Federal Financial Assistance and Civil Rights Requirements [May 18, 2022]
From the Document: "Congress has authorized federal agencies to distribute federal funding to aid a wide range of industries and entities. [...] The recipients of federal financial assistance are obligated to comply with various laws and regulations, including the requirements of four major civil rights laws[.] [...] As explored in more detail below, these civil rights laws are generally enforced in two ways. First, when an agency distributes financial assistance, it is responsible for ensuring recipients' compliance with the relevant civil rights laws in the funding programs it administers. [...] Second, private litigants harmed by a violation of these laws can sue in federal court to enforce relevant requirements against recipients directly. [...] This report opens with a brief discussion of the Supreme Court's treatment of Title VI, Title IX, Section 504, and the Age Discrimination Act as legislation enacted pursuant to Congress's authority under the Spending Clause before turning to an examination of these statutes' requirements, which apply to recipients of federal financial assistance. The report then notes how federal agencies and federal courts enforce these statutory and regulatory requirements. Given the legal obligations that come with the receipt of federal financial assistance, this report also explores questions regarding which types of federal aid qualify as federal financial assistance for the purposes of these civil rights spending laws, and which entities constitute recipients of such assistance. This report closes with potential legislative considerations, including a discussion of the unique aspects of legislation enacted pursuant to Congress's Spending Clause authority."

This is the July 31, 2013 hearing on "TSA Integrity Challenges: Examining Misconduct by Airport Security Personnel," held before the U.S. House of Representatives Subcommittees on Oversight and Management Efficiency and Transportation Security of the Committee on Homeland Security. From the opening statement of Jeff Duncan: "The Transportation Security Administration (TSA) was created after the horrific terrorist attacks of September 11th, 2001 in an effort to strengthen the security of our nation's transportation systems, especially our airports. Considering the nature of the attacks, and other terrorist attempts, like the 2009 Christmas Day underwear bomber and the 2001 shoe bomb plot, the American public looks to the TSA to keep them safe when flying. However, with countless TSA misconduct cases spread throughout the country, confidence in airport security is quickly waning. For example, in 2011, a Transportation Security Officer at Newark Airport pleaded guilty to stealing thousands of dollars in cash and other valuables from unsuspecting travelers. In March of this year, a wanted rape suspect made his way through the security checkpoint at JFK carrying a 3,800K-volt stun-gun, which is definitely on the list of banned items for airplane travel. And, in February of this year, TSA improperly detained a 3-year-old disabled, wheelchair-bound child suffering from spina bifida on her way to Disney World with her family. This instance specifically was heart-breaking. TSA must do more to focus on the true threats and stop with invasive screening of low risk travelers." Statewide Interoperability Planning Guidebook
"The purpose of this Statewide Interoperability Planning Guidebook is to provide the designated State Interoperability Coordinators or the appropriate authority from each of the states and territories with an explanation of the statewide plan criteria, a step-by-step guide for developing an interoperability plan, and a recommended layout for the statewide plans. Detailed explanations include common questions to consider, helpful hints in completing each section, and a list of the criteria each section addresses. This guidebook will help communities not only satisfactorily respond to the statewide plan criteria, but also define an actionable path forward for states and their leaders. Interoperable emergency response communications enable agencies to exchange voice and/or data on demand, in real time, when needed, and when authorized. Truly seamless communications interoperability will be achieved when any emergency response official can be deployed anywhere in the country, use his or her own radio to communicate with other responders, and use the compatible standard operating procedures (SOPs) he or she has been trained on in their respective jurisdiction."

From the remarks of Secretary Chertoff: "The Department of Homeland Security has been working hard to implement two important laws that will add greatly to our security. Both of them were recommended by the 9/11 Commission. The first, the REAL ID Act, raises the bar for the security of driver's licenses so that we can actually rely on those documents. The REAL ID Act requires that the federal government accept only driver's licenses that clearly establish identity and legal presence in the United States. The second, the Western Hemisphere Travel Initiative, or WHTI, requires passports or similar secure documents, including secure, enhanced driver's licenses, for everyone who crosses our borders, including the land border with Canada. I'm pleased that New York has agreed to work with the Department of Homeland Security to move forward with both REAL ID and enhanced driver's licenses. Let me expand. First, New York has announced a number of anti-fraud security measures to meet the requirements of REAL ID to make their driver's licenses more secure than they already are. The state is using advanced, facial recognition technology, central issuance procedures, and advanced document verification systems. These techniques will make New York licenses among the most secure in the country. The Governor has also committed to marking licenses that do not meet federal requirements, and to adopting a residency requirement to prevent misuse of New York licenses by people from out of state. This meets the requirement that REAL ID licenses be tamper-proof, secure and available only to U.S. citizens or those lawfully in the country."

Remarks by Homeland Security Secretary Michael Chertoff at a Securing the Schools Initiative Event [October 30, 2007]
From the remarks of Secretary Chertoff: "Through the Safe School Initiative, we comprehensively assessed over 25 years of school shootings and incidents; 37 incidents in particular of targeted school violence involving 41 attackers. And it looked at the characteristics and the behavior of people involved in these kinds of incidents, recognizing very importantly that often these are incidents which do have some harbingers; they don't simply erupt out of the blue, but there are some warning signs. In fact, in 81 percent of the cases studied as part of the Safe School Initiative, other people had some kind of prior notice of the possibility of an attack before that attack was carried out. And I think that in this particular new century that we're in, where students are now communicating online and using chat rooms and e-mails and text messages, there are even more opportunities to detect and be made aware of potential threats before they actually come to pass. And that's why it's very important to know what to look for and how to respond."
