  "I am pleased to forward a copy of 'Our Changing Planet: the FY 1998 U.S Global Change Research Program'. This annual report was prepared under the auspices of the President's National Science and Technology Council (NSTC). The first edition of 'Our Changing Planet' was transmitted to Congress as a supplement to the FY 1990 budget. In the eight years since, the U.S. Global Change Research Program (USGCRP) has brought about dramatic improvements in our knowledge of the Earth system. Consider just a few of the major accomplishments. The rate, extent, and mechanisms of stratospheric ozone depletion are largely understood, enabling us to monitor the effectiveness of the remedial actions that this knowledge has stimulated. The rate and extent of South American tropical deforestation have been documented, the other tropical regions of the world are being inventoried, and a series of exciting new interdisciplinary investigations are unraveling the basic processes, causes and effects of land cover change. The onset and effects of El Niño/Southern Oscillation ocean circulation events in the Pacific are being predicted with increasing accuracy, and these science results are being used to create useful information for resource managers around the world."

  This report represents the first effort of its kind to characterize the legal and regulatory structures of the critical infrastructures as they pertain to infrastructure assurance. The first part provides a high-level overview of the legal landscape. The report then presents the results of a two-stage survey, proceeding agency by agency and, in some cases, office by office, describing each of the relevant body's authority and jurisdiction and its current mechanisms and programs relating to infrastructure assurance. It also attempts to identify authorities or mechanisms or to merely spot infrastructure-assurance-related issues. These efforts have identified many legal and policy issues that will help drive the implementation process for the Commission's recommendations.

  "Executive Order 13010 established the President's Commission on Critical Infrastructure Protection (PCCIP) and tasked it with assessing the vulnerabilities of, and threats to, eight named critical infrastructures and developing a national strategy for protecting those infrastructures from physical and cyber threats. The Executive Order also required that the PCCIP consider the legal and policy issues raised by efforts to protect the critical infrastructures and propose statutory and regulatory changes necessary to effect any subsequent PCCIP recommendations. To respond to the legal challenges posed by efforts to protect critical infrastructures, the PCCIP undertook a variety of activities to formulate options and to facilitate eventual implementation of PCCIP recommendations by the Federal government and the private sector. The PCCIP recognized that the process of infrastructure assurance would require cultural and legal change over time. Thus, these activities were undertaken with the expectation that many would continue past the life of the PCCIP itself. The Legal Foundations series of reports attempts to identify and describe many of the legal issues associated with the process of infrastructure assurance. The reports were used by the PCCIP to inform its deliberations. […] Legal Foundations: Studies and Conclusions is the overall summary report. It describes the other reports, the methodologies used by the researchers to prepare them, and summarizes the possible approaches and conclusions that were presented to the PCCIP for its consideration. The series has been sequenced to allow interested readers to study in detail a specific area of interest. However, to fully appreciate the scope of the topics studied and their potential interaction, a review of the entire series is recommended."

  This edition of "Proliferation: Threat and Response" updates the original 1996 report with new information about the proliferation challenge as well as new programs put in place to counter proliferation. The report is divided into two main sections. The first section focuses on regional challenges and evaluated the goals, capabilities, intentions, and trends for each of the following regions: Northeast Asia; South Asia; the Middle East and North Africa; and Russia, Ukraine, Kazakhstan, and Belarus. Also included is an evaluation of the transnational threat, including both terrorism and nuclear security. The second section is an overview of Department of Defense counter-proliferation programs, which are categorized by prevention, protection, and acquisition. A technical annex, glossary, and list of suggestions for further reading are contained at the conclusion of the report.

• Chemical Weapons Disposal: Understanding Scheduled Downtime at Disposal Facilities

  "The U.S. Army Chemical Materials Agency (CMA) is responsible for protecting and safely storing the nation's aging chemical weapons, while working toward the effective recovery, treatment and ultimate elimination of the nation's chemical warfare materiel and to enhance national security. Aging chemical weapons, many created during World War II, Korean and Cold War eras are safely stored in eight secured sites within the continental United States. The weapons pose risks to our nation and those communities surrounding the storage sites, the longer they remain in storage. These risks include ones posed by natural events, i.e., earthquakes, lightening and tornadoes, weapon degradation and the threat of terrorist attack. CMA has been charged by Congress to eliminate this risk to our nation using approved disposal technologies. These technologies are part of on-site disposal facilities designed to destroy chemical weapons in a safe and environmentally friendly manner. Facilities are designed with engineering controls and safeguards to ensure the protection of workers, the public and environment. Once a facility begins destroying chemical agent, it will stop operations periodically for pre-scheduled preventative maintenance, and/or preparations for destroying a new type of munition [a 100-pound spray tank vs. an 8-inch projectile] or a different kind of chemical agent. Preventive maintenance and preparation for destroying a new type of munition or a different chemical agent are important aspects of CMA's mission to safely and effectively eliminate chemical weapons."

• Linking Legacies: Connecting the Cold War Nuclear Weapons Production Processes to Their Environmental Consequences

  "In the aftermath of the Cold War, the US has begun addressing the environmental consequences of five decades of nuclear weapons production. In support of this effort, the National Defense Authorization Act for Fiscal Year 1995 directed the Department of Energy (DOE) to describe the waste streams generated during each step in the production of nuclear weapons. Accordingly, this report responds to this mandate, and it is the Department`s first comprehensive analysis of the sources of waste and contamination generated by the production of nuclear weapons. The report also contains information on the missions and functions of nuclear weapons facilities, on the inventories of waste and materials remaining at these facilities, as well as on the extent and characteristics of contamination in and around these facilities. This analysis unites specific environmental impacts of nuclear weapons production with particular production processes. The Department used historical records to connect nuclear weapons production processes with emerging data on waste and contamination. In this way, two of the Department's legacies--nuclear weapons manufacturing and environmental management--have become systematically linked. The goal of this report is to provide Congress, DOE program managers, non-governmental analysts, and the public with an explicit picture of the environmental results of each step in the nuclear weapons production and disposition cycle."

  From the thesis abstract: "As the military moves into the 21st century its focus is outward to meet a foreign threat. The growing number of militias and racial extremist in this country, that are advocating violence and the overthrow of our government, will demand that in the 21st century the military will have to look inward to meet a domestic threat. [... The 1990's] have seen a large increase in the number of Militias, Patriot movements, and religiously founded extremist, both black and white, in America. It is estimated that there are over 441 militias and 368 Patriot groups, involving by some accounts, up to five million people. The main drive behind these movements has been a growing dissatisfaction with how our government is being run and economic hardship. Most of the Militias have formed because of the fear that the United States government is being taken over by the United Nations under the auspices of the 'new world order.' The members of the militia feel they must stand up their armies and stop the take over, to protect our country. Two recent events have fueled the fires of militia mania. They are: the stand off at Ruby Ridge, Idaho and the attack on the Branch Davidian compound in Waco, Texas. Unfortunately the threats of violence are no longer just talk as shown by the Oklahoma City bombing, and the increase of militia involvement in crime to support their cause."

• Evaluation of Implementation of a New Emergency Management System for Public Health in the State of Georgia

  "This Report presents a qualitative evaluation of the effectiveness of preparedness efforts in the State public health system during two subsequent disasters in 1998. Overall, the State and district staff reported that the planning process and regular plan maintenance implemented under the new public health system greatly improved their ability to respond effectively, especially in relation to staff management, communications, reduced stress, and improved deployment times, as well as other areas. However, some shortcomings with the new system were also noted. Overall, the system worked well, but will continue to require support and guidance from the DPH Emergency Coordinator for the procedures to run smoothly. The general sentiment after the analysis was that because of their prior flood experience, the public health staff knew they could handle anything; because of their planning, they knew they could do it efficiently. This Report was funded in part through a Quick Response Research Grant from the Natural Hazards Research and Applications Information Center. "

• Domestic Operations: The Canadian Approach

  "The application of military force by a democratic government within the confines of its borders, and in some cases against its citizenry, has long been a controversial and politically sensitive topic. Though that is not a new type of operation for either the American or the Canadian military establishments, the nature of the threats each is being asked to confront has evolved. [...]. It is safe to assert that threats to North American domestic security will increase in nature, scope, and number in the next century. This in turn will presumably prompt more debate on and calls for an increase in the military's role in containing and neutralizing those threats. Military commentators, observers, and policymakers in both nations can perhaps learn from one another how democratic and culturally similar nations prepare for and respond to domestic situations requiring military force. The United States' closest ally and trading partner, Canada, has in the past 30 years undertaken several sensitive domestic operations. Canada has forged effective intragovernment legal and command mechanisms to conduct such operations effectively with its small but well-trained military. The purpose of this article is to explain what these mechanisms are, how they have evolved, and how they have been employed by the Canadian government. Though structured primarily to support and implement government policy overseas and to protect Canada from external threats, the Canadian Forces provide the battlefield attributes of coordination, communications, mobility, organization, discipline, and force which the civil power does not possess in abundance, if at all."

• Worker Responses to Realistic Evacuation Training

  This paper from the Pittsburgh Research Center of the National Institute for Occupational Safety and Health examines the human stress response during emergency evacuation from the underground mining work environment. The paper was published for presentation at the International Emergency Management Society Conference, Copenhagen, Denmark, January, 1997. From the "Discussion" section: "In an emergency situation such as escape under apparatus in smoke from an underground mine, the stress response is a normal reaction. Placing miners in a realistic simulation as was done by design in this study, created a stressful situation for these subjects. Their responses to this situation presented an opportunity to compare individuals having previous experience or training in smoke with those who had no previous experience or training. The study also allowed for a comparison of reactions to stress based upon previous experience or training. The general finding that miners who had more experience or training also tended to report less stress during the exercise suggests the value of realistic instruction. Thus, the following recommendations are offered: [1] Develop emergency escape simulation training as part of Annual Refresher Training in the U.S. [2] In the training, include information about the human stress response for all mine workers and, especially, for mine rescue teams. Additionally, foster an environment in which this type of training can occur. It is suggested that, in planning procedures for dealing with mine emergencies, mining companies develop relationships and arrange for collaboration among mine management, community health (including mental health), and local emergency personnel." • Is Counterproliferation Compatible with Nonproliferation? Rethinking the Defense Counterproliferation Initiative [Airpower Journal, Spring 1997]

  "The Gulf War of 1991 might have had a much different outcome had Saddam Hussein possessed a small nuclear arsenal or if he had decided to use his chemical weapons. The Bottom-Up Review conducted by the Department of Defense (DOD) in 1993 identified the threat of weapons of mass destruction (WMD) in the hands of a small number of antagonistic regional adversaries such as Iraq as the number one security threat to the United States. On the one side, the Clinton administration vigorously advocates traditional nonproliferation measures. US leader ship was instrumental in securing the unconditional and indefinite extension of the Nuclear Non proliferation Treaty (NPT) in May 1995. The United States is moving forward with negotiations for the Comprehensive Test Ban Treaty and the Fissile Material Cut off. The administration also promotes the Chemical Weapons Convention and Biological Weapons Convention despite the resurgent opposition of congressional conservatives. Under US leadership, classical diplomatic approaches to WMD nonproliferation are enjoying broader international support than ever before. On the other side, DOD launched its defense Counterproliferation Initiative (CPI) in December 1993 under the sponsor ship of the late secretary of defense Les Aspin. Counterproliferation provides military options to counter the acquisition and use of WMD by regional adversaries. Its supporters claim that these new military options will strengthen and enhance the traditional nonproliferation options. Key DOD officials have been careful to stress that counterproliferation will in no way replace nonproliferation, but that its purpose is to provide us able options when nonproliferation fails."

• Role of Federal Military Forces in Domestic Disorders 1877-1945

  "Though the turmoil of the cold war focused the Army on the challenges of conventional and nuclear conflict, the Army has a rich legacy of conducting domestic support operations. These have included activities from disaster relief to managing Indian reservations, military government in the post-Civil War South to supporting domestic law enforcement. This study focuses on the use of federal troops in domestic disorders from 1877 through 1945. These operations are not only an important part of our Army's past, but they portend lessons for the future. As the U.S. Army enters its third century of service to the nation, it faces an era in which it will undoubtedly be called on again to conduct domestic support operations at home and stability and peace operations overseas. This work, the second of three volumes on the history of Army domestic support operations, encompasses a tumultuous era, the rise of industrial America with attendant social dislocation and strife. It begins with the first major U.S. Army intervention in a labor dispute, the Great Railway Strike of 1877, and concludes with War Department seizures of strike-plagued industries during World War II. The evolution of the Army's role in domestic support operations, its strict adherence to law, and the disciplined manner in which it conducted these difficult and often unpopular operations are major themes of this volume. Throughout these troubled times presidents came to rely on the U.S. Army to provide units for civil disturbance duty. The national leadership began to tap the Army for units as a first, not last, resort. Army units not only enforced federal authority, but also aided local and state officials in maintaining law and order, protecting lives and property, and preserving social and political stability."

Spencer Abraham: "We should note that the vast majority of citizenship applicants are law abiding, legal immigrants with every right and desire to become full-fledged American citizens. At the same time, we must recognize that all of us, those who are citizens, whether they are native-born Americans or naturalized citizens, have, I think, the right to know that the process by which others gain their citizenship is a process that is conducted in a credible way, in an accurate way, and in a way that only permits those who are eligible and who play by the rules to become citizens. So, certainly, our goal here today and in further hearings is going to be to try to take actions that make sure that that is the way the process is functioning. Unfortunately, there have been problems in the naturalization process which have been observed, causing those who are not eligible, those with criminal backgrounds, to be naturalized. I want to stress and make this point, that these are not new problems. They are not ones that just came to light in the last few weeks or few months. In 1988, a Department of Justice audit found no record of fingerprint checks requested or mailed to the FBI in something in the vicinity of 47 percent of the files reviewed, and I think we will be hearing more about that." We have a number of important issues to consider in relation to the reauthorization of that very popular program, and I am pleased that we have excellent witnesses to bring us up to date both on what has happened during the program's current establishment and also to talk about where we go from here. The Visa Waiver Program essentially is a system by which aliens from designated countries may enter the United States as temporary visitors without the visa that would normally be required to enter our country in addition to a passport. Because this very popular program expires at the end of the current fiscal year, on September 30, 1997, the subcommittee will have to consider its reauthorization, along with any changes or modifications that we find should be made to the program."   From the opening statement of Steve Horn: "On January 17, 1994, an earthquake measuring 6.7 percent on the Richter scale struck the Los Angeles area. It was one of the most devastating natural disasters ever to confront our Nation. In its wake, more than 70 people lost their lives, and thousands were injured. Tens of thousands of structures were damaged, leaving over 25,000 people homeless. Severe destruction to the freeways occurred tying up the region's transportation network. The damage resulting from the quake was estimated to exceed $20 billion. Immediately following the earthquake, the Federal Government, working with State and local governments, mobilized its responses. Coordinated by the Federal Emergency Management Agency, FEMA [Federal Emergency Management Agency], the recovery effort continues through this day. The purpose of today's hearings is to determine the adequacy of the Federal Government's response, the cooperation between Federal, State, local governmental entities as well as the work of nonprofit and community organizations. In a region where earthquakes are a constant threat, it is imperative for Members of Congress to understand first-hand what occurred in the aftermath of the Northridge earthquake in order to learn from it."   "In July 1996, the National Institute for Occupational Safety and Health (NIOSH) received a Health Hazard Evaluation (HHE) request from the Building Services Supervisor at the New Hampshire Police Standards and Training facility in Concord, New Hampshire. Although no adverse health effects had been reported, the request was prompted by concern about potential staff and recruit exposures to lead at the James S. Noyes Firearms Training Facility. In response to this request, NIOSH conducted a site visit on September 19-20, 1996, which included environmental sampling and a walk-through inspection of the facility."

  From the Introduction: "Since the early 1960s, US policymakers have come to rely increasingly on photo-reconnaissance satellite imagery for timely and accurate intelligence. Photo-reconnaissance satellites and the information they provide have become virtually indispensable to the US Intelligence Community and its intelligence assessments. Developed, operated, and managed by the National Reconnaissance Office (NRO) , these satellite systems sparked a revolution in intelligence collection. Operating in a crisis atmosphere, the NRO forged a unique working partnership with US private industry to design and build these new satellite systems. The NRO/industry partnership drove space reconnaissance technology beyond current limits. It made possible a new generation of photo-reconnaissance technologies that resulted in the acquisition of never-before-seen, detailed intelligence data for US officials."
