Federal Hate Crime Prosecutions, 2005-19

From the Document: "From October 1, 2004 to September 30, 2019, U.S. attorneys investigated a total of 1,864 suspects in matters involving violations of federal hate crime statutes. Federal prosecutors referred 17% of the suspects for prosecution. The number of hate crime matters investigated fell 8%, from 647 during 2005-09 (129 per year) to 597 during 2015-19 (119 per year). During the most recent 5-year period of 2015-19, nearly half (48%) of the 597 suspects investigated for a hate crime were referred to U.S. attorneys for Hate Crimes Prevention Act (HCPA) violations. This report uses data from the Bureau of Justice Statistics' Federal Justice Statistics Program to describe criminal prosecutions over federal hate crimes from 2005 to 2019."

This marked the first rise in federal arrests since they dropped 25% from a former high of 188,164 arrests in 2013 to 142,008 arrests in 2017. Of the 372,354 persons under federal correctional control at fiscal year-end 2018, 60% were in secure confinement and 40% were under community supervision. This was similar to fiscal year-end 2017, when 372,531 persons were under federal correctional control (59% in secure confinement and 41% supervised in the community). This report describes persons processed by the federal criminal justice system."

"The 115th Congress has continued to debate the role of the Organization of American States (OAS) in the Western Hemisphere and its utility for advancing U.S. objectives in the region. The United States helped found the OAS in 1948 to establish a multilateral forum in which the nations of the hemisphere could engage one another and address issues of mutual concern. In subsequent decades, OAS decisions often reflected U.S. policy as other member states sought to maintain close relations with the dominant economic and political power in the hemisphere. This was especially true during the early Cold War period, when the United States was able to secure OAS support for initiatives that were controversial in the region, such as a 1962 resolution to exclude Cuba from active participation as a result of its association with the communist bloc. OAS actions again aligned closely with U.S. policy in the 1990s following the end of the Cold War as a result of strong consensus among member states in support of initiatives designed to liberalize markets and strengthen democratic governance."

Under a 1994 U.S.-UAE defense cooperation agreement (DCA), about 5,000 U.S. military personnel are stationed at UAE military facilities, particularly the large Al Dhafra air base. The UAE was the first Gulf state to order the most sophisticated missile defense system sold by the United States (the THAAD), demonstrating support for U.S. efforts to assemble a coordinated regional missile defense network against Iran. The UAE has a long-standing territorial dispute with Iran and has implemented economic sanctions against it, even though doing so has adversely affected some of the UAE's large and politically influential trading community. Suggesting continued wariness of Iranian ambitions in the Gulf, the UAE has sought U.S. assurances that the United States will maintain its commitment to Gulf security. Regionally, the UAE has become increasingly assertive against extremist Islamic organizations, to the point of undertaking even some unilateral military action in post-Qadhafi Libya. "Regionally, the UAE [United Arab Emirates] has become increasingly assertive against extremist Islamic organizations, to the point of undertaking even some unilateral military action in post-Qadhafi Libya. This UAE policy has led it to join U.S.-led airstrikes against the Islamic State in Syria; to financially assist the military-led government of Egypt that ousted the elected Islamist president in 2013; to support moderate Islamist rebel groups in Syria; and to work against other Muslim Brotherhood-related organizations in the region such as Hamas. […] On domestic politics and human rights issues, the UAE's relatively open borders and economy have won praise from advocates of expanded freedoms in the Middle East. However, the social tolerance has not translated into significant political change; the country remains under the control of a small circle of leaders who allow citizen participation primarily through traditional methods of consensus-building. […] Very few policy changes are anticipated should UAE President Shaykh Khalifa bin Zayid Al Nuhayyan leave the scene unexpectedly. He suffered a stroke on January 24, 2014, leaving his younger brother Shaykh Mohammad bin Zayid, who already had substantial governing responsibilities, in charge. President Khalifa has not appeared at recent major events, such as the 2014 iteration of the annual GCC [Gulf Cooperation Council] summit (December 2014), and the extent of his current governing role is likely limited. The UAE is considered among the wealthiest countries in the world because of the ratio between its government revenues and small population requiring services. It has received no U.S. foreign aid since FY2011, and the aid that has been provided has been minimal but targeted."

From the Summary: "The number of federal arrests declined from 179,034 in 2010 to 172,248 in 2012. The decline in arrests was due to decreases across several offense types, including property (down 3,381), drug (down 2,786), and supervision violations (down 2,607). During this period, arrests for immigration offenses increased by 3,203. Illegal immigration (50%) was the most common arrest offense in 2012, followed by drug (15%) and supervision (13%) violations. From 2010 to 2012, arrests for regulatory offenses increased from 266 to 300 (average annual increase of 6%). Sex offense arrests increased at the next fastest rate (up 3% per year), followed by immigration offenses (up 2%). During this period, fraud offenses (down 10% per year) declined the most, followed by other property (down 6%) and supervision (down 5%) offenses. The five federal judicial districts along the U.S.-Mexico border (California Southern, Arizona, New Mexico, Texas Western, and Texas Southern) accounted for 60% of all federal arrests in 2012, up from 45% of all arrests in 2006 (map 1) (see Federal Justice Statistics, 2010, NCJ [National Criminal Justice] 239913, BJS [Bureau of Justice Statistics] web, December 2013). In 2012, these five districts also accounted for 53% of suspects investigated by U.S. attorneys, 54% of suspects detained prior to trial, 39% of defendants convicted, and 41% of offenders sentenced to federal prison."

"This report describes criminal case processing in the federal justice system, including arrest and booking through sentencing and corrections. These statistical tables present the number of suspects arrested and booked by the U.S. Marshals Service (USMS), suspects in matters investigated and prosecuted by U.S. attorneys, defendants adjudicated and sentenced in U.S. district court, and characteristics of federal prisoners and offenders under federal supervision. Data are from the Bureau of Justice Statistics' (BJS) Federal Justice Statistics Program (FJSP), which collects comprehensive information describing suspects and defendants processed in the federal criminal justice system and annual data on workload, activities, and outcomes associated with federal criminal cases. The data presented in these tables were collected from the U.S. Marshals Service, Drug Enforcement Administration, Executive Office for U.S. Attorneys, Administrative Office of the U.S. Courts, U.S. Sentencing Commission, and the Federal Bureau of Prisons."
