  "The U.S. Department of Homeland Security (DHS) Fleet AFV Program Report for Fiscal Year 2004 presents the Department's data on the number of alternative fuel vehicles (AFVs) acquired in fiscal year (FY) 2004, and its planned acquisitions and projections for FY 2005 and FY 2006. The report has been developed in accordance with the Energy Policy Act of 1992 (EPAct) (42 U.S.C. 13201-13556) as amended by the Energy Conservation Reauthorization Act of 1998 (Public Law 105-388) (ECRA), and Executive Order (EO) 13149 (signed by the President in April 2000). Of the 704 covered vehicles DHS acquired in FY 2004, 528 were required to be AFV's in order to comply with the 75 percent acquisition requirement mandated by EPAct. Of the 704, 683 or 97 percent were AFV's. Our plans indicate an improved level of compliance FY 2005 and FY 2006 with projected acquisitions of 900 and 950 AFV's respectively."

DHS has expressed a desire to use personally identifiable information from commercial databases to reduce the number of false positive identifications in screening programs as one justification for the potential use of commercial data. The commercial data could potentially come from large data aggregators or from smaller data sets. The DHS Data Sharing and Usage Subcommittee of the DHS Data Privacy and Integrity Advisory Committee has reviewed the risks created by DHS assess to commercial data. In this report, the Subcommittee addresses certain issues it believes must be satisfactorily addressed prior to DHS use of commercial data in terrorist screening programs."

• Protecting the Pandemic Essential Worker

  From the Introduction: "In March 2020, states and cities tried to slow the spread of the Coronavirus (COVID-19) by issuing shelter-in-place or stay-at-home orders. Once the economic consequences of a total shutdown of the economy became clear, however, the federal government and states declared that certain business sectors or industries were critical. These critical businesses and industries were required (or at least allowed) to remain open. Unfortunately, when businesses told the people we now call 'essential workers' to keep working, no one told businesses what they needed to do to protect those workers. Things initially looked promising for essential workers--at least for some of them. People stood on balconies and lined streets during 'clappy hours' to herald and valorize higher income doctors and nurses as they went to and from work. For a brief period, it even seemed that the lower wage employees who scrubbed hospital floors, drove patients to or admitted them to hospitals, stocked shelves in Amazon warehouses, processed meat in factories, picked vegetables on farms, and drove city buses might also be valorized. Essential workers were called heroes and some retail workers even received tips from grateful customers during the early weeks of the pandemic. Later on, many of these low wage, face-to-face (F2F) workers were harassed, assaulted, and even murdered by customers who became enraged when they tried to enforce mask or social distancing requirements put in place to keep customers and workers safe."

As part of the adjudication process, USCIS conducts three different background checks on applicants/petitioners applying for USCIS benefits. These include (1) a Federal Bureau of Investigation (FBI) Fingerprint Check, (2) a FBI Name Check and (3) a Customs and Border Protection (CBP) Treasury Enforcement Communication System/Interagency Border Inspection System (TECS/IBIS) Name Check. Prior to BCS, information relating to the FBI Fingerprint Checks and the FBI Name Checks was stored in two different systems. Information relating to the TECS/IBIS Name Checks was not stored in any system. BCS will be the central repository for all activity related to these background checks."

  "The purposes of this paper are to: (1) offer an analytical framework for use by the Department of Homeland Security ('DHS' or 'the Department') in determining whether to deploy a Radio Frequency Identification (RFID) enabled system to identify and/or record the presence of individuals; and (2) offer a set of best practices to consider when DHS chooses to use an RFID enabled system. The focus of this paper is on such systems in border crossing contexts. We believe that the issues raised in this paper are relevant to other credential or human identification related applications, and that the best practices we recommend are also applicable in those contexts. [...] With specific reference to RFID deployments, we recommend that if the Department, after careful consideration of all technologies and analysis of the least intrusive means to achieve department objectives, determines to deploy an RFID‐enabled system to identify individuals, that it build in, from the design stage, sufficient privacy and security safeguards to ensure that the use of RFID‐enabled systems meets the Department's objectives while respecting and protecting the privacy and security of information collected about individuals throughout the lifetime of the system and, in the case of the information, beyond."

  This presentation by Dr. Maureen McCarthy outlines what makes Homeland Security intelligence challenging: "Everything must be tailored, timely and actionable; collection ('harvesting') from all-sources; analysis is unique, complex and daunting; dissemination is to everyone who cares; and the tradecraft is new: experts are few." She includes several slides on creating a shield of protection from WMD attacks, and the unique challenges posted to the Intelligence Community. Some of these challenges: "The majority of information available is from non-traditional sources and must be distinguished from benign reporting; sorting the technically feasible from the likely to occur is very difficult; and reporting on transfer of knowledge, materials, and people from state actors to terrorist groups is very limited." She concludes by explaining actionable intelligence and its key components, and how Measurements and Signatures Intelligence can make HS WMD intelligence more effective.

• Tactical Interoperable Communications Scorecards: Summary Report and Findings, January 2007

  The tactical interoperable communications scorecard assesses the maturity of tactical interoperable communications capabilities in 75 urban/metropolitan areas. These scorecards were developed by subject matter expert panels that reviewed documentation on current communications plans, exercises, and a self-assessment to arrive at consensus findings and recommendations for each region on how to best improve that region's communications capabilities. These scorecards and the recommendations included are being distributed directly to each of the urban/metropolitan areas to focus their regional efforts to improve tactical interoperable communications. The Department of Homeland Security (DHS) is using these scorecards to focus technical assistance programs and target specific areas of improvement in communications interoperability.

First, our goals optimize our security, but not security at any price. Our security strategy promotes Americans' freedom, privacy, prosperity, and mobility. Second, our goals drive continuous improvement as terrorists will not relent, and natural disasters are inevitable. Third, we must be an effective steward of public resources - setting and meeting priorities, sound financial management, a commitment to measure and report performance, and fostering innovation. Finally, our work must be guided by the understanding that effective security is built upon a network of systems that spans all levels of government and the private sector. DHS does not, and should not, own or control all of these systems. We set a clear national strategy and design an architecture in which separate roles and responsibilities for security are fully integrated among public and private stakeholders.   From the Introduction: "The COVID-19 [coronavirus disease 2019] ('COVID') pandemic disrupted most social and legal institutions, and contract was no exception. Sometimes, the disruptions were localized and personal: venue-rental contracts were not honored because weddings or birthday parties were cancelled or delayed. Other times, the disruptions were national or international in scope: mergers and acquisitions were deferred or abandoned; the orders that feed global supply chains for clothing and other consumer goods became unpredictable. These disruptions were an occasion to consider foundational questions about contract law and what, concretely, should the legal system do in a world where 'COVID rendered many contracts in or near breach,' as one of us recently observed. The COVID pandemic meant, among other things, that parties would need to make the choice whether to renegotiate or litigate their contracts. Any choice would be made especially difficult given the uncertain trajectory of the pandemic: while we might not come 'roaring back,' the economy could certainly rebound, as it did after the pandemic of 1918-19. To litigate or to go into bankruptcy would be to terminate or impair relationships, which may be problematic during and after the pandemic. But reconfiguring contractual arrangements (or simply doing nothing) was also a fraught choice, especially in an environment where governments' responses to both the public-health and economic challenges of COVID became heavily politicized. Contract parties could neither ignore their agreements nor expect that ordinary public responses--whether through judicial intercession or fiscal largesse--were likely to be reliable or effective."

  "This guide is intended for emergency response officials responsible for designing and executing interoperable communications plans for planned events (e.g., festivals, concerts, and sporting events) in their community. Interoperable communications plans include not only voice but also data considerations. The content presented in this guide is based on input from emergency responders, including lessons learned and best practices. To use communications equipment and systems effectively in all types of emergencies, emergency response personnel must have multi-disciplinary and multi-jurisdictional opportunities to become familiar with the equipment, practice Standard Operating Procedures (SOPs), and enhance their preparedness. Too often, communities procure communications equipment for interoperability with the intent of using it only when disaster strikes or the need arises. Technology alone, no matter how expansive or advanced, is limited in its effectiveness unless it is used regularly in day-to-day operations. A planned event is a way for personnel to test equipment in real-life situations. It also provides an opportunity to learn, practice, and implement interoperability solutions and to better prepare for unplanned future events. Communities can modify the methodology presented in this guide to meet the specific needs, realities, and cultures of their areas."

  "This document is a new System of Records Notice (SORN) for the Automated Targeting System (ATS) and is subject to the Privacy Act of 1974, as amended. ATS is an enforcement screening tool consisting of six separate components, all of which rely substantially on information in the Treasury Enforcement Communications System (TECS). ATS historically was covered by the SORN for TECS. The Department of Homeland Security, U.S. Customs and Border Protection (CBP) published a separate SORN for ATS in the Federal Register on November 2, 2006. This SORN did not describe any new collection of information and was intended solely to provide increased notice and transparency to the public about ATS. Based on comments received in response to the November 2, 2006 notice, CBP issues this revised SORN, which responds to those comments, makes certain amendments with regard to the retention period and access provisions of the prior notice, and provides further notice and transparency to the public about the functionality of ATS."

ATS performs screening of both inbound and outbound cargo, travelers, and conveyances.   From the Introduction: "The F-35 Joint Strike Fighter (JSF), also called the Lightning II, is a strike fighter airplane being procured in different versions for the Air Force, Marine Corps, and Navy. The F-35 program is DOD's largest weapon procurement program in terms of total estimated acquisition cost. Current Department of Defense (DOD) plans call for acquiring a total of 2,456 F-35s for the Air Force, Marine Corps, and Navy at an estimated total acquisition cost, as of December, 2019, of about $397.8 billion in constant (i.e., inflation-adjusted) FY2012 dollars. U.S. allies are expected to purchase hundreds of additional F-35s, and eight foreign nations are cost-sharing partners in the program. The Administration's proposed FY2022 defense budget requested about $12.0 billion in procurement funding for the F-35 program. This would fund the procurement of 48 F-35As for the Air Force, 17 F-35Bs for the Marine Corps, 20 F-35Cs for the Navy and Marines, advance procurement for future aircraft, and continuing modifications. The proposed budget also requested about $2.1 billion for F-35 research and development."

Many experts trace the current dynamism of the relationship to 2014, when the reaction of some countries to Russia's first invasion of Ukraine, including sanctions, led Moscow to seek to strengthen its ties to China and other countries. The two countries' apparent mutual affinity has led some U.S. policymakers and Members of Congress to express concern that Beijing and Moscow constitute a de facto alliance, and to seek ways to counter their global influence. The PRC and Russia's bilateral relationship falls short of a mutual defense pact, more closely resembling a nonbinding alignment based on shared opposition to what they describe as the U.S.-led international order. This common opposition has spurred cooperation between the two countries, but has not fully overcome their historical strategic mistrust."
