"H.R. 883 would amend the current process for issuing nondisclosure requirements for subpoenas in certain cases of child exploitation. Under current law, a formal court order is needed for such nondisclosure requirements. Under the bill, a nondisclosure requirement could be placed on a subpoena if the subpoena is issued concurrently with a certification that disclosure of the summons could have certain adverse consequences on the defendant or the trial; a formal court order would no longer be necessary. Based on an analysis of information provided by the Administrative Office of the U.S. Courts on the number of cases that would be affected by the bill, CBO [Congressional Budget Office] estimates that implementing H.R. 883 would have no significant effect on the federal budget."
