  From the opening statement of Dan Lungren: "Today's world is even more interconnected through cyberspace, not just through the use of computers, but because of our increasing reliance on cybersystems to control our national infrastructures and economy. Ensuring that essential services and industries survive an attack has always been a part of our national security strategy. What is new is how cyberspace networks have created complex interdependencies that have never existed to this extent before. The complexity and extent of these networks is not fully understood. The technology and networks are themselves constantly changing. Identifying what is critical is becoming simultaneously more difficult and more vital. Furthermore, the majority of critical infrastructure is outside of Federal control, with 85 percent in private hands. The Department must work hand in hand with the private sector not only because the majority of structure is owned privately, but because the private sector is at the forefront of innovative, productive and efficient technologies to secure cyberspace and associated critical infrastructure." This quarterly report describes the activities of the U.S. Government in support of the East Africa Counterterrorism Operation and the North and West Africa Counterterrorism Operation, as well as the work of the Department of Defense, the Department of State, and the U.S. Agency for International Development to promote the U.S. Government's policy goals in Africa, during the period January 1 through March 31, 2020. This report also discusses the planned, ongoing, and completed oversight work conducted by the Lead IG [Inspector General] agencies and our partner oversight agencies during the quarter. This quarter, the Lead IG agencies issued one evaluation report related to the North and West Africa Counterterrorism Operation.   From the Document: "The objectives of our review were to review States' initial 45-day GEER [Governor's Emergency Education Relief] Fund reports to determine how States plan to allocate funds to entities within the three authorized categories: local educational agencies (LEA), institutions of higher education (IHE), and education-related entities, and the criteria upon which these decisions were based; and review GEER Fund annual reports to identify changes to and progress made from the initial plans in the 45-day reports. To accomplish our objective, we reviewed plans submitted by each of the 50 States, as well as the District of Columbia and Puerto Rico, to determine how they planned to allocate funds to entities within the three authorized categories and the criteria upon which these decisions were based. [...] The Coronavirus Aid, Relief, and Economic Security (CARES) Act was signed into law on March 27, 2020. It authorized more than $2 trillion to battle Coronavirus Disease 2019 (coronavirus) and its economic effects. The CARES Act provided approximately $31 billion for an Education Stabilization Fund to prevent, prepare for, and respond to coronavirus, domestically or internationally. The Education Stabilization Fund is composed of three primary emergency relief funds: a GEER Fund, an Elementary and Secondary School Emergency Relief Fund, and a Higher Education Emergency Relief Fund."

Among those are to provide for the development of one authorized geologic repository for the permanent disposal of waste. The Act also authorizes one commercial spent nuclear fuel interim storage facility under certain conditions. The Department's fiscal year 2010 budget request announced the administration's intended termination of the Yucca Mountain Repository Project and includes the funding needed to explore alternatives for nuclear waste disposal and to continue participation in the Nuclear Regulatory Commission license application process. However, the Department remains committed to meeting its obligations for managing and ultimately disposing of spent nuclear fuel and high level waste. To that end, the Secretary of Energy is convening a blue ribbon panel of experts to evaluate alternative approaches for meeting the federal government's responsibility." Police forces, including the Metropolitan Police Department, are increasingly employing video surveillance, both to deter crime and to catch criminals. The Metropolitan Police Department is in the process of establishing the most extensive surveillance network in the United States; a system that could ultimately include more than 1,000 cameras, all linked to a central command station accessible to not only the District police but the FBI, the Capitol Police, the Secret Service, and other law enforcement agencies. The existence of such a network raises many questions. Among them, does the prevalence of cameras inhibit our privacy rights? Are those cameras effective in deterring or solving crimes? And, perhaps most urgently, who gave permission for the implementation of this system, and where are the policies governing its use? I believe there has been an unfortunate lack of public debate on these issues. Even supporters of electronic surveillance concede that police departments should only use these cameras if there is a widespread public desire for such technology. There is clearly no consensus the District of Columbia for or against these cameras, because the public only learned about their existence after they had been put in place." From the opening statement of Fred Upton: "First, the Nuclear Waste Policy Act is the law on this subject. As Chairman Shimkus stated, that means Yucca Mountain. In shutting down the repository program, the administration did not elaborate on a technical or safety concern, merely that it was 'unworkable.' This was followed by the former Nuclear Regulatory Commission chairman unilaterally ceasing the staff's review of the license application one month -- one month before a key safety evaluation report was to be publicly released with the agency's conclusions about the safety of Yucca Mountain. Electricity consumers pay for the disposal of civilian spent nuclear fuel and taxpayers pay for disposal of nuclear waste from the atomic energy defense program. Michigan consumers alone have paid nearly $600 million dollars into the fund. $15 billion was invested in the repository program and got us within one month of knowing whether we have a scientifically safe and sound location. After spending $15 billion, the public should have a right to know what the NRC [Nuclear Regulatory Commission] concluded. Instead, DOE's [Department of Energy] strategy unfortunately abandons that investment, expecting consumers and taxpayers to foot the bill for another $5.6 billion for the first ten years to start over from square one." But as we know very well and sometimes painfully, there can be a dark side to the Internet, too. The Children's Online Privacy Protection Act [COPPA] was adopted by Congress in 1998 to help protect the privacy of our children. COPPA requires Web sites and other online services to obtain parental consent before collecting and sharing information from kids who are under the age of 13. As a mother and as chairman of the subcommittee, this is an issue that remains one of my top priorities, as well as one of my big areas of concern. For the most part, the FTC [Federal Trade Commission] has done a great job of making sure COPPA has worked well for our kids and their families, but it is time to begin asking some important questions. Should Congress revisit COPPA in light of the rapid technological advances which have been made since its enactment more than a decade ago? Is the current age threshold sufficient to protect our kids or should it be raised? If it is raised, what are the constitutional and technological implications? Is the COPPA safe harbor regime an effective self-regulatory model and could it be successfully utilized in other privacy contexts? And finally, is the expansion of the definition of personal information in the COPPA appropriate for use as a precedent in the broader online privacy context. Today, we will begin debating these and other issues with a respected panel of experts." It is important to ensure that all levels of Government are working together to plan for and prepare for any hazards and disasters. The California Delta has more than 1,000 miles of waterways, more than 1,100 miles of levees, barrier water supply lines, petroleum pipelines, and two inland seaports. The Delta is the main hub for delivering fresh water to millions of California residents in the San Francisco Bay area and southern coastal communities of the State, along with millions of acres of farmland of the San Joaquin Valley. To plan for a disaster in this region, in 2008 the California Legislature passed legislation that created the Sacramento-San Joaquin Delta Multi-Hazard Coordination Task Force to make recommendations on improving, planning, and preparedness. The task force, led by CalEMA [California Emergency Management Agency], issued its report January of this year. The report included recommendations related to establishing an interagency unified command system framework, developing an emergency preparedness and response strategy, and ensuring all hazards training and exercises. Many of these recommendations require close coordination with FEMA, the State and local communities, as well as those in charge of our infrastructure and utilities. […] So, starting off with a Reuters news story this morning reveals that secret U.S. State Department cables trace computer system attacks colorfully code named the Byzantine Hades by U.S. investigators. They have traced these to the Chinese military itself. An April 2009 cable even pinpoints the attacks to a specific unit of the Chinese People's Liberation Army. According to U.S. investigators China has stolen terabytes of sensitive data from password for State Department computers to designs for multi-billion dollar weapon systems. The United States is under attack. Cyber-attack and cyber-espionage traced backed to China have been dramatically increasing every year. What kind of damage is being done? How is our national security being compromised? Well shielding our digital infrastructure from attacks, and protecting the intellectual property and classified information is strategically important to our national security. But how do that and what else needs to be done in terms of protecting this? The Communist Chinese Government has defined us as the enemy. It is buying, building and stealing whatever it takes to contain and destroy us." Waxman: "Just over 4 years ago, the Committee on Government Reform held a hearing entitled 'Overexposed: the Threats to Privacy and Security on File-Sharing Networks.' Then, as now, the hearing was part of a bipartisan effort to investigate and understand the uses and risks of peer-to-peer file-sharing networks, also known as P2P networks. […] After the hearing, numerous P2P file-sharing program distributors adapted a voluntary Code of Conduct to prevent inadvertent disclosures of sensitive information. Along with other Members, I had hoped the problem had been solved. In March, however, the Patent and Trademark Office released a report suggesting the inadvertent file sharing may still be a serious problem. Moreover, following the release of the PTO study, several news reports revealed that individuals and government entities were unknowingly sharing highly confidential information, including files from National Archives, the Department of Transportation, a Naval Hospital, and the Department of Defense. […] In light of these developments, Ranking Member Davis and I agreed that the committee should take another look at the privacy and security issues posed by P2P networks. There are a variety of Internet fraud schemes being used by cyber criminals at any given time. By way of example, a recent fraud scheme involves a cyber criminal gaining access to an unsuspecting users' e-mail account or social networking account, claiming to be the account holder and sending messages to many of the users' friends. In the message, the con man states that he is on travel and has been robbed of his credit cards, passport, money and cell phone. He also states the need for money is immediate. Without realizing the message is from a criminal, the victims of the fraud account holder contacts often wires money to an overseas account without validating the claim." On March 1st, the Office of Management and Budget [OMB], will provide our fifth annual report to Congress on the implementation of the Federal Information Security Management Act [FISMA], which will detail our improvements and remaining weaknesses for both security and privacy. Over the past year, departments and agencies continue to improve their security programs, manage their risks and become more fully compliant with FISMA. To enhance information security programs, OMB continues to use the oversight mechanisms to improve performance, including the President's management agenda score card and the agencies' capital planning processes. We are also engaging agencies in a variety of information security and privacy initiatives to close any remaining performance gaps. Over the past year, in collaboration with the National Institute for Standards and Technology [NIST], the Department of Defense, the National Security Agency, and Microsoft, we have developed a set of information security controls to be implemented on all Federal desktops, which are running Microsoft Windows XP or Vista, known as the Federal Desktop Core Configuration [FDCC]. By implementing a common configuration, we are gaining better control of our Federal desktops, allowing for closer monitoring and correction of potential vulnerabilities. Thieves use spyware to harvest personal information from unsuspecting Americans and they even use spyware to track keystrokes an individual makes, including credit card and Social Security numbers. Spyware can also adversely affect the business community who have to spend money to block and remove it from their systems. Microsoft, in fact, has stated that spyware is ''at least partially responsible for approximately one-half of all application crashes reported to them.'' Experts estimate that as many as 80 percent to 90 percent of all personal computers contain some form of spyware. In 2004, 93 million Americans experienced a spyware-related problem. From the opening statement of Tom McClintock: "And today the Water and Power Subcommittee meets to hear two bills, one of which protects valuable private water rights from efforts by the Federal Government to expropriate those rights through what should be a routine permitting process. The other bill reauthorizes the Emergency Drought Relief Act, which provides Federal taxpayer dollars for local drought-related water projects. H.R. 3189, the Water Rights Protection Act, is a straightforward measure to prevent the U.S. Forest Service from demanding that privately owned ski resorts surrender long-held water rights under State law as a condition of receiving special use permits for longstanding uses of public land. Despite over 100 years of Federal deference to State law, Federal agencies have adopted the practice of demanding that water users transfer rights granted to them by States over to the Federal Government as a condition of getting a permit to operate on Federal lands. This amounts to an uncompensated taking and is a violation of both the Fifth Amendment to the Constitution and a violation of State law, under which the Federal Government must acquire water rights through the proper channels as would any other user. There are 121 ski areas on Federal public lands, 14 of which, by the way, are on Forest Service lands in my district. These ski areas rely on privately held water rights for snowmaking, using this water as collateral for financing to build and maintain their facilities, and for supplying water to the local communities that they support." The following is from the opening statement of the Honorable Doc Hastings, "Entire agriculture economies and ways of life grew around our ability to irrigate these once-dormant lands. In our regions, respective regions, food grows where water flows. Conversely, communities wither and die when the water spigot stops. As many of you know, this is an all-too-familiar occurrence here in the San Joaquin Valley. And, if it can happen here, it can happen anywhere in the Western United States, including my home area. As Chairman of the House Natural Resources Committee, I have painfully watched the cycle that has gone on over here for the past several years. In 2009 and 2010, a man-made drought brought this region to its knees, where communities experienced 40 percent unemployment and food lines handed out Chinese-produced carrots to the victims of senseless regulatory drought. That followed, then, with two good years of water. During those relatively good times, the House passed a comprehensive bill--and, I might add, every Member on this dais voted for that bill--that was intended to ensure that man-made drought never returned. Unfortunately, that bill fell on deaf ears in the Senate and by this administration. And so now we are back yet with another drought, and this one could be far more catastrophic than the previous one."   From the statement of Gene Green: "Carbon capture and sequestration is known as CCS. It is one of the most important possible solutions for climate change. Without sequestration, coal fire power plants could go from being a low cost option to a high cost option if Congress regulates greenhouse gas emissions. Electricity, heating, and manufacturing costs could rise economy wide, at least, in the short and medium term. Cost models for climate change legislation are highly dependent on the development of future technologies which are inherently difficult to predict. Several models do tell us, however, that one of the largest variables for the impact of cost--energy cost, is the availability of CCS. EPA's analysis of the recent Lieberman-Werner bill indicates that CCS could account for 30 percent of the CO2 reductions by 2015, which would involve injecting many gigatons of CO2 underground. If CCS were unavailable, these reductions would have to come from elsewhere and, likely, at a higher cost. CCS has two major components, capture and sequestration. To date much of the attention has been on capture. Last week our Energy and Air Quality Subcommittee held a hearing on the important legislation introduced by Chairman Boucher to move capture technology into the commercial phase. We are holding our hearing to inform Congress of the geological opportunities to sequester carbon and potential risk of underground injection of CO2 on a massive scale." The level of cooperation by the Government of Uzbekistan, Kyrgyzstan, Tajikistan, their level of cooperation with these three governments has been outstanding since 9/11. There has even been a respectable level of cooperation with Russia in Afghanistan and in other regional hotspots. During most of this period, terrorism in Central Asia was kept to a minimum. However, since 2010 there has been an increase in violence by Islamic militants in Central Asia. A closer look at security risks in the region north of Afghanistan is long overdue, and it is imperative as we move to a U.S. pullout of troops by 2014 that we focus on what that will result in, in those countries just north of Afghanistan. The point of today's hearing is to examine what efforts the United States is making to keep Central Asia stable and to improve relations with the states in the region."
