Syria's Chemical Weapons: Issues for Congress [August 7, 2013]
"The use or loss of control of chemical weapons stocks in Syria could have unpredictable consequences for the Syrian population and neighboring countries as well as U.S. allies and forces in the region. Congress may wish to assess the Administration's plans to respond to possible scenarios involving the use, change of hands, or loss of control of Syrian chemical weapons. Syria has produced, stored, and weaponized chemical weapons, but it remains dependent on foreign suppliers for chemical precursors. The regime of President Bashar al Asad reportedly has stocks of nerve (sarin, VX) and blister (mustard gas) agents, possibly weaponized into bombs, shells, and missiles, and associated production facilities. Chemical weapons and their agents can deteriorate depending on age and quality. Little is known from open sources about the current size and condition of the stockpile. Syria continues to attempt to procure new supplies of chemical weapons precursors, which are dual-use, through front companies in third countries. Most countries that have had chemical weapons arsenals in the past have destroyed these weapons under the Chemical Weapons Convention, or are in the process of destroying them. The U.S. intelligence community cites Iran, North Korea, and Syria as having active chemical weapons programs. While the United States and other governments have said they believe the Asad regime has kept its chemical weapons stocks secure, policymakers are concerned about what could happen to these weapons in the course of the civil war, such as diversion to terrorist groups or loss of control during a regime collapse."

Iran's Nuclear Program: Tehran's Compliance with International Obligations [July 31, 2013]
"In 2002, the International Atomic Energy Agency (IAEA) began investigating allegations that Iran had conducted clandestine nuclear activities. Ultimately, the agency reported that some of these activities had violated Tehran's IAEA safeguards agreement. The IAEA has not stated definitively that Iran has pursued nuclear weapons, but has also not yet been able to conclude that the country's nuclear program is exclusively for peaceful purposes. The IAEA Board of Governors referred the matter to the U.N. Security Council in February 2006. Since then, the council has adopted six resolutions, the most recent of which (Resolution 1929) was adopted in June 2010. The Security Council has required Iran to cooperate fully with the IAEA's investigation of its nuclear activities, suspend its uranium enrichment program, suspend its construction of a heavywater reactor and related projects, and ratify the Additional Protocol to its IAEA safeguards agreement. However, Tehran has continued to defy the council's demands by continuing work on its uranium enrichment program and heavy-water reactor program. Iran has signed, but not ratified, its Additional Protocol. Iran and the IAEA agreed in August 2007 on a work plan to clarify the outstanding questions regarding Tehran's nuclear program. Most of these questions have essentially been resolved, but the agency still has questions regarding 'possible military dimensions' to Iran's nuclear programme. The IAEA has reported for some time that it has not been able to make progress on these matters. This report provides a brief overview of Iran's nuclear program and describes the legal basis for the actions taken by the IAEA board and the Security Council. It will be updated as events warrant."

The Department of Defense (DOD) continues to view cluster munitions as a military necessity but has instituted a policy to reduce the failure rate of cluster munitions to 1% or less after 2018. There are two major international initiatives to address cluster munitions: the Convention on Cluster Munitions (CCM) and negotiations under the U.N. Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons (CCW). The Obama Administration has reiterated U.S. opposition to the CCM, which entered into force August 1, 2010, but participated in negotiations regarding cluster munitions under the CCW."

Arms Control and Nonproliferation: A Catalog of Treaties and Agreements [July 15, 2013]
"Arms control and nonproliferation efforts are two of the tools that have occasionally been used to implement U.S. national security strategy. Although some believe these tools do little to restrain the behavior of U.S. adversaries, while doing too much to restrain U.S. military forces and operations, many other analysts see them as an effective means to promote transparency, ease military planning, limit forces, and protect against uncertainty and surprise. Arms control and nonproliferation efforts have produced formal treaties and agreements, informal arrangements, and cooperative threat reduction and monitoring mechanisms. The pace of implementation for many of these agreements slowed during the Clinton Administration, and the Bush Administration usually preferred unilateral or ad hoc measures to formal treaties and agreements to address U.S. security concerns. But the Obama Administration resumed bilateral negotiations with Russia and pledged its support for a number of multilateral arms control and nonproliferation efforts. The United States and Soviet Union began to sign agreements limiting their strategic offensive nuclear weapons in the early 1970s. Progress in negotiating and implementing these agreements was often slow, and subject to the tenor of the broader U.S.-Soviet relationship. As the Cold War drew to a close in the late 1980s, the pace of negotiations quickened, with the two sides signing treaties limiting intermediate range and long-range weapons. But progress again slowed in the 1990s, as U.S. missile defense plans and a range of other policy conflicts intervened in the U.S.- Russian relationship. At the same time, however, the two sides began to cooperate on securing and eliminating Soviet-era nuclear, chemical, and biological weapons. Through these efforts, the United States allocates more than $1 billion each year to threat reduction programs in the former Soviet Union. However, these programs may slow or stall in the next few years."

Article III of the treaty requires non-nuclear-weapon states-parties to accept comprehensive International Atomic Energy Agency (IAEA) safeguards; Tehran concluded a comprehensive safeguards agreement with the IAEA in 1974. In 2002, the agency began investigating allegations that Iran had conducted clandestine nuclear activities; the IAEA ultimately reported that some of these activities had violated Tehran's safeguards agreement. The agency has not stated definitively that Iran has pursued nuclear weapons, but has also not yet been able to conclude that the country's nuclear program is exclusively for peaceful purposes. The IAEA continues to investigate the program. Following more than three years of investigation, the IAEA Board of Governors referred the matter to the U.N. Security Council in February 2006. U.S. Export Control System and the President's Reform Initiative [April 19, 2013]
"The 113th Congress may consider reforms of the U.S. export control system. The balance between national security and export competitiveness has made the subject of export controls controversial for decades. Through the Export Administration Act (EAA), the Arms Export Control Act (AECA), the International Emergency Economic Powers Act (IEEPA), and other authorities, the United States restricts the export of defense items or munitions; so-called 'dual-use' goods and technology--items with both civilian and military applications; certain nuclear materials and technology; and items that would assist in the proliferation of nuclear, chemical, and biological weapons or the missile technology used to deliver them. U.S. export controls are also used to restrict exports to certain countries on which the United States imposes economic sanctions. At present, the EAA has expired and dual-use controls are maintained under IEEPA authorities. […] Aspects of the U.S. export control system have long been criticized by exporters, nonproliferation advocates, and other stakeholders as being too rigorous, insufficiently rigorous, cumbersome, obsolete, inefficient, or any combination of these descriptions. In August 2009, the Obama Administration launched a comprehensive review of the U.S. export control system. In April 2010, Defense Secretary Robert M. Gates proposed an outline of a new system based on four singularities: [1] a single export control licensing agency for both dual-use and munitions exports, [2] a unified control list, [3] a single enforcement coordination agency, and [4] a single integrated information technology (IT) system."

"Pakistan's nuclear arsenal probably consists of approximately 90-110 nuclear warheads, although it could be larger. Islamabad is producing fissile material, adding to related production facilities, and deploying additional delivery vehicles. These steps could enable Pakistan to undertake both quantitative and qualitative improvements to its nuclear arsenal. Whether and to what extent Pakistan's current expansion of its nuclear weapons-related facilities is a response to the 2008 U.S.-India nuclear cooperation agreement is unclear. Islamabad does not have a public, detailed nuclear doctrine, but its 'minimum credible deterrent' is widely regarded as designed to dissuade India from taking military action against Pakistan. Pakistan has in recent years taken a number of steps to increase international confidence in the security of its nuclear arsenal. In addition to overhauling nuclear command and control structures since September 11, 2001, Islamabad has implemented new personnel security programs. Moreover, Pakistani and some U.S. officials argue that, since the 2004 revelations about a procurement network run by former Pakistani nuclear official A. Q. Khan, Islamabad has taken a number of steps to improve its nuclear security and to prevent further proliferation of nuclear-related technologies and materials. A number of important initiatives, such as strengthened export control laws, improved personnel security, and international nuclear security cooperation programs, have improved Pakistan's security situation in recent years."

Ultimately, the agency reported that some of these activities had violated Tehran's IAEA safeguards agreement. The IAEA has not stated definitively that Iran has pursued nuclear weapons, but has also not yet been able to conclude that the country's nuclear program is exclusively for peaceful purposes. Most of these questions have essentially been resolved, but the agency still has questions regarding 'possible military dimensions' to Iran's nuclear programme. The IAEA has reported for some time that it has not been able to make progress on these matters. This report provides a brief overview of Iran's nuclear program and describes the legal basis for the actions taken by the IAEA board and the Security Council. It will be updated as events warrant."

"The 113th Congress may consider reforms of the U.S. export control system. The balance between national security and export competitiveness has made the subject of export controls controversial for decades. Through the Export Administration Act (EAA), the Arms Export Control Act (AECA), the International Emergency Economic Powers Act (IEEPA), and other authorities, the United States restricts the export of defense items or munitions; so-called 'dual-use' goods and technology--items with both civilian and military applications; certain nuclear materials and technology; and items that would assist in the proliferation of nuclear, chemical, and biological weapons or the missile technology used to deliver them. U.S. export controls are also used to restrict exports to certain countries on which the United States imposes economic sanctions. At present, the EAA has expired and dual-use controls are maintained under IEEPA authorities. The U.S. export control system is diffused among several different licensing and enforcement agencies. Exports of dual-use goods and technologies are licensed by the Department of Commerce, munitions are licensed by the Department of State, and restrictions on exports based on U.S. sanctions are administered by the U.S. Treasury. Enforcement of export controls is conducted by these agencies as well as by units of the Department of Homeland Security (DHS) and the Department of Justice (DOJ)."

Syria's Chemical Weapons: Issues for Congress [December 5, 2012]
"The use or loss of control of chemical weapons stocks in Syria could have unpredictable consequences for the Syrian population and neighboring countries as well as U.S. allies and forces in the region. Congress may wish to assess the Administration's plans to respond to possible scenarios involving the use, change of hands, or loss of control of Syrian chemical weapons. Syria has produced, stored, and weaponized chemical weapons, but it remains dependent on foreign suppliers for chemical precursors. The regime of President Bashar al Asad reportedly has stocks of nerve (sarin, VX) and blister (mustard gas) agents, possibly weaponized into bombs, shells, and missiles, and associated production facilities. Chemical weapons and their agents can deteriorate depending on age and quality. Little is known from open sources about the current size and condition of the stockpile. Syria continues to attempt to procure new supplies of chemical weapons precursors, which are dual-use, through front companies in third countries. Most countries that have had chemical weapons arsenals in the past have destroyed these weapons under the Chemical Weapons Convention, or are in the process of destroying them. The U.S. intelligence community cites Iran, North Korea, and Syria as having active chemical weapons programs."

Proliferation Control Regimes: Background and Status [October 25, 2012]
"The United States has historically led the international community in establishing regimes intended to limit the spread of nuclear, chemical, and biological weapons and missiles. The regimes and their member countries use cooperative and coercive measures to achieve nonproliferation and counterproliferation objectives. Multilateral agreements and organizations are supplemented by strong bilateral cooperation among key allies, unilateral political and economic actions, and recourse to military operations should they become necessary. Congress supports the nonproliferation regimes primarily by providing statutory authority and funding for U.S. participation, establishing policy, and mandating punitive actions to help enforce the international standards set by the regimes. The term 'regime' often refers to the entire array of international agreements, multilateral organizations, national laws, regulations, and policies to prevent the spread of dangerous weapons and technologies. The nuclear nonproliferation regime is presently the most extensive, followed by those dealing with chemical and biological weapons, and then by the missile regime. The difficulty of producing nuclear weapons material (highly enriched uranium or plutonium) and the great awareness of nuclear weapons' destructiveness together have been conducive to creating a complex regime with widespread agreement on the priority of nuclear nonproliferation. Chemical weapons are easier to make and rely on readily available precursors, and they are far less destructive. Biological weapons also rely on dual-use technology, and as technology has spread, efforts to build a more extensive control regime have intensified. Finally, there is no international consensus on the danger of missile proliferation to support a nonproliferation treaty or a binding regime with enforcement mechanisms."

Iran's Nuclear Program: Status [October 17, 2012]
"Iran's nuclear program began during the 1950s. The United States has expressed concern since the mid-1970s that Tehran might develop nuclear weapons. Iran's construction of gas centrifuge-based uranium enrichment facilities is currently the main source of proliferation concern. […] Obtaining fissile material is widely regarded as the most difficult task in building nuclear weapons. As of August 2012, Iran had produced an amount of LEU (Low-Enriched Uranium) containing up to 5% uranium- 235 which, if further enriched, could theoretically produce enough HEU (Highly Enriched Uranium) for several nuclear weapons. Iran has also produced LEU containing up to 20% uranium-235, but, as of August 2012, this amount was not sufficient to yield a sufficient amount of weapons-grade HEU for a weapon. […] The International Atomic Energy Agency (IAEA) monitors Iran's nuclear facilities and has been able to verify that Tehran's declared nuclear facilities and materials have not been diverted for military purposes. Conventional Arms Transfers to Developing Nations, 2004-2011 [August 24, 2012]
"This report is prepared annually to provide Congress with official, unclassified, quantitative data on conventional arms transfers to developing nations by the United States and foreign countries for the preceding eight calendar years for use in its policy oversight functions. All agreement and delivery data in this report for the United States are government-to-government Foreign Military Sales (FMS) transactions. Similar data are provided on worldwide conventional arms transfers by all suppliers, but the principal focus is the level of arms transfers by major weapons suppliers to nations in the developing world. Developing nations continue to be the primary focus of foreign arms sales activity by weapons suppliers. During the years 2004-2011, the value of arms transfer agreements with developing nations comprised 68.6% of all such agreements worldwide. More recently, arms transfer agreements with developing nations constituted 79.2% of all such agreements globally from 2008 to 2011, and 83.9% of these agreements in 2011. The value of all arms transfer agreements with developing nations in 2011 was over $71.5 billion. This was a substantial increase from $32.7 billion in 2010. In 2011, the value of all arms deliveries to developing nations was $28 billion, the highest total in these deliveries values since 2004."

Pakistan's Nuclear Weapons: Proliferation and Security Issues [July 23, 2012]
"Pakistan's nuclear arsenal probably consists of approximately 90-110 nuclear warheads, although it could be larger. Islamabad is producing fissile material, adding to related production facilities, and deploying additional delivery vehicles. These steps could enable Pakistan to undertake both quantitative and qualitative improvements to its nuclear arsenal. Whether and to what extent Pakistan's current expansion of its nuclear weapons-related facilities is a response to the 2008 U.S.-India nuclear cooperation agreement is unclear. Islamabad does not have a public, detailed nuclear doctrine, but its 'minimum credible deterrent' is widely regarded as designed to dissuade India from taking military action against Pakistan. […] Moreover, Pakistani and some U.S. officials argue that, since the 2004 revelations about a procurement network run by former Pakistani nuclear official A. Q. Khan, Islamabad has taken a number of steps to improve its nuclear security and to prevent further proliferation of nuclear-related technologies and materials. A number of important initiatives, such as strengthened export control laws, improved personnel security, and international nuclear security cooperation programs have improved Pakistan's security situation in recent years. However, instability in Pakistan has called the extent and durability of these reforms into question. Some observers fear radical takeover of a government that possesses a nuclear bomb, or proliferation by radical sympathizers within Pakistan's nuclear complex in case of a breakdown of controls. While U.S. and Pakistani officials continue to express confidence in controls over Pakistan's nuclear weapons, continued instability in the country could impact these safeguards.
