  "The President's National Energy Plan combines proposed legislative, administrative, and budgetary actions aimed at solving the Nation's energy problems. The Plan is an important first step toward developing a national energy policy. GAO [General Accounting Office] believes it is a good start. GAO agrees with many of the Plan's specific initiatives and offers recommendations to improve others. GAO believes that the Plan, even if approved in its entirety by the Congress, will, in some cases, fall short of its established goals. GAO calls for the Congress to adopt a set of National Energy Goals and design a program that meets these goals, establish a set of milestones to judge progress in meeting these goals, and establish a set of standby initiatives if satisfactory progress is not being made."

  This report was conducted by the Privacy Protection Study Commission, July 1977 pursuant to the Privacy Act of 1974. This report was transmitted to President Jimmy Carter on July 12, 1977. From the preface: "Issues of public policy rarely, if ever, emerge on the political scene fully developed and fully articulated. Rather, they result from gradual changes in the social and economic environment, which are then identified and intensively debated. This has been the pattern with the subject of this report. The relationships between individuals and various record-keeping organizations have been developing over a long period of time. An analysis of these relationships and their consequences for personal privacy lie at the heart of the findings and recommendations in this report."   "The Export Administration Review Board, hereinafter referred to as the Board, which was established by Executive Order No. 11533 of June 4, 1970, as amended, is hereby continued. The Board shall continue to have as members the Secretary of Commerce, who shall be Chairman of the Board, the Secretary of State, the Secretary of Defense, and the Chairman of the East-West Foreign Trade Board (Section 7 of Executive Order No. 11846, as amended). No alternate Board members shall be designated, but the acting head of any department may serve in lieu of the head of the concerned department. In the case of the East-West Foreign Trade Board, the Deputy Chairman or the Executive Secretary may serve in lieu of the Chairman. The Board may invite the heads of other United States Government departments or agencies, other than the agencies represented by Board members, to participate in the activities of the Board when matters of interest to such departments or agencies are under consideration."

  "A NOAA [National Oceanic and Atmospheric Administration] survey team traveled to Massachusetts February 7-9, 1977, to interview NOAA personnel. other Federal and state officials, and scientists from local institutions associated with the NOAA participation in the ARGO MERCHANT incident…The survey was limited to the period extending from December 15, 1976, when the ARGO MERCHANT was grounded, to February 11, 1977, when the Coast Guard determined that the wreckage contained no oil and that cleanup and containment activities were no longer necessary. This survey constitutes the first evaluation of a NOAA response to a major oil spill. The spill did not occur within territorial seas, where the States have primary responsibility for assessing damage to the marine environment and fishery resources, nor did the oil go ashore during the period covered by the survey. Consequently, the assessment of environmental and resource damage was predominantly a Federal action, in which NOAA played the principal role. The survey provided an opportunity to determine the extent of interaction not only among the many NOAA elements involved, but also the extent of their interaction with Federal, state, local, and private organizations and individuals."

Reflect revisions to the National Oil and Hazardous Substances Pollution Contingency Plan, Title 40, Code of Federal Regulations, Section 1510 (hereinafter referred to as the "National Contingency Plan"), such as (1) more precise information on substances to remove discharges, (2) revised criteria to determine size of discharges, (3) an updated definition of discharge and its relationship to public health and welfare, and (4) a broad definition of the geographic area covered. b. Implement the Environmental Protection Agency (EPA) Regulations on Oil Pollution Prevention (reference (Title 40. Code of Federal Regulations, Section 112, )). c. Establish a Department of Defense Oil and Hazardous Substances Pollution Prevention and contingency Program (hereinafter referred to as the "DoD Program"), to: (1) Reduce the likelihood of oil discharges from non-transportation related onshore and offshore facilities into or upon the waters of the United States or adjoining shorelines (2) Respond rapidly to control and minimize the damage caused by discharges of oil or hazardous substances for DoD facilities. (3) Provide, in a manner consistent with DoD operational requirements, resources and other assistance necessary to support Federal pollution response operations conducted in accordance with the National Contingency Plan. 2. DoD Directive 5030.41, October 3, 1972 is hereby superseded and canceled.

• Coastal Flood Hazards and the National Flood Insurance Program

  "From New Hampshire to Florida, and virtually the entire coast of the Gulf of Mexico, our shoreline is a succession of low-lying barrier islands, beaches, sand dunes, bluffs, and unconsolidated landforms. They are the front line of storm defense for a thousand miles of United States Atlantic and Gulf of Mexico coastline. The low-lying lands immediately adjacent to the open oceans are hostile environments for man to build in. The combination of coastal storm surges, wave action, battering by debris, scouring, and high winds makes development highly hazardous in such coastal areas...Operation of the National Flood Insurance Program in three Rhode Island coastal communities studied by the author in 1975 indicated a number of counterproductive forces to the goals of the Program. In response, the Federal Insurance Administration questioned extrapolation of the Rhode Island experience to all of the nation's coasts, but expressed concern that phenomena found there might be more widespread. It proposed to investigate the effects of flood insurance availability at several points along the U.S. coast , and to perform a random investigation of coastal development to determine the impact of flood insurance on the acquisition or construction of coastal properties. The author's ensuing study, reported here, has combined field investigations of fifteen coastal communities with survey data obtained by the Wharton School of Finance of the University of Pennsylvania."

  From the Abstract: "The magnitude and frequency of floods from gaged and ungaged drainage areas in California, for any recurrence interval from 2 to 100 years, can be estimated by use of the method presented. Equations relating flood magnitudes of selected frequency to basin characteristics such as drainage area, precipitation, and altitude were developed for six regions in the State. Nomographs are included for solution of the equations. The regression equations were developed for streams that have natural flow or flows not substantially affected by storage."

  "Preventing the spread of nuclear weapons to other nations has been a major policy objective of the United States Government since the end of World War II. This objective has found expression in domestic legislation restricting the export of nuclear technology and materials, and, on the international front, in the establishment of the International Atomic Energy Agency (IAEA) and in the negotiation of the Treaty on Nonproliferation of Nuclear Weapons (NPT). With the increasing pace in the construction of nuclear power plants abroad, considerable attention has been given to the problem of assuring that none of the plutonium produced in these plants is diverted for use in weapons. Indeed, the NPT requires continuing IAEA inspection of nuclear power plants in signatory nations that currently do not have nuclear weapons. However, the NPT alone cannot prevent the proliferation of nuclear weapons if these weapons can be produced outside the mainstream of the nuclear industry in facilities specifically dedicated to their manufacture. It appears that this, in fact, is the case. As shown in this report, many nations in the world today, in particular, many small and/or developing nations, are capable of undertaking nuclear weapons programs that can provide them with a small number of weapons in a period of five to ten years. It is reasonable to assume that any nation which embarked on a program to procure nuclear weapons would attempt to keep this fact a secret as long as possible."

  This assessment, prepared under the direction of the OTA Energy Program, was requested by Senators Abraham Ribicoff, John Glenn, and Charles Percy of the Senate Committee on Government Operations. The purpose was to provide a comprehensive analysis of technological factors and potential options to assist Congress in evaluating national and foreign policy relevent to nuclear proliferation. The study concludes that the complex and difficult problem of proliferation is controllable only by hard and controversial choices by many nations over which the U.S. has only limited influence. Within these limits, however, there are many options for reducing the probability of proliferation. The desirability of these options depends not only on their effectiveness and feasibility, but also on perceptions of the importance of non-proliferation relative to other national choices.

• ARGO Merchant Oil Spill: A Preliminary Scientific Report

  "The tanker 'Argo Merchant' carrying 7,700,000 gallons of No. 6 fuel oil went aground on Fishing Rip, 29 nautical miles southeast of Nantucket Island, Massachusetts, at 0600 EST [Eastern Standard Time] on December 15, 1976. Despite attempts to refloat the tanker, it began to leak oil and, at 0835 on December 21, broke in half after a battering by gale force winds. By the next day, after the ship had broken again, most of the oil it carried was drifting at the mercy of winds and currents. The bow section, which still had some buoyancy and was thought to contain some remaining cargo, started drifting away from the other two pieces of wreckage. Despite attempts by the U.S. Coast Guard to remove the buoyancy by holing the floatation compartments on December 31, the bow section drifted southeast into deeper water under the influence of the severe currents in the area. On February 8, 1977, the bow section was relocated 1 mile to the southeast and was found to be empty of oil. What started as another tanker going aground ended up as one of the largest oil spills in U.S. history."

The directive also establishes a joint NSC/Domestic Council Committee on the security of US Telecommunications.

  "Since the last version of 'The Effects of Nuclear Weapons' was prepared, much new information has become available concerning nuclear weapons effects. This has come in part from the series of atmospheric tests, including several at very high altitudes, conducted in the Pacific Ocean area in 1962. In addition, laboratory studies, theoretical calculations, and computer simulations have provided a better understanding of the various effects. Within the limits imposed by security requirements, the new information has been incorporated in the present edition. In particular, attention may be called to a new chapter on the electromagnetic pulse. [...] It is because of these fundamental differences between a nuclear and a conventional explosion, including the tremendously greater power of the former, that the effects of nuclear weapons require special consideration. In this connection, a knowledge and understanding of the mechanical and the various radiation phenomena associated with a nuclear explosion are of vital importance. The purpose of this book is to describe the different forms in which the energy of a nuclear explosion are released, to explain how they are propagated, and to show how they may affect people (and other living organisms) and materials."

  "The first duty assigned by the Senate to the Senate Select Committee on Intelligence, when it was created on May 19, 1976, was to develop effective processes of oversight and accountability for the intelligence activities of the United States. The most difficult task facing the committee was to balance the right of the public and the Senate to be informed of the government's activities with the countervailing necessity to protect valid national secrets. The Constitution's design of interaction among the three separate branches of government is based on the conviction that the responsibilities for all that government does, even secret activities, must be shared by the three branches of government in their appropriate ways. This is the best protection that the public has that secret activities will not erode our freedoms. [...] This first annual report by the committee is an accounting to the Senate and public of the performance to date of legislative oversight. We have tried in this report to describe fully the processes developed for effective oversight and accountability. The details of much that the committee has been involved in remains classified. While valid national security concerns prevent the committee from placing these details in the public record, the full record is available to the Senate in accordance with the provisions of S. Res. 400."
