ABSTRACT

United States Foreign Intelligence Surveillance Court: Memorandum Opinion and Order   [open pdf - 37MB]

This document is compiled from Parts 1-9 of the judicial review of the U.S. Government's submission before the United States Foreign Intelligence Surveillance court, concerning "the acquisition of certain telephone and Internet communications pursuant to Section 702 of the Foreign Intelligence Surveillance Act". "For the reasons set forth [in the Memorandum and Opinion], the government's requests for approval are granted in part and denied in part. The Court concludes that one aspect of the proposed collection - the 'upstream collection' of Internet transactions containing multiple communications - is, in some respects, deficient on statutory and constitutional grounds."
