  From the opening statement of the Hon. Joshua Eilberg: "The second half of this morning's hearing will be concerned with the operation of section 212(d) (3) of the Immigration and Nationality Act. As such, this portion of the hearing represents a continuation of oversight hearings which have been held to review the general administration of various provisions of the Immigration Act by the Department of State and the Department of Justice, and we will continue to hold such hearings throughout this Congress. 212(d)(3) provides a broad grant of discretionary authority to the Attorney General to waive most of the grounds of excludability set forth in section 212 for aliens who are applying for temporary admission to the United States. The waiver authority extends to every ground for exclusion except those set forth in section 212(a) (27) and section 29 relating to national welfare, safety, or security. In conferring this authority on the Attorney General, Congress clearly recognized that certain circumstances could justify the temporary admission of an inadmissible alien for the purpose of promoting international trade, furthering the national interest, or for example, to enable an alien to obtain medical care in the United States which was not available in his native country. At the same time, Congress expressed its intent to closely monitor the implementation of this section of law under section 212(d)(6) which requires the Attorney General to submit detailed reports to the Congress on waivers which are granted for criminals and members of the Communist Party."

• Ground Motion Values for Use in the Seismic Design of the Trans-Alaska Pipeline System

  From the abstract: "The proposed trans-Alaska oil pipeline, which would traverse the state north to south from Prudhoe Bay on the Arctic coast to Valdez on Prince William Sound, will be subject to serious earthquake hazards over much of its length. To be acceptable from an environmental standpoint, the pipeline system is to be designed to minimize the potential of oil leakage resulting from seismic shaking, faulting, and seismically induced ground deformation. The design of the pipeline system must accommodate the effects of earthquakes with magnitudes ranging from 5.5 to 8.5 as specified in the 'Stipulations for Proposed Trans-Alaskan Pipeline System.' This report characterizes ground motions for the specified earthquakes in terms of peak levels of ground acceleration, velocity, and displacement and of duration of shaking. Published strong motion data from the Western United States are critically reviewed to determine the intensity and duration of shaking within several kilometers of the slipped fault. For magnitudes 5 and 6, for which sufficient near-fault records are available, the adopted ground motion values are based on data. For larger earthquakes the values are based on extrapolations from the data for smaller shocks, guided by simplified theoretical models of the faulting process."

In the months ahead, it will be this subcommittee's particular responsibility to see that the needs of our Government for intelligence information are met efficiently and effectively and in a manner that is consistent with the fundamental rights of American citizens. Allegations of widespread abuse of rights by the intelligence community led to the previous select committee's 15-month investigation of intelligence activities. In conclusion, extremely conservative calculations demonstrated that it is completely impossible for either the earth`s atmosphere or sea to sustain fusion reactions of either thermonuclear nuclear chain reaction type. And, in particular, such reactions cannot be triggered by the explosion of nuclear weapons, even those having unrealistically high yield and impractical high yield-to-weight."

• Church Report: Covert Action in Chile 1963-1973

  Covert United States involvement in Chile in the decade between 1963 and 1973 was extensive and continuous. This report of a congressional committee chaired by Senator Frank Church of Idaho investigates U.S. intelligence operations in Chile during this time. This study is primarily concerned with what is labeled "covert action" by the United States government and its purpose is to evaluate the intent and effect of clandestine American activities in Chile. The report preliminarily concludes that covert action has been a key element of U.S. foreign policy toward Chile and was obvious throughout the decade between 1964 and 1974. "In 1964, the United States commitment to democratic reform via the Alliance for Progress and overt foreign aid was buttressed via covert support for the election of the candidate of the Christian Democratic party, a candidate and a party for which the Alliance seemed tailor made. During 1970 the U.S. Government tried, covertly, to prevent Allende from becoming President of Chile. When that failed, covert support to his opposition formed one of a triad of official actions: covert aid to opposition forces, "cool but correct" diplomatic posture, and economic pressure. From support of what the United States considered to be democratic and progressive forces in Chile we had moved finally to advocating and encouraging the overthrow of a democratically elected government."

  "A tsunami or seismic sea wave is a series of waves of extremely long wavelength and period caused by an underwater disturbance. Although most tsunamis are associated with large earthquakes in which the epicenters underlie or border the ocean floor, the generating mechanism is not positively known. Vertical displacement of the ocean floor during an earthquake may be responsible, or possible submarine avalanches on the slope of oceanic trenches, or generation of resonant oscillations of trench water by long-period earthquake waves. Submarine volcanic eruptions also have been known to generate tsunamis. All submarine earthquakes do not produce tsunamis, and all tsunamis are not large enough to cause damage; however, occasional large waves have caused great destruction and loss of life in coastal areas. At present, there is no way. to determine if an earthquake has generated a tsunami, except to note the occurrence and epicenter of the earthquake and then detect the arrival of the characteristic waves at a network of tide stations. The waves, although often called tidal waves, have nothing to do with the tides."

  "Smoke as a critical factor in the safety of persons in a fire situation in a high-rise building has received considerable attention in recent years. In case of fire in such a structure, the initial buoyancy forces due to heat may be augmented by a stack effect resulting from weather conditions to cause air and smoke to travel more rapidly upwards in stairways and elevator and utility shafts. This vertical movement of smoke not only speeds smoke infiltration into the upper levels of a building, but can also leave travel paths clogged with smoke, thus hindering or preventing evacuations and obstructing the efforts of firefighters. Recent research abroad and in the United States has indicated the feasibility of smoke control by means of ventilation make-up, air input, and pressurization or venting of the stair-wells. [...] Current smoke control activities at the National Bureau of Standards (NBS) are aimed at evaluating the techniques quantitatively. With this in mind two approaches have been taken: first, to conduct high-rise smoke simulation experiments that can quantitatively measure the smoke movement under controlled and uncontrolled conditions; and second, to model the smoke simulation experiments analytically: to establish a smoke movement prediction program which will form the basis for optimizing smoke control design standards."

  "Since the beginning of time, man has sought protection from the dangers of a hostile environment. The cave, the forest, even hollow logs provided refuge for many of our forebears. Where the shelter and the actions taken were suitable to meet the emergency conditions, man survived. History contains countless references to individual, group, and community actions for protection from famine, flood, fire, and the effects of war. It was not, however, until the onset of World War II, with the threat of large-scale aerial attacks on cities and industrial centers, that civil defense planning gained impetus. Added impetus resulted from the advent of atomic and thermonuclear weapons and advanced delivery systems. […] The origin of civil defense preparedness in the United States may be traced to August 1916, when Congress established the Council of National Defense to coordinate 'industries and resources for the national security and welfare, and to create relations which will render possible, in time of need, the immediate concentration and utilization of the resources of the Nation'. The Council consisted of the Secretaries of War, Navy, Interior, Agriculture, Commerce, and Labor. In December 1918, this Council was dissolved, and from that time until 1940, civil defense in a formal sense did not exist in the United States. On May 28, 1940, President Roosevelt established the National Defense Advisory Commission, which included the Division of State and Local Cooperation. In May 1941, a Presidential Executive Order replaced the Division of State and Local Cooperation with the Office of Civilian Defense."

  This letter, one of a number sent by FBI attache Robert Scherrer to Chilean General Ernesto Baeza, provides intelligence obtained through the interrogation of a captured Chilean leftist, Jorge Isaac Fuentes. The document records US collaboration with Chile's security forces, including the promise of surveillance of subjects inside the United States. Fuentes was detained through Operation Condor - a network of Chilean, Argentinian and Paraguayan secret police agency which coordinated tracking, capturing and killing opponents. According to the Report of the Chilean National Commission on Truth and Reconciliation, he was tortured in Paraguay, turned over to the Chilean secret police, and disappeared.

However, unmet needs still exist in our monitoring, warning preparation, warning dissemination, and preparedness capabilities. The 'Federal Plan for Natural Disaster Warning and Preparedness' was published in June 1973. That Plan presented a comprehensive picture of the coordinated plans of 10 Federal agencies to bring about needed improvements to the warning system and preparedness programs. In the months since the Plan was prepared, much progress has been made to improve the system, and applications of recent technological advances promise even greater future improvements."

• Strategic Intelligence from ERTS? An Analysis of Digital Data on Soviet ICBM Sites

  "The Earth Resources Technology Satellite, ERTS-1 (recently renamed LANDSAT-1), and its successor, LANDSAT-2, are providing the world with a revolutionary form of electro-optical overhead imagery at very low cost to the consumer. ERTS products are freely available for purchase from the United States, and a growing number of countries are building their own ground receiving stations. ERTS data could be a source of strategic intelligence for countries that do not have access to overhead reconnaissance systems but do have strategic missile-targeting and other military requirements. Because of the growing usage of ERTS data and de-centralization of dissemination centers, the difficult of detecting foreign military intelligence use of that data is increasing rapidly. This study reveals little evidence that foreign countries are exploiting the military and strategic intelligence potential of purchased ERTS data; but the Peoples Republic of China, which has shown interest in ERTS data and has made a considerable effort to obtain geodetic information and maps covering the Soviet Union and other areas, appears to be a possible user of ERTS data for such applications. An assessment of standard ERTS multi-spectral film coverage of selected Soviet areas indicates that the Chinese could now use it to identify and target large cities, airports, port facilities and transportation routes. ERTS digital images and data, supplemented by collateral information, could be used to map and target even smaller features, such as the larger Soviet SAM [surface-to-air missile] sites and soft ICBM [intercontinental ballistic missile] sites."

• Some Climatological Characteristics of Hurricanes and Tropical Storms, Gulf and East Coasts of the United States

  "A climatology of hurricane factors important to storm surges is presented for the U. S. gulf and east coasts. A smoothed frequency of tropical storms and hurricanes entering and exiting the coast and storms passing within 150 n .mi. [nautical miles] of the coast during the period 1871-1973 is given. The central pressure for hurricanes and tropical storms and the radius of maximum winds and speed of forward motion for hurricanes were obtained from data analysis . Directions of landfalling hurricanes and tropical storms at the time they crossed the coast at selected points were also analyzed. The probability distribution of each factor was plotted and analyzed for each 50-n.mi. interval along the coast . Selected probability levels of each distribution were then summarized, and smoothed variations along the coast were obtained by analysis . The speeds of motion for two classes of hurricanes (those that entered the coast and those that passed within 150 n .mi. of the coast) were studied separately and a smooth speed analysis determined for each. The question of joint probability among the various factors and with latitude is discussed qualitatively."

  "I would like to speak to you this evening about confidentiality and democratic government. The subject is an important one. It is complicated and has many facets. I do not suggest there are easy answers. I do suggest, however, that public understanding of the issues involved and the relationship among the issues is extremely important. The bar as a profession has an enormous responsibility to help clarify these issues. My belief is that understanding may be increased by putting together certain doctrines and values with which most of us would agree. The relationship among these doctrines and values may have been obscured in the recent past. If hard cases sometimes make bad law, emergency situations also have distorted our perspective. The public good requires that we try to correct that distortion. In recent years, the very concept of confidentiality in government has been increasingly challenged as contrary to our democratic ideals, to the constitutional guarantees of freedom of expression and freedom of the press, and to our structure of government. Any limitation on the disclosure of information about the conduct of government, it is said, constitutes an abridgement of the people's right to know and cannot be justified. Indeed, it is asserted that governmental secrecy serves no purpose other than to shield improper or unlawful action from public scrutiny. This perception of the relationship between confidentiality and government has been shaped in large measure by the Watergate affair. The unfortunate legacy of that affair is a pervasive distrust of public officials and a popular willingness to infer impropriety. Skepticism and distrust have their value; they are not the only values to which our society must respond."
