Declining Reliability of the U.S. Inland Waterway System
"The roughly 12,000-mile U.S. inland and intracoastal waterway system is an integral, albeit largely unnoticed, part of our nation's freight transportation system (see Figure 1). This network handles about 600 million tons, and 300 billion ton-miles, of domestic cargo movements annually -- principally raw materials and liquid and bulk primary products, like coal, petroleum, chemicals, grain, processed metals, cement, sand and gravel.1 It is the primary artery for more than half of the nation's grain and oilseed exports, for about 20 percent of the coal for utility plants, and for about 22 percent of domestic petroleum movements. From a national transportation perspective it is a 'quiet' mode, largely unnoticed by a general public used to dodging trucks on the highways or stopping for freight trains at suburban crossings. However, the infrastructure that supports this quiet mode is starting to show its age, and a major failure at one of its component locks and dams could have serious economic consequences that would give the quiet mode some very loud public attention."

Preventing and Detecting Bid Rigging, Price Fixing, and Market Allocation in Post-Disaster Rebuilding Projects: An Antitrust Primer for Agents and Procurement Officials
"American consumers have the right to expect the benefits of free and open competition -- the best goods and services at the lowest prices. Public and private organizations often rely on a competitive bidding process to achieve that end. The competitive process only works, however, when competitors set prices honestly and independently. When competitors collude, prices are inflated and the customer is cheated. Price fixing, bid rigging, and other forms of collusion are illegal and are subject to criminal prosecution by the Antitrust Division of the United States Department of Justice. As a member of the Department of Justice Hurricane Katrina Fraud Task Force, the Antitrust Division is committed to offering our expertise and assistance in the wake of the devastation caused by Hurricane Katrina. As FEMA and state and local government agencies with whom FEMA is coordinating begin to solicit competitive bids for rebuilding contracts, the Antitrust Division is prepared to provide assistance to these agencies to protect against bid rigging, price fixing and other collusive conduct among companies competing for rebuilding contracts. Experienced Antitrust Division attorneys are available to provide training to law enforcement agents, auditors, and procurement personnel in the affected areas to assist them in identifying and preventing potential bid rigging and collusion in the competitive bidding process. If collusive conduct is discovered, the Antitrust Division stands ready to criminally prosecute the individuals and corporations seeking to unjustly profit from this tragedy."

Global Climate Change: National Security Implications
"On March 29-31, 2007, the Strategic Studies Institute and the Triangle Institute for Security Studies conducted a colloquium on 'Global Climate Change: National Security Implications' held in Chapel Hill, North Carolina. This volume is based on the proceedings of this conference. Chapter 1 addresses the growing historical awareness of the threat and outlines the science of climate-change. Chapters 2 and 3 focus on how climate change might affect human societies and the degree to which it might cause or exacerbate violence and conflict. Particular attention is paid to the implications for the security of the United States. Chapters 4 and 5 consider a variety of potential solutions, ranging from international diplomacy to the development of efficient technologies. Chapters 6 and 7 focus on the role of the U.S. Armed Forces. What can they do and what should they do to mitigate climate change or prepare to meet the threat? Chapter 8 summarizes and concludes. Contributors to this volume agree that climate change is a threat deserving of serious attention. They stress the need for greater planning and coordination and for further research as well as the utility of engagement-military to military and state to state-on environmental issues. They differ as to whether the Armed Forces should play a leading or supporting role, but agree that they can-and already do-make a valuable contribution."

"In 2007, the U.S. Department of Homeland Security, Immigration and Customs Enforcement (ICE) enacted a multi-year strategy of improving immigration enforcement. This strategy targets criminal aliens, fugitive aliens, and the criminal infrastructure that supports illegal immigration, and has an enhanced focus on worksite enforcement and elimination of the jobs magnet that draw illegal workers to the United States. A key component in executing this strategy is providing safe, secure and compliant detention facilities for all ICE detainees, once a determination has been made to assume custody. Essential to ensuring that these facilities provide appropriate conditions of confinement is the ICE Detention Facility Inspection Program. In order to facilitate transparency of the ICE Detention Facility Inspection Program, the Assistant Secretary of ICE directed that the Office of Detention and Removal Operations (DRO) report semi-annually on agency-wide adherence with the ICE National Detention Standards (NDS). ICE, with the assistance of law enforcement professionals and non-governmental organizations (NGOs), has carefully crafted 38 National Detention Standards, which are explained in detail in Appendix A. This is the first such report issued under this directive and covers the period of January through June 2007. It explains the standards that ICE uses to rate the performance of detention facilities, and shows results for the six months covered by this report."

Counterinsurgency in the 21st Century: Creating a National Framework
"Our national security system is principally designed to deter and defeat state-based threats, which it does with great success. But it is precisely because of our overwhelming capability to overcome conventional threats that our enemies will attempt to defeat us through other means. That fact, along with the increasing danger of transnational, regional, and substate threats has made it clear that the most dangerous threats the United States will face in the 21st century are as likely to come not from other states but from within states, and principally from within weak or poorly-governed states. The Westphalian world order is being challenged by a new form of insurgency -- transnational, distributed, networked, and ideologically driven -- that is most graphically represented by al-Qaeda, a global Islamist movement that seeks to replace secular governments with theocratic Islamic regimes hostile to liberal values and secular democracy. The War on Terrorism is a national response to high-profile violence conducted by small but potent movements of violent extremists seeking to destabilize and disempower national governments. Their targets are nations whose policies and presence in Islamic countries prevents the realization of their vision of a global 'virtual Caliphate' of Islamic governments in predominantly Muslim countries around the world. Other non-state organizations using terrorism or organized political violence for local or global ends that are inimical to US national interests adds to the challenge."

Domestic Shipping: Vital to the Nation's Economy, Security and Transportation
"Domestic waterborne shipping in the United States moves 14% of the national cargo tonnage for less than 2% of the freight bill, provides an estimated 124,000 direct jobs, generates $10 billion in annual freight revenue, and provides $300 million and $55 million in federal and state tax revenue respectively. Domestic waterborne transportation is safe, reliable, efficient and an established mainstay of America's national transport system. (1) The total volume of domestic water trade is immense. In 1996, the volume of cargo moved between U.S. Ports by the domestic fleet exceeded one billion tons. (2) The total direct economic activity associated with the domestic trade is approximately $10 billion per year, which includes more than $4 billion in direct wages paid to vessel crews and shore side managers. To encourage a strong U.S. merchant marine for both national defense and economic security, the nation's domestic waterborne commerce is reserved for vessels built in the United States, owned and crewed by American citizens, and registered under the American flag. U.S. laws governing the domestic transportation of passengers and cargo by water are generally known as the Jones Act, named after Senator Wesley Jones (R-WA) the sponsor of the Merchant Marine Act of 1920. The Jones Act continues to be the foundation for America's domestic shipping policy. This pamphlet describes America's domestic shipping trades and the essential services they provide for a healthy, growing economy."

Maintenance, Rehabilitation, and Upgrading of Shore Facilities in Support of United States Coast Guard Missions
"This report presents the results of our audit of shore facilities that support the missions of the United States Coast Guard. Our objective was to determine the extent to which the United States Coast Guard is properly maintaining, rehabilitating, and upgrading its shore facilities. The United States Coast Guard has been working diligently to maintain its more than 22,000 shore facilities. However, as each year passes, this task is becoming increasingly challenging. More than 80% of its current acquisition, construction, and improvements funding is directed to the Integrated Deepwater System Program, leaving funding available for shore facilities well below the industry and United States Coast Guard accepted standard of 2% of plant replacement value. For fiscal years 2003 through 2006, the United States Coast Guard funded shore acquisition, construction, and improvements at approximately 0.3% of plant replacement value, resulting in a funding gap of about $511 million. To compensate for the gap, the United States Coast Guard improperly used maintenance funds to upgrade or expand its shore facilities."

Tobacco and Terror: How Cigarette Smuggling is Funding our Enemies Abroad
"It has been well --reported that terrorist and criminal organizations are conducting illicit business operations within the United States, sending the profits overseas to finance domestic and international terrorist and criminal organizations. Recent law enforcement investigations have revealed that these profits, estimated to bin the millions of dollars annually in the United States alone, are generated in part by illicit cigarette trafficking. Historically, the low-risk, high profitability of the illicit cigarette trade served as a gateway for traditional criminal traffickers to move into lucrative and dangerous criminal enterprises such as money laundering, arms dealing, and drug trafficking. Recent law enforcement investigations, however, have directly linked those involved in illicit tobacco trade to infamous terrorist organizations such as Hezbollah, Hamas, and al Qaeda. These startling discoveries led U.S. House Committee on Homeland Security Ranking Member Peter T. King (R-NY) to launch an investigation of the issue. The following staff report-which will focus on the estimated millions of dollars in illicit tobacco profits being funneled to terrorist groups overseas as well as New York State's refusal to enforce tobacco laws-is the result of numerous interviews with law enforcement officials at the local, state and Federal level, as well as open-source research."
