The intelligence community estimates that since January 2012, over 16,000 Foreign Fighters have travelled to Syria from more than ninety countries, including the United States. These fighters, many of whom have joined ISIL, al-Nusrah Front and other terrorist organizations, are a threat to people across Syria and Iraq and endanger the stability of the entire region. Economic sanctions have long been a key diplomatic tool. Athens imposed a trade boycott on Sparta's ally Megara. And, of course, it is a long history, but in recent years the United States has increasingly relied upon reputational financial sanctions, particularly against North Korea and Iran. These sanctions target financial institutions employed by rogue states for illicit transactions. To preserve their reputation and protect their businesses, other banks shun the targeted institution, restricting the rogue's ability to finance proliferation or terrorist activities. This model was effectively used in 2005 with Banco Delta Asia [BDA] hitting North Korea. Once BDA was identified as complicit in North Korea's money laundering and WMD [Weapons of Mass Destruction] activities, banks throughout the region shunned Banco Delta Asia and other North Korean transactions, effectively shutting the regime out of the international system. As Dr. David Asher, a key architect of this policy, will testify, this was a 'financial shot heard around the world.' The key to this action was Section 311 of the PATRIOT Act, which allows the Treasury Department to designate a particular financial entity as a 'primary money laundering concern,' barring it from the U.S. financial system. One witness, Juan Zarate, pioneered the use of this sanction against 'bad banks' during his tenure at Treasury." From the opening statement of Ileana Ros-Lehtinen, "Unfortunately, we have seen in many of our other hearings this year, al-Qaeda is resurgent throughout the Middle East and North Africa, not just in Iraq. The grim reality is that al-Qaeda is on the rise and continues to be a grave threat to U.S. national security -- despite the Administration's assessment that it is on the run. It has now been two years since we withdrew all U.S. forces from Iraq, leaving behind a fragile Iraq that perhaps was not ready to become stable. Since our departure, we have seen a drastic increase in sectarian violence at levels not seen since 2008 -- with over 7,000 civilian deaths so far this year. Leaving Iraq with so much uncertainty caused irreparable repercussions to our regional and national security interests -- not to mention all of the sacrifices made by our brave men and women in uniform. The Administration's failure to find a mutually agreeable resolution to extend our presence in Iraq has severely weakened our influence in the country, and left a vacuum that is currently being filled by forces who seek to harm us and our allies. On one side, we see a growing Iranian influence in Iraq, as the regime in Tehran strengthens its ties with the Maliki government. Nowhere is this more evident than with the unwillingness of the Iraqi government to halt the Iranians from using Iraqi airspace to ship Assad and his regime weapons, supplies and even Iran's Revolutionary Guard Corps, IRGC, members to fight along Hezbollah and Assad's forces. On the other hand, we have seen a dangerous rise in extremism as we witness a clear resurgence of al-Qaeda in Iraq, AQI, -- also known as the Islamic State of Iraq and al-Sham, ISIS, -- and other groups, due to the fact that the Iraqi security forces are struggling to combat these extremists and their government is not willing to be tough on the Iranian regime." From the opening statement of Committee Chairman Bob Goodlatte: "While testifying this March, ICE [Immigration and Customs Enforcement] Director Saldaña expressed her enthusiastic support for mandatory detainers. Then, the very next day, she retracted that statement made under oath and called mandatory detainers highly counterproductive. There are now more than 200 jurisdictions, including San Francisco, which refuse to honor ICE detainers. This effectively releases criminal aliens onto the streets with all too tragic results. Secretary Johnson's solution, the Priorities Enforcement Program, is a failure. Politely asking for cooperation from sanctuary cities is a fool's errand. The clear answer to this problem is for DHS to mandate compliance with detainers and for this Administration to defend the mandatory nature of detainers in Federal court. Unfortunately, the Administration has taken neither of these crucial steps to keep our communities safe. Prior to Secretary Johnson's appointment, DHS, under the Obama administration, went beyond simple nonenforcement and took the leap of granting administrative amnesty to a class of hundreds of thousands of unlawful aliens. Then, last November, Secretary Johnson announced that DHS would grant such deferred action to over 4 million more unlawful aliens. By granting these classes of people deferred action, he would bestow benefits such as legal presence, work authorization, and access to the Social Security trust fund, and the earned income tax credit. It is within the constitutional authority of Congress, not the Administration, to grant such benefits to classes of unlawful aliens. Twenty-six States believe that Secretary Johnson's planned grant of deferred action en masse would cause them irreparable harm. They challenged the plan in Federal court. While still a new industry, UAS are already contributing to our economy and changing how companies do business. Across the country, we already see UAS used for a myriad of operations, from surveying, photography and safety inspections, to medical delivery and search and rescue. With each new use, businesses and commercial users can save time, money, and even lives. But like any other new technology, UAS bring new challenges as well. In the past year, pilots have been reporting sightings of UAS near airports at an accelerating rate. In 2014, the FAA received 238 reports of drone sightings. In 2015, the number has already exceeded 600. Safety is paramount in aviation and the increased number of suspected sightings raises serious questions. Some of these reports involved airliners and occurred at low altitudes near the nation's busiest airports. Other reports involve pilots of general aviation aircraft in less busy airspace. The real possibility of a mid-air collision must be taken seriously in order to prevent tragic consequences." I applaud NRC [Nuclear Regulatory Commission] staff for recently releasing the draft supplemental environmental impact statement (SEIS) on potential groundwater impacts for Yucca Mountain. The draft SEIS again verifies the repository can safely operate for 1 million years and affirms the site is the best solution to permanently dispose of spent nuclear fuel. The Federal Government's inability to fulfill its legal obligations established by the Nuclear Waste Policy Act continues to increase every year Yucca Mountain is delayed. The NRC and Department of Energy must resume consideration of the Yucca Mountain license application and reach a final decision whether the site, as science has indicated, can safely store spent nuclear fuel. In upcoming months we will consider other important components of a used fuel management system. Issues such as transportation, benefits for host States and communities, the role of consolidated interim storage, and system budgeting and funding challenges should be thoughtfully examined to inform used fuel legislation." New companies who are developing and deploying antiterrorism products and services are justifiably concerned that these technologies could leave them and their customers exposed to enormous civil liabilities. Legal precedents such as those emanating from the 9/11 attacks as well as those holding the Port Authority of New York and New Jersey liable for the 1993 World Trade Center attacks make it clear that civil litigation can intimidate the developers and users of security technologies and services after a terrorist event. So Congress acted decisively to address this concern by passing the SAFETY Act as part of the Homeland Security Act of 2002. SAFETY Act is intended to encourage the development and deployment of antiterrorism technologies by limiting the liability of sellers of the technology for third-party claims arising out of an act of terrorism where the technology has been deployed to prevent, respond to, or recover from such an act. It is meant not only to protect technology providers, but also businesses and facilities using them and to encourage people to use them before the fact.
