: that Inspectors General must be given complete, timely, and unfiltered access to agency records. However, as reflected in the recent Inspectors General letter and in my prior testimony before Congress, since 2010 and 2011, the FBI and some other Department components have not read Section 6(a) of the IG Act as giving my Office access to all records in their possession and therefore have refused our requests for various types of Department records. As a result, a number of our reviews have been significantly impeded."

  From the Executive Description: "The U.S. Department of Justice Office of the Inspector General (OIG), Audit Division, has completed a follow-up audit of the Methamphetamine Initiative Grants awarded by the Office of Community Oriented Policing Services (COPS) to the Mississippi Bureau of Narcotics (MBN). In December 2005, the OIG completed an audit of the MBN's performance under COPS' Methamphetamine Grants awarded to the MBN to assist state and local law enforcement agencies in reducing the production, distribution, and use of methamphetamine. Our 2005 audit found the MBN to be in material non-compliance with the terms and conditions of the COPS Methamphetamine Initiative grant guidelines. The MBN's grant drawdowns could not be reconciled to the financial system reports or accounting records. As a result of the non-compliance, the OIG questioned $1,968,775 in grant payments received by the MBN and recommended an additional $98,127 in funds put to better use. To evaluate the actions taken by the MBN to address the recommendations from our 2005 audit, we performed this follow-up audit on the MBN's management of the 2008 and 2009 COPS' Methamphetamine grants awarded to the MBN since our original audit. We also audited the Office of Justice Programs (OJP), Bureau of Justice Assistance American Recovery and Reinvestment Act (Recovery Act) subgrants awarded to the MBN."

  "The Department of Justice (DOJ or Department) Office of the Inspector General (OIG) is conducting an audit of the Drug Enforcement Administration's (DEA) Confidential Source Program. The OIG initiated the audit as a result of the OIG's receipt and review of numerous allegations regarding the DEA's handling and use of confidential sources. This audit report specifically focuses on our examination of the DEA's confidential source policies and their consistency with Department-level standards for law enforcement components, review of the DEA's oversight of certain high-level confidential sources and high-risk activities involving confidential sources, and evaluation of the DEA's administration of death and disability benefits to confidential sources. Our audit work thus far has been seriously delayed by numerous instances of uncooperativeness from the DEA, including attempts to prohibit the OIG's observation of confidential source file reviews and delays, for months at a time, in providing the OIG with requested confidential source information and documentation. In each instance, the matters were resolved only after the Inspector General elevated them to the DEA Administrator. As a result, over 1 year after we initiated this review, the OIG only has been able to conduct a limited review of the DEA's Confidential Source Program. Nevertheless, we have uncovered several significant issues related to the DEA's management of its Confidential Source Program that we believe require the prompt attention of DOJ and DEA leadership, as identified in this report. We will continue to audit the DEA's Confidential Source Program to more fully assess the DEA's management and oversight of its confidential sources."

• Handling of Sexual Harassment and Misconduct Allegations by the Department's Law Enforcement Components

  "The Department of Justice's (Department) law enforcement components are charged with investigating violations of federal law. Given the nature of their work, federal law enforcement employees are held to the highest standards of conduct and must be accountable for their actions both on- and off-duty. When employees of law enforcement components commit sexual misconduct or sexual harassment, or engage in criminal activity related to prostitution or the exploitation of children, it affects the component's reputation, undermines its credibility, and potentially compromises the government's efforts in prosecutions. Sexual misconduct and sexual harassment in the workplace also affect employee morale and hamper employees' ability to have and maintain effective working relationships. When sexual misconduct involves a criminal element, witness, confidential source, informant, or foreign national, it may also affect the security of the components' operations. In the past 3 years, there have been allegations of sexual misconduct involving law enforcement agents from a Department component, as well as from another federal law enforcement agency, that have received international media attention. In the wake of our review of the alleged sexual misconduct of several DEA Special Agents in Cartagena, Colombia, the Office of the Inspector General (OIG) initiated this review to assess the nature, frequency, reporting, investigation, and adjudication of allegations of sexual misconduct (including the transmission of sexually explicit texts and images) and sexual harassment in the four Department law enforcement components: the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF); the Drug Enforcement Administration (DEA); the Federal Bureau of Investigation (FBI); and the United States Marshals Service (USMS)."

This investigation was initiated under the pattern-or-practice provision of the Violent Crime Control and Law Enforcement Act of 1994, 42 U.S.C. § 14141, the Omnibus Crime Control and Safe Streets Act of 1968, 42 U.S.C. § 3789d ('Safe Streets Act'), and Title VI of the Civil Rights Act of 1964, 42 U.S.C. § 2000d ('Title VI').   From the Introduction: "Consent encounters are one of the means of interdiction used by the Drug Enforcement Administration (DEA) to carry out its mission. This report focuses on what are sometimes referred to as 'cold' consent encounters. These can occur in one of two ways: (1) when an agent approaches an individual based on no particular behavior; or (2) when an agent approaches an individual based on the officer's perception that the person is exhibiting characteristics indicative of drug trafficking without the officer having any independent predicating information. The encounter typically entails the officer asking for consent to speak with the individual and, if the agent thinks it warranted, to seek consent to search their belongings. These encounters are considered voluntary because the officer does not seek to require the person to participate in the encounter or submit to a search based on prior information about the person or their connection to drug trafficking. Within DEA operations, cold consent encounters are primarily used by DEA interdiction Task Force Groups (TFGs) that work to interdict drug trafficking at transportation facilities."

  From the Executive Summary: "In the USA PATRIOT Improvement and Reauthorization Act of 2005 (the Reauthorization Act), Congress directed the Office of the Inspector General (OIG) to conduct ' a comprehensive audit of the effectiveness and use, including improper or illegal use' of the Federal Bureau of Investigation's (FBI) use of Section 215 of the Patriot Act. See Pub. L. No. 109-177, [section]106A. Section 215 of the Patriot Act allows the FBI to seek orders from the Foreign Intelligence Surveillance Court for 'any tangible things,' including books, records, and other items from any business, organization, or entity provided the item or items are for an authorized investigation to protect against international terrorism or clandestine intelligence activities.   "The purpose of the Federal Bureau of Investigation's (FBI) Critical Incident Response Group (CIRG) is to provide expertise in a broad range of tactical and investigative techniques including crisis management, hazardous device disruption, and rapid deployment logistics. CIRG's Tactical Section units identify and test new equipment, supply FBI field offices with training and gear, standardize operational techniques, and assist other state and local law enforcement agencies in situations that require advanced capabilities. […] We found that CIRG's Tactical Section generally implemented adequate internal controls over the needs, uses, and safeguards of its procurements during fiscal years (FY) 2013 and 2014. During this time, CIRG and its Tactical Section transitioned to the Unified Financial Management System (UFMS) while new leadership enhanced oversight of procurements. These changes resulted in more robust financial control procedures and management controls such as better justifications for requested items, limits on the methods available to procure items, and improved inventory controls. Our audit did not identify instances of unjustifiable or unreasonable procurements, nor did it find evidence to substantiate specific allegations regarding improper CIRG procurements or training exercises. Rather, based on our work, it appeared that the CIRG Tactical Section used the items it procured to a reasonable extent given its mission. We also found that CIRG generally demonstrated adequate safeguards over procured items, although we did identify a few instances where Tactical Section personnel could have better documented purchase order justifications for procurements involving certain products and services or preferred vendors. We make one recommendation to the FBI to address this issue."

  "This is the second Office of the Inspector General (OIG) report on the International Prisoner Transfer Program (treaty transfer program), which Congress created to allow selected foreign national inmates in federal prisons to complete their prison terms in their home countries' prisons. The OIG's first report found that of the over 40,000 inmates from treaty transfer nations in Federal Bureau of Prisons (BOP) custody in fiscal year (FY) 2010, less than 1 percent of these inmates were ultimately transferred back to their home countries. This report finds that while some progress has been made in addressing the issues identified in our initial report in 2011 and there are some factors largely outside the control of the Department of Justice (DOJ or Department), more can be done by the Department to improve the effectiveness of the treaty transfer program. We believe that Department leadership needs to address this challenge to ensure that the Department is more fully utilizing this important program."

  "In September 2012, the Office of the Inspector General (OIG) issued a 471-page report that described the findings of our review of two Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) firearms trafficking investigations, one code named 'Operation Fast and Furious' and the other 'Operation Wide Receiver.' Our review identified serious management flaws in both investigations and we made six recommendations to address the deficiencies we found. We requested that the Department of Justice (Department or DOJ) examine ATF's law enforcement policies to ensure that they comply with the Department's guidelines and policies, and evaluate the sufficiency of ATF's case review procedures for matters that present heightened risk to the public or agents. We also believed that ATF should institute training; we requested the Department work with ATF to develop guidance on how agents should investigate gun trafficking organizations. [...] In this follow-up review we evaluated the Department's efforts to implement our recommendations. We determined that four of the six recommendations can be closed. The two remaining recommendations have been resolved, but additional work needs to be completed in order for them to be closed."

  "The Federal Bureau of Prisons (BOP) is responsible for protecting public safety by ensuring that federal offenders serve their sentences of imprisonment in facilities that are safe and appropriately secure. In support of this mission, BOP institutions maintain armories, which are secure depositories for BOP's emergency equipment. The armories contain firearms, ammunition, chemical agents, stun munitions, badges, communication equipment, detection equipment, and defensive equipment (collectively referred to here as armory munitions and equipment). Armory munitions and equipment are made available for routine assignments, as part of emergency response, and for training exercises. Each institution's Security Officer is delegated the day-to-day responsibility for controlling, maintaining, and inventorying armory munitions and equipment, using BOP's Security Officer System (S0S). As of December 2015, BOP operated 122 institutions with 120 armories. Following a BOP employee pleading guilty in December 2011 to stealing stun munitions from Federal Correctional Complex (FCC) Florence during tactical trainings, the U.S. Department of Justice Office of the Inspector General conducted this audit to assess BOP's controls over armory munitions and equipment, including the use of armory munitions and equipment for training. We also evaluated BOP institutions' compliance with policies governing armory munitions and equipment, and the accuracy of armory inventories, by conducting site-work at seven BOP institutions. The audit covers activity in BOP's armories from the start of fiscal year 2013 through December 2015."
